The United States supports comprehensive initiatives based on EU regulations that strengthen the economies of the Western Balkan countries and bring them closer to Europe.

Seven years since the lawsuit was filed, and the trial for the construction of the Lake Park Playground has not yet been completed.
"Lost energies, long waits, delays in the process, long hours in courtrooms", these are the memories of the activists who sued the Municipality of Tirana for the playground project.
" I remember the session where the court rejected our request for a lawsuit. I remember the reasoning because it seemed to me an arbitrary and abusive decision ", recalls the activist Rezarta Çaushaj. She has participated in the protests at the Lake Park as well as in the protracted trials against the Municipality of Tirana.
" The judge allowed the continuation of the works, as they had started and in short the damage had been done ", says Çaushaj.
Environmental organizations face a long bureaucratic ordeal when it comes to environmental crime lawsuits.
First, the Albanian environmental legislation does not contain special rules regarding the criteria that these organizations must meet in cases of filing lawsuits in court, unlike the legislation of the European Union.
A study by the ResPublica Center for Collective Lawsuits and Albanian law shows that citizens enjoy the rights of environmental protection by law, but not only are these rights not respected, but often the adoption of administrative acts in the field of environment has caused damage to irreparable in the environment ”.
Lawyer Irena Dule from ResPublica says that the biggest obstacle in this regard is the prolongation of a trial beyond the reasonable time.

Other logistical barriers remain the high costs that organizations have to bear.

Apart from the fact that the case of the TOKA Association today can be considered positive, it has gone through a long bureaucratic ordeal since 2016.
According to activists, this process, which has lasted for years, has been used not infrequently as a means to tire organizations and "stifle resistance."
The lack of law has left the interpretation to the judges, who in similar cases have acted differently.
The first case where the Court acted differently and agreed to review the lawsuit is the case of Vjosa.
37 citizens together with EuroNatur, Riverqatch and Eco Albania filed a lawsuit against the Ministry of Energy and Industry for the protection of the Vjosa from the construction of the Pocem HPP.
The case was taken to trial and was a case of success in terms of legitimizing the lawsuit.
The court has legitimized both the residents and one of the plaintiff associations on the grounds that the plaintiffs were registered as residents of the area where the hydropower plant would be built and are therefore interested parties.
Meanwhile, in the case of the lawsuit of the TOKA Association together with 27 inhabitants, against the Ministry of Infrastructure and Energy, the Ministry of Tourism and Environment, regarding the construction of two HPPs Dragobia on the river Valbona, the Court acted differently. The court rejected the lawsuit with the argument that " for the plaintiffs to address the court with a lawsuit must have an interest, where the latter must have some elements, be legitimate, personal and direct, born and acted l".
The Court then acknowledged that the plaintiffs had the right to go to court for information matters and for matters where they claim to be part of the decision-making. But on the other hand he argued that " the construction of hydropower plants is not part of Annex 1 and the plaintiffs do not prove a legitimate interest ".
The court held that indeed the plaintiffs had the right to go to court, but they had to prove that the environment had been harmed.
Catherine Bohne, an activist with the TOKA Center, told Citizens Channel that in 2017 the court argued that any decision taken by the government “ was taken in the best interest of the population, so for the population to oppose such a decision is absurd, and for therefore the rights of Aarhus do not apply .
She shows that from her experience "courts cooperate to make the process as long as possible".
" When a hearing is scheduled, 2 out of 3 times the judge does not appear, causing the hearing to be postponed for months or even years ," said Bohne. The Valbona case went to the Supreme Court.
After a 6-year battle against the construction of HPPs in Valbona, the residents of the area reaped a delayed victory on July 21, 2021, when the Administrative College of the High Court decided as a security measure the suspension of the concession contract for HPP Dragobia and Çeremi, thus turning it into a positive practice. But the government turned a blind eye to the decision, as the HPPs continued to operate, although the court ruled otherwise.
"Residents do not have the right to sue"
Another case in point is the opposition to the construction of a Playground at the Lake Park. The obstacles in this case are even greater than in the case of Valbona.
The argument used by the Court in the Lake Park case was even more complex, as in this case it required the plaintiffs to prove that they themselves had suffered damage and that the fact that the environment had been harmed or that the arrival of a damage.
The Playground project was not only not done with a public consultation but in February 2016, without any prior public notice and before the approval of a valid administrative act, a part of the Lake Park in Tirana was surrounded by the Municipality of Tirana.
The plaintiffs argued that the project was illegal, which was also opposed with protests by citizens and activists.
The lawsuit in this case was made by engaged citizens represented by lawyers of the ResPublika Center. They sued the Municipality of Tirana and the private construction company regarding this activity.
" It was a very discouraging decision for some time, but the way the municipality, assisted by the government formally coped with all legal abuses in a record time, motivated us to continue the fight in court ," recalls activist Rezarta Çaushaj.
Their lawsuit was dismissed by the Tirana Administrative Court of First Instance, which ruled to dismiss the activists' lawsuit, arguing that they, being not affected owners of the lake, were not directly harmed.
On this reasoning the court did not delve into the arguments for the illegality of the project implementation.
The decision was upheld in December 2020. The Administrative Court of Appeal, unlike the Court of First Instance, recognized the activists' right to sue, but did not properly assess their inquiries regarding the illegality of the project.
The case was referred to the Supreme Court by the lawyers of the ResPublica center.
Dule states that “ it is aware that it will not have an effect on the damage already caused to the environment, but will be valid in the form of a strategic litigation, the aim of which is to establish a good practice, to be followed in issues of the future ”.
"The battle continues to hear the highest court in the country and why not to ask it to unify the case law regarding legitimacy, security measures, and other issues raised there ," says Dule.
" The lawsuit has already traveled for 6 years from the First Administrative Instance, which did not legitimize our appeal, to the Administrative Appeal which legitimized it and now that the lawsuit has gone to appeal to the High Court, " says activist Rezarta Çaushaj.
She says that despite the fact that justice "is not very hopeful " in the case of Lake Park, activists want to give a message " that the fight for a cause must continue until the end ."

Dubai Electricity and Water Authority (Dewa) has announced that Mohammed bin Rashid Al Maktoum Solar Park, the largest single-site solar park in the world being built at an investment of AED50 billion ($13.6 billion), is set to achieve net-zero emissions by 2050.
The solar park has a planned capacity of 5,000 megawatts (MW) by 2030 and once completed, it will reduce over 6.5 million tonnes of carbon emissions annually.
According to Dewa, the solar park hosts two pioneering projects - The Innovation Centre and the R&D Centre.
The Innovation Centre supports Dewa's efforts to enhance innovation and creativity in clean and renewable energy and raise awareness on sustainability, in addition to strengthening national capabilities and enhancing business competitiveness.
It also provides visitors with a unique experience to explore the latest innovations in clean energy technologies, said the statement from Dewa.
The R&D Centre supports Dewa's efforts to anticipate the future, develop proactive, long-term plans to keep pace with the Fourth Industrial Revolution by developing disruptive technologies.
It has the largest and most comprehensive solar testing and certification facility in the UAE, and it operates the longest continuous testing of photovoltaic panels in the UAE in desert climate conditions, it added.
Saeed Mohammed Al Tayer, MD and CEO of Dewa, said the regulatory frameworks in Dubai, which enable the private sector to take part in energy production projects in Dubai, have encouraged international investors and developers to participate in the solar park's projects, which Dewa is implementing using the Independent Power Producer (IPP) model.
"We have attracted investments of around AED40 billion through this model in public-private partnerships. The project also received the lowest solar energy prices (Levelised Cost of Energy) globally five consecutive times, making Dubai a global benchmark for solar power prices," he added.
According to him, the current capacity at the solar park is 1,527MW using photovoltaic solar panels.
"We are implementing more projects with a total capacity of 1,333 MW using solar photovoltaic and Concentrated Solar Power (CSP), in addition to future phases to reach 5,000 MW by 2030. The clean energy capacity share is currently around 11.4 percent of Dubai's energy mix, and is expected to reach around 14 percent by the end of 2022," added Al Tayer.

Seventy six-year-old Ahmad Mohammed Falaknaz, the head of the prominent Falaknaz business family, has seen Dubai grow from pearling to the laptop era. Spanning almost a century of growth and development, he has seen skyscrapers rise from humble beginning because of "the visionary leadership of the late Sheikh Rashid bin Saeed Al Maktoum".
"I have seen the country grow, especially after 1958.
Before that there was not much happening except trade which was largely limited to Dubai and Sharjah," he said.
"The growth gathered momentum after oil was discovered in 1962 by Dubai. However, the credit goes to the late Sheikh Rashid bin Saeed Al Maktoum, was so motivated to create the emirate of today.
"I remember he had travelled with a group of friends to London for the first time, for an operation. After the surgery, his friends wanted to stay back for a while and take in the place but he said no, "our future is in Dubai" and came back immediately.

"The industry suffered a huge setback when the Japanese introduced cultured pearls, which were smoother, perfectly formed and cheaper. Now life has come a full circle and natural pearls are extremely valuable," he said.
Ahmad Mohammed started his business with textiles and foodstuff in India, where he lived for many years with his family. After his father passed away, he returned to the UAE to take over the reins of the company.
Reminiscing about his past, Ahmad Mohammed feels life has been good, despite its many challenges. He is happy with what the years have offered him and his current hope for the new year is to see his 23-year-old grandson Mansoor married. His son Abdul Rahman Falaknaz, who is 54, agreed that would be a key part of the family's agenda for 2002, along with watching and ensuring the family business' growth.
He said, "I studied in Mumbai and was a keen sportsman, so the first business I set up after my education in 1962 was the Emirates Sports Store, followed by the Falaknaz General Enterprises for building materials.
"The family business is run by my brother Amin, who is two years younger and I. Today we have diversified into medicine, furniture, Habitat – which is 25 years old, real estate, jewellery and exhibitions. We are a medium-sized company that is trying to keep pace with the growth of Dubai. The destinies of the country and its people are intertwined and a strong economy such as the UAE supports that.
"The past year has been difficult, but Dubai has been untouched by it. In fact, it has grown, with the opening of the Dubai Media City, e-services initiative by the government and other institutional developments.
"However, I expect 2002 to be good businesswise, especially by the second quarter based on international and local projections. On a personal level, life has been good and I have no complaints," added Abdul Rahman.
His 34-year-old son Mohammed Abdul Rahman Falaknaz would beg to differ on this account. He said: "I want my parents to take holidays more often and especially my father to take it a little easy at work.
"He made sure that life was easy for us when we were growing up and I would like to do the same for him. But it is very difficult to get him to stop.
"Last year has been tough, especially as I took over management of a lot of the business interests from my dad. It got quite low and the only way is up, so I am hoping for 2002 to be a good year.
"With each passing year, the market becomes tougher and challenges increase. In my son's time, I expect it to be even more difficult."
The youngest Falaknaz male, seven-year-old Rashid, is more blase about the new year. He likes to learn new things, with interests ranging from taekwondo to travelling and he hopes to continue doing that. Otherwise life hasn't been exceptionally tough on the young computer wiz, who manages to give IT tips to his grandfather.
Together, the Falaknaz family is anticipating a good 2002 with the business pacing up and more leisure time to follow hobbies such as cricket and fishing.

Albania is blessed with water: has 39 rivers which discharge on average about 1250 m3 /s (40 billion m3 of water per year) in the Adriatic Sea and the Ionian Sea. Albania with a total surface of 28 748 km2 is a highland country where 70% consists of mountains, hills, lakes and rivers.
The hydro graphic territory of Albania has a surface of 44,000 km2 or 57% more than national area of our country. In its catchment area it falls about 1 400 mm of rain per year. It snows in the height over 1 000 m. Due to the non-uniform distribution of rainfall during the year, river flows have large changes.
35% of the average water inflows of these rivers are used for hydro power production and approx. 1 billion m3 of water is used for irrigation of about 360,000 ha of land.
A very important role in the management of these waters play the dams built in several rivers of the country which are used for hydro power production, drinking water supply, land irrigation, flood protection, fish farming, water transport and development urban.
According to the National Register of Large Dams prepared and approved by the National Committee of Large Dams (ALBCOLD), in our country there are currently 351 large dams defined by Law No.8681, dated 02.11.2000 "On design, construction, use and Maintenance of Dams and Dams ” and ICOLD recommendations.
24 large dams are used for hydro power production, 325 large dams are used for irrigation, and 2 large dams are used for drinking water supply. In 1957, Dam of HEPP Ulza with height 64 m, was completed as first hydro power dam. The tallest dam is Dam of HEPP Fierza with height 166.5 m. It is rockfilled dam with clay core.
According to the ICOLD Register, Albania is in 19th place in the world for the total number of large dams and is ranked first in Europe for the number of large dams per 1000 km2.
In Albania there are currently 10 very large dams with a height of over 60 m and 3 main cascades built on the rivers Drin, Devoll and Mat which are used for hydro power. At the same time, they are the dams with the highest risk of damage to the economy and loss of people in the event of a catastrophic natural event or possible breakdown of a dam. The main cascade for hydro-power is Drini Cascade. It is unique in Europe in regard to the dam types and their heights, the artificial lakes created, the installed power of the HPPs and their Operational Management. The Drini river in northern Albania has been transformed into a chain of 3 artificial lakes with total water capacity of 3.4 billion m3 which supply water to the three largest Hydro-power plants (HEPP-s) of Albania. The HEPP-s of Fierza, Koman and Vau i Dejes are built in period 1971 to 1986. Their installed capacity is 1350 MW and their average energy production is 4 000 GWh per year.
All hydro-power large dams are objects of special importance and require the taking of all organizational, technical and financial measures to guarantee their normal use, longer life and non-intrusion of third parties in the phase of construction, use and maintenance.
Since 1964, Albania is a full member of the International Commission of Large Dams (ICOLD) where it participates and gives its official contribution actively in all processes of technical and institutional cooperation with international actors in this sector.

The Shala River is threatened by the construction of hydropower plants

CONCESSION
The concession contract for the construction of hydropower plants on the river Shale was signed on April 4, 2018, after an open tender by the Ministry of Infrastructure and Energy. The document envisages the construction of 3 hydropower works, 2 of which with derivation and 1 with dam. The total installed capacity will be 83.45 MW, while the concession holder is the company "3 Power Shala", created by the temporary merger of companies "Çinar-San Hafriyat Nakliyat Insaat Turizm Sanayi Ve Ticaret LTD.STI", Shala Energy PLC And Falak Properties LLC.
The concession competition for the Shale River Cascade was opened after the termination of a previous contract, signed in 2008, while at that time the ministry argued that the cause was the violation of some procedural aspects, ascertained by the audit performed on concession contracts.
"Based on the hydropower potential of this watershed, MEI decided to reopen the procedure for its use, already with a requested proposal," the ministry explained at the time.
Meanwhile, 4 years after the signing of the contract, the new concessionaire is facing violations of the terms of the contract, but contrary to previous practice, the agreement has not been abrogated. Meanwhile, referring to the contractual provisions, in case of its revocation, the Albanian state would not have any financial penalties.
"For a concession contract not to have financial consequences on the state budget, ie no penalties, it is important that the termination of this contract be done within those legal provisions that the contract itself has. That is, the contract can be terminated for justified reasons ", - explains the economic expert, Zef Preçi.
According to the document, the concessionaire was obliged to submit the implementing project within 18 months from the signing of the contract, as well as to be provided with the necessary permits and licenses for the implementation of the contract. In a written response, the National Environment Agency and the Water Resources Management Agency, told "EkoSkaner" that the company "3 POWER SHALA" has not submitted any application to these institutions, to be provided with the relevant permits, which are necessary for the implementation of the project.
Violations of the contractual obligation have been ascertained by the National Agency of Natural Resources, since the Monitoring Report of the first quarter of 2020, while the Ministry of Infrastructure and Energy told "EkoSkaner" that it has recorded them in September 2021 or more than 1 year and a half later.
The reasons for these delays remain unclear, but if the legal steps had been followed, according to the contract, the concession should have been revoked, while the financial consequences for the state budget would have been "zero".
MEI also did not provide an answer as to why no actions of unilateral breach of contract have been taken, as long as it turns out that the temporary merger of operators is in violation of some of the provisions of the concession contract, such as securing financing, breach of equipment and with permits, licenses and authorizations or it turns out that he is insolvent for its implementation.
"If a contract has legitimate reasons to be broken, but the institutions do not act, it is understandable that in this case there is a lack of political will. The lack of decision-making itself can be considered as a suspected case for narrow personal, corrupt, political, electoral interests. So, there is a community of interests that none of them contribute to the protection of public interests ", - says Preçi.
"Any decision-making that goes beyond the business cycle, that is taken for companies created specifically to obtain a public concession contract, calculates companies that have neither the technical capacity nor the financial capacity, are clearly suspicious of corrupt contracts, which leave hostages. the taxes that will be collected in the coming periods and at the same time compromise the goals of the undertaking of these concessions ", - he adds.
MEI told "EkoSkaner" that in January this year it asked the concessionaire to correct the violations within 90 days, according to contractual provisions. "If after this deadline, the concession company does not fulfill its obligations, MEI in the capacity of contracting authority, has the right to proceed with the unilateral termination of the contract," the letter reads.
Until this publication, this department did not respond whether it has initiated proceedings to revoke the contract or not.
Preçi talks about several types of responsibilities, which come as a result of violations of legal procedures by institutions.

When we consider hydropower plants, it is not just a dam and a generator, but the ecological footprint is even bigger because to build a HPP you have to build access roads, which generally run parallel to the river and the passage paths of large mammals. From our experience this has been very obvious, which means changing the ways mammals use to find their prey or prey as well as the way to find a mate to reproduce. "During the operation phase, these paths are broken, they are not restored, it takes time and investment to address them", - says Nika.

"Net domestic electricity production in this period decreased by 39.7%, reaching the value of 2,016 GWh from 3,344 GWh of energy produced in the first quarter of 2021. This production was realized by public hydropower plants at the rate of 52.8%, from private and concession hydropower plants to the extent of 46.7% and from other generators (Photovoltaic) to the extent of 0.5% of net domestic electricity production.
Gross import of electricity (energy in receipt), in the first quarter of 2022, reached the value of 715 GWh from 99 GWh which was in the same period a year earlier, thus marking an increase of 7.2 times. "Gross export of electricity (supply energy) reached the value of 373 GWh from 1,147 GWh marking a decrease of 67.5%," said in the balance sheet.
According to INSTAT, public hydropower plants, in the first quarter of 2022, produced 1,065 GWh from 1,890 GWh produced in the first quarter of 2021, thus marking a decline in production by 43.7%.
Private and concession hydropower plants produced 942 GWh from 1,446 GWh produced in the same period a year ago, marking a decline in electricity production by 34.9%.
Electricity exchange (difference between exports and gross energy imports), in the first quarter of 2022 has reached a negative value of 342 GWh, compared to the first quarter of 2021 where it had a positive value of 1,047 GWh.

About the project
Barriers in the Community: The effects of the construction of hydropower plants on the socio-economic status of the local population, is an initiative supported by LevizAlbania, which has as its main goal public awareness on the effect of unregulated construction of groups of hydropower plants in different river basins, in the quality of life of the local population, as well as the activation of the latter in decision-making on issues of special importance.
BackgroundsTraditionally, electricity in Albania is based on hydropower which stands at exactly 99.8%. Increasing electricity from hydropower generation has been the only solution and therefore, the electricity security strategy is based on increasing generating capacity. Most of the electricity generation in Albania is stemming from a combination of 3 large state offshore HPPs on the Drin River (up to 88% of the total energy produced) as well as some owned and owned HPPs. operated through private concessions. Despite all efforts to diversify the energy budget, Albania remains highly dependent on hydropower to meet the country's electricity needs. So far, permits have been issued to build more than 900 hydropower plants across the country. Most of them are small-scale hydropower plants that would contribute a maximum of 5% to total electricity production. Despite their extremely low production, their ecological footprint and their negative effect on the social aspect is fourfold high. Moreover, the process of construction of HPPs in Albania in most cases has not been carried out accordingly. Thus, the lack of transparency has led to many conflicting cases across the country. Conflicts have arisen between concession companies and local communities over the right to use water. In 2017, approximately 20 conflict cases were identified in HPPs where the number of plants already completed was about 120. In the last 2 years this number has increased and includes new areas. According to EcoAlbania, there are new conflict cases created by the development of HPPs addressed or being addressed: HPP Cem, HPP Shala, HPP Luma, HPP Zall-Gjoçaj, HPP Miredita (Kaçinari ), HPP Gjorica, HPP Kardhiq (Zhulati, Picari), HPP Shushica, HPP Seta. In most cases, conflict issues are accompanied by local protests, as they have been rejected / ignored by the authorities in their petitions and requests to stop the construction of dams. In some cases the conflict has been tried to be resolved through lawsuits (Valbona, Vjosa, Osumi, Zall-Gjoçaj) while some have succeeded and some have not. However, not all cases have been in the spotlight of the national media. The reason for the poor media coverage of these cases has been the remoteness of the places where the HPPs are located, but also the conflict of media interest with specific issues. In recent years, there has been a total lack of media coverage, beyond Reporter.al or local journalists and bloggers, of these conflicts, with the main national media not covering this topic for more than 2 years.
Purpose and Products
The main purpose of this initiative is to hold public hearings with residents of areas affected by these investments in the country's river infrastructure, the problems encountered by the latter by these enterprises, their effect on their daily lives and their future. in these areas deeply affected by the construction of hydropower infrastructure. Based on these meetings, the Working Group of the Albanian Center for Quality Journalism, with the help of local experts, aims to compile, produce and publish a series of short documentaries on the effect of hydropower clustering on local populations. These documentaries and their purpose for raising the awareness of various actors on the socio-economic impact of these investments, will be accompanied by a series of research papers on environmental and social effects, economic and humanitarian aspects of such initiatives nationwide. The products of this intervention will be shared with all stakeholders affected by these investments as well as all civil society stakeholders, international actors in the field of environmental protection, local actors, central institutions and numerous schools of journalism and civil engineering.
