GENM filed with the SEC for a while, then deregistered themselves. The consultant who assisted their reverse merger and initial listings was Michael Ash of Ashbyrne Inc. The Byrne part of Ashbyrne is the infamous Terence Byrne, who's apparently not involved with GENM, but has quite an amazing history. Here's a taste...

Another interesting note from the Venice indictment involves a now defunct British firm called Allivane. The indictment identifies Allivane as one of several firms involved in secretly supplying Iran with armaments. According to the Venice indictment, Allivane supposedly supplied millions of fuses to Iran that were used to detonate artillery shells. But Allivane did not just concentrate on helping to arm Iran.
Allivane also had contracts to supply Iraq with a million artillery fuses and it was to help construct two high-technology fuse assembly lines in Iraq. In early 1992, two former Allivane directors were convicted in Britain of illegal arms shipments related to the Iraqi fuse deals.
What is interesting about Allivane is that it was set up and run by an American man named Terry Byrne. Mr. Byrne, who was never indicted for the Allivane deals with Iraq, is reportedly back in the United States. He has a very interesting background, very much like Mr. Gerald Bull, who was assassinated in Brussels. I brought out a little of his history. I will bring out more later. Mr. Bull was the developer of the giant gun that he enabled Iraq to possess.
Prior to starting Allivane, Mr. Byrne worked for a Pennsylvania-based firm called ISC and prior to that, a New Jersey firm called Rexon Corp. ISC was founded by James Guerin, who is serving time in jail after being convicted of, among other things, illegally shipping military technology to Iraq.
Rexon, a New Jersey-based firm, is currently under criminal investigation for illegal shipments of artillery fuse parts and technology to Iraq. Rexon's activities involved a contract to provide parts for an Iraqi artillery fuse project being run by the assassinated ballistics genius Gerald Bull and his Space Research Corp. Rexon is also under investigation involving Chilean arms dealer Carlos Cardoen's activities in Iraq.
The committee has attempted to contact Mr. Byrne and Rexon. For the present, Rexon refuses to talk and Mr. Byrne remains elusive. The committee has many questions for both of them and wants to know if BNL Atlanta loans figured in the fuse deals with Iraq.

GENM doesn't seem to have a clue what the rest of the industry is doing, and they're dreaming if they think a 10k-tune site is going to have any impact whatsoever with competitors like Walmart, Apple, Microsoft, Sony, RealNetworks, Virgin and soon Yahoo. Compare the recent PRs from GENM and Virgin. (Try not to laugh too hard at the wannabes from Montreal.)
Virgin launches US music downloads

BRITISH tycoon Richard Branson's Virgin Group is jumping into the market for online music, with a "Digital Megastore" offering US customers song downloads for US99c ($1.40).
The move pits the British magnate's company against the popular Apple iTunes music service, Microsoft's MSN and others offering pay-per-download.
Virgin said it would offer more than one million songs on its site and would be selling at least 50 portable music players.
"Virgin stands for innovation, fun, and an absolute dedication to customer value," Mr Branson said in a statement.
"We worked directly with passionate music fans around the world and together we've come up with a digital music service that truly defines the Virgin energy and spirit. It's time for a digital music revolution."
The venture is a new challenge for Mr Branson, the tycoon who made his initial fortune in the record industry, heads Virgin Atlantic airlines and has also launched a string of other companies in sectors such as railways, mobile phones, internet access and soft drinks.
Virgin also will offer a subscription-based service, called Digital Music Club, for $US7.99 per month, allowing unlimited access to its library, and a streaming music and radio service.
This offers a lower price than some rivals for this type of service, which would allow users to listen to an unlimited amount of music from their computers but not transfer to CDs or other devices.
"They will have the challenge of educating the customers and make it clear that you don't own your songs if you stop paying your bills," said Gartner analyst Mike McGuire.
Mr Branson's venture is a relative latecomer to the burgeoning market for online music downloads.
Apple became a quick market leader last year when it launched its iTunes services, aiming to offer a legal alternative to song-swapping, which has spawned legal action from the music industry.
Apple says it has sold 125 million song downloads and has a 70 per cent market share of the legal digital music market.
Another major player is Napster , which was initially a file-swapping service until forced into bankruptcy by lawsuits, and then was purchased and transformed into a fee-based service.
Wal-Mart, Sony and RealNetworks also offer similar services, and Yahoo is widely expected to launch one soon.
But strategies vary for the different online music ventures. For Apple, the service is seen as promoting the sale of its popular iPod music players; for Microsoft, it helps promote its Windows operating system by offering music in the WMA (Windows Media Audio) format.
Apple, Sony and RealNetworks use their own technical formats; each format is generally compatible with specific music players, and Microsoft appears to have an edge in the number of devices using the WMA format.
Virgin, which has adopted the WMA format, claims it will make up for its late arrival with extra customer service, including live online music and technology assistance, and links to album credits and artist biographies.
Mark Mulligan of Jupiter Research in London said Virgin's experience as a music retailer can provide the company with an edge.
"Retailers such as Virgin . . .have an ongoing relationship with their customers, so it's a lot easier for them to migrate customers (to the internet)," he said.

Dismissed is dismissed, spree...it's over. Since it's a lower court, the plaintiff can of course appeal the decision, but I would wonder if there are any grounds for such an appeal. One can't simply say that they don't like the decision and appeal. There must be a valid reason for an appeal, and my layman's eye doesn't see one here. None of the usual proponents of the naked-short conspiracy theory have suggested that an appeal would be considered.
Furthermore, while O'Quinn took JAG's case on a contingency basis, I would wonder if he would prepare a costly appeal without insisting upon a retainer.
I expect that JAG's next periodic filing will contain a statement about the litigation. Indeed, it's required.

The case is over spree, for all practical purposes. There's some formalities yet before the court closes the book on it, but that's just paychecks for the lawyers. It was only an important case to the Stockgaters. To the rest of the market, and particularly to the defendants, it was simply an annoying nuisance.
I posted a link to the full text of the Judge's ruling on the motion to dismiss. I also posted the docket which shows earlier dismissals of numerous defendants. But don't let reality stop you from sailing on that big Egyptian river.
The comet came and went, spree. You missed it.
Good luck with your fantasy price, but I doubt you'll ever see the stock trade over a dollar again. There is little intrinsic value in the company, and the oft-touted short squeeze will never happen. Indeed, as time goes on, the get-shorty story will be thoroughly discredited as a toutish strategy that was used to prop up numerous worthless penny trash stocks.
Why do you either consistently misinterpret my comments or invent comments that I haven't posted? If all you know is GMXX's price, then you know so little that you really shouldn't offer any opinion about it.
JAG lost because they (as represented by their attorneys) could not convince the Court (given three attempts) that they could make a case against the numerous defendants. Have you read the dismissal? I suggest that you do before you mischaracterize it further.

It was only an important case to those of us who have been following the get-shorty phenomenon for years. It was important because JAG was positioned as a kind of flagship among the penny trash who have been claiming victim status, and because the 'greatness' of its counsel was so often touted on the boards.
In the larger framework of the marketplace and the world in general, it was but a failed attempt by a company with a broken business plan that trades on the pink sheets, and as such not really very newsworthy.
It doesn't work that way, spree. The reason that JAG lost its case is the they were unable to produce evidence that there was violation of the law by the numerous defendants. It is the responsibility of the claimant to produce evidence in support of a claim.
Speaking of evidence, or lack thereof...what has happened to GMXX's cases vs. the brokerages?
If that were true and I were as successful as Warren B., then I would buy IHUB to run as my own playtoy, and would set up a Krispy Kreme franchise for Fatt Matt's personal use. LOL!

GMXX didn't run on massive short covering at all, but rather it ran on an orchestrated pump with most of the outstanding shares from the initial private placement locked up to limit the float. Of course, the promoter ICI's shares weren't locked. The 'short covering' was a (ahem) cover story.
Indeed, the smart money--the promoters and those with private placement shares--more than likely sold short as the orchestrated spike peaked, covering later with their cheap shares. The terms of the lock-up and private placement were never disclosed publically, so we don't know if there was an anti-shorting provision. From the price action at the top of the spike, I'd wager that there was no such restriction.
Bezz- Reality seems to bother you.
Consider for example, the latest fluffbomb from CDVJ. Cortellazzi can't even get the terminology right as the release states "10-15 oil fields in Trinidad Colorado", but I'm sure he means oil wells. There aren't that many oil fields in Las Animas County, where Trinidad is located. LOL!
In fact, NOBODY seems to be pumping much oil in Las Animas County. Evergreen is the major producer there--of natural gas, not oil.
There is a wealth of information available if you know where to look.
The 'motions' have provided convenient excuses for a host of penny trash stocks who jumped on the GetShorty bandwagon. The idea was perpetuated by the likes of ICI and Investrend, who used the concept as a centerpiece for promotion. Investrend has been noticably quiet about the JAG dismissal.

It's clear that it's all over but the shouting, and that the final dismissal of the entire case is but a few formal gestures away. If JAG want to appeal, I expect that O'Quinn will make 'em put up a hefty retainer. Meanwhile, all the 'get shorty' nonsense can be put in a hefty container. LOL!

Attempts by the penny stock promotion community to create the impression of a national financial scandal brought about by "illegal naked shorting" of micro cap stocks trading on the NASDAQ OTC-BB service and the privately held Pink Sheets, Inc., were dealt another serious blow on September 3, 2004. On that date Presiding Judge Vanessa Gilmore, Southern District Court of Texas, granted a motion for dismissal filed by over seventy securities industry firms named in the case: Jag Media Holdings, et. al. v AG Edwards and Sons, Inc. et. al (CV 02-2867) Judge Gilmore noted in her lengthy order of dismissal that despite three attempts Jag Media's attorney John O'Quinn of Houston, Texas, had failed to provide minimum factual support of the suit's claims, and had failed to state a course of action. O'Quinn is a controversial trial lawyer who became national known because of his successful fraud prosecution of class action complaints against silicon breast implant manufacturers and against "Bib Tobacco," collecting tens of millions of contingency fund fees from the awards in those cases. O'Quinn, a controversial figure in Houston, entered the "illegal naked shorting" arena with much fan fare, hailed in penny stock press releases as famed trial attorney John O'Quinn. According to sources knowledgeable of his arrangements with penny stock companies he represented, O'Quinn initially agreed to take these cases on a contingency fee basis. The same source reports he subsequently required a $1 million retainer for new cases.
The pattern of O'Quinn's complaints was virtually identical in all cases file by him, or by firms affiliated with him. A small stock trading on the OTC-BB or Pink Sheets would name scores of brokerage firms, market making firms, and convertible debenture financiers of conspiring to "naked short" the hapless company's stock, driving its price into the ground. All filings were long on claims and short of factual support of the claims. The latest blow is his forth loss in similar claims in a row, and besides Jag Media, include dismissals of O'Quinn pleadings on behalf of Endovasc, GeneMaxx, and NuTex (now Datascension).Company promotional releases featuring his work in the remaining naked short suits refer to him as a "wealthy Texas attorney," Rather than as a "famed trial lawyer."
In some ways Jag Media was the poster child of the claims made of widespread "illegal naked shorting" that was driving down the share price of penny stocks. Jag's former CEO, Gary Valinoti had made numerous claims that his company-which has no significant assets or operations-and put his long suffering shareholders through three of what he termed "recapitalizations." These recapitalizations were, in fact, requirements that shareholders obtain and exchange paper stock certificates for a new issue of certificates. These exchanges could supposedly reveal the existence of "counterfeit" shares and cause a short squeeze, driving up the price of the stock as investors who had naked shorted the stock were forced to buy shares in the open market to cover their delivery commitments. The third recapitalizations, which also involved a move to certificate only trading, resulted in a prolonged period of almost total illiquidity, with shareholders awaiting delivery of their new shares being unable to trade. That prolonged illiquidity and yesterdays WSJ.com announcement of the ruling by Carol Remond has led to a 80% to 90% drop in Jag shareholder value. None of the claimed naked short position-Valinoti had once claimed that it was over five times the actual available shares of JAGH was ever revealed, and the final recapitalization has resulted in Jag Media being delisted from the OTC-BB services to the Pink Sheets.
To date Jag has made no public statement on the Judge's ruling, and InvestmentWire, which daily touts the latest "naked short" scandal in which hundreds of companies are "involved, did not report the story.

From the dismissal...
...there are multiple deficiencies within the Third Amended Complaint. Claims against Moving Defendants are subject to dismissal for failure to sarisfy Rule 9(b)'s and PSLRA's particularity requirements and failure to adequately plead scienter. Claims against Moving Defendants are further subject to dismissal for failure to plead specific misrepresentations or manipulative or deceptive acts by the defendants. Plaintiffs have had more than a year to state their claims, in addition they have had the benefit of thie Court's September 2003 Order as well as numerous motions to dismiss. The only conclusion this Court can come to by Plaintiffs' continued failure to meet the standards set forth in the Court's Order is the Plaintiffs do not have a viable claim against the Moving Defendants. Further, grounds for dismissal might well exist in Moving Defendants' arguments that the Court did not address. The extent of the deficiencies in the Third Amended Complaint is a strong indication that amendment would be futile.

Subsidiary? CSJJ WAS wholly owned, but can't possibly be now. Both stocks are totally manipulated pink sheet trash, and 'market cap' is more or less meaningless.
Likely driven by wash trades to create the volume and initial price appreciation. Further volume was triggered as bagholders took their opportunity to get out and greedy new bagholder wannabes ran the price up further. That said, there really wasn't much money traded today--less then $100k. GOOG traded $240MM and CMKX traded about a million bucks worth.

1) hasn't taken control yet, and
2) must elect a new Board of Directors, who
3) must prepare a new set of by-laws, and
4) have it approved by its members
...before any deals can be negotiated. Cortellazzi has been dangling this mouldy airport carrot in front of investors since he took over the PAVP shell and issued a series of press releases claiming that everything was a done deal.
