Looks like we are trending up and possible new 3G licensee as speculated. Where there is smoke there is fire. that's what I thought this morning when I openned up my account and the share price keep rising...someone in the know got in early.

jai, I totaly agree with you. Look at Qualcom, most OEM are lining up to license...Qualcom will sue you in a heartbeat. They won't hesitate. The end result is respect and fair value or more for their IPR.
No more Mr. nice guy or "future cooperation." No such thing as cooperation in this environment. If they can make money using your IPR without paying they'll do it...no ethics. the name of the game is being proactive and depend your IPR vigorously because tommorow if you wait, you may end up with nothing. Can you imagine the hard work of all this unsung heroes (the engineers and inventors)at IDCC...all their work down the drain..no substantial revenue realize. I do hope someday they will realize their dreams like all of us, because they are the ones that has the hardest work in addition to endless waiting. Management, if you are listening, don't do it for us, do it for your engineers and inventors. Do it while we still have time for 3G. We don't want the 2G cycle to repeat itself in 3G.
Don't worry about so called "cooperation," if you have the goods produce by our top notch scientist, engineers and inventors, they will use it or others will use it..learn from Qualcom...follow the example of Qualcom. By the way, I am not a trader, I'm long IDCC.

Based from Howard statement that we have it in all or we are covered in all modes of 3G, i am assuming therefore that any OEM producing equipment whether infrastructure or handset will be infringing IDCC in some way or another, correct me If I am wrong.
I guess the posture will be let's not sue them yet because they are not producing infrastracture or handset that much yet. Let's wait until they produce critical mass then sue them.
My question, is IDCC afraid that if we sue them now they will stop infrastructure installation and may be circumvent our IPR or use alternative IPR. I thought we have it all in 3G, again correct me If I am wrong. I don't think an OEM can delay 3G equipment installation if the demand is there....others will fill the gap.
from other post, someone assumed that MOT and ERicy are possible triggers for NOK and are now currently infringing IDCC IPR for sale of 3G equipment.
My point is, we're going to end in court litigation anyway whether now or 3 years from now gauging from past track record. Why don't we start the litigation process now and by the time they mass produce we will have a court ruling by then i.e., NOK triggers.
Unless by litigation the triggering OEM's will get upset and use alternative IPR for their equipment. Do we really have the IPR for all modes? if the answer is yes, then why are we afraid of suing them now, they have no choice but use our IPR.
I understand that in 3G, wordings are more specific than in 2G and should be peanuts to defend our IPR in court, let alone chairing some of the standard commitees.
This question is for all.

I would think Judge Lyn would give enough time for this colossus multinational corporatioon to hear their case...since it is scheduled at 4:30 PM leads me to believbe that she doesn't want to waste time and will rule in favor of IDCC...not to unseal the documents or perhaps declare that she has no jurisdiction over this issue....if this is the ruling then proceed to arbitration.
Heres the question that twelvebees asked that has not been responded to by ourlegal circle: why would arbitration panel take a year to decide if according to what the legal minds afforded here that this is simply a case of contract law?
I think teecee may be right. Just an opinion from a non-legal mind.

It's just the constant litigations, arbitrations and delays that seems to haunt them that bothers me...not be able to go over the hump.

Based from your analysis, I think Mr. Espy is a good candidate to represent me as a shareholder and will greatly enhance shareholders' value. I will go out on the limb to declare my support for Mr Espy (Mr. Espy you have my vote if you decide to run for Director I don't see anything wrong in your credentials, in fact it is excellent and with Rmarchma on your side you have an exceelent adviser). If he turn it down, Lets get James Baker, Dick Cheeney or others with polical connections. If we sweetened the deal why not. Just my opinion as long as all is done legally.....just another way of doing business.
The bottom line is enhancing shareholders value amd affording shareholders more information to make critical judgement in their investment which the current directors are failing.

Are we expecting a response from IDCC today?
Perhaps Ericy is confident that IDCC will prevail and IDCC requested them not to get involve for now in oreder not to appear like they are ganging up on NOKIA (David and Goliath scenario). However, if judgfe Lynne favor unsealing of the documents, then that's the time Ericy will file their motion. I still think some positive negotiation is going on. To me it is good news until we know it for sure.

Possible reason for the delay:
1. F & J is derelict of their duty. (I don't think so)
2. Computer virus ( Jim said, they don't file electronically)
3. Critical talks (negotiation) in the works.

Hoa, F&J are very efficient lawfirm. I don't think they will be derelict of their duty filing on time. I think something big is going on.....maybe Howard is threatening to sue NOK big time for defaming his character on alleged insider trading......and NOK is concerned and just want to settle this matter. Just my opinion
maybe high level negotiation to settle going on...and IDCC don't need to respond or change the tone of their response. Hence the delay. Just my opinion

rmarcnma, thank you, great letter. Please send it over to Nokia. Can you draft a generic letter we can all send to our Senators and congressperson.
We shareholders are losing a lot of money because of this unfair tactics that Nokia is waging with IDCC. If IDCC is unwilling to fight the battle full force due to some commercial restriction, let's all shareholders unite and make Nokia pay in whatever legal means.
It seems like a win or lose situatin here now, specially for those long timers. When you're this long with this stock, it is difficult to give it up, walk away and surrender (as long as fundamentals didn't change) , after all those years of waiting. It is near yet it is so far away.
If there's any one willing to lead a shareholders letter writing campaign? I will be a willing participant not a leader.
