the truth is, I was sending out a text to my daughter, who I just picked up from camp tonight, and so my head was down! we were wrapping up and it was all about scheduling, etc, so I thought I could sneak in a personal text :)
as soon as he said that, I turned to look behind me where Bets, Ben, James, Dorthea, Dave and Bill were sitting...totally missing any facial expression she had! by the time I looked at her, the moment had passed...
no, that's what's so funny about this. anyone would get annoyed if they were picked apart personally...I haven't set out to do that! I just tweet what I see and hear...you all know that I say that constantly! that's what makes this even more interesting.

I thought the EC was pleased with the day. Personally, I thought Maxwell held up extremely well and with JMW pushing for valuation, I don't see her not accepting his critique, but it is very much like her to take time to decide before ruling.
Our guys spent quite some time meeting in the courtroom after the hearing. I was outside talking across the street and we saw them leave possibly 45 mins after the hearing ended. I don't have a read on that other than they are clearly working hard on this.

yw! not sure if you mean the delay until Monday? I do understand that it is both a respect and a religious matter, so I put less stock in the fact that the hearing was delayed, but I am reserving judgement until the end to see if my faith in JMW is misplaced here or not.
he actually did complain about them. but that made me realize how much of a difference all of the interested shareholders are making in this case...otherwise, why be threatened by a little girl like me tweeting??

Friday, in my opinion, will be a very interesting day in court, and will tell the tale. Looks to me, from reading the EC's motion, that we have the hedge funds cornered...and that a trail back to the Debtors is fairly clear.

On balance, I don't think anyone won or loss yesterday's round. Certainly we all walked out looking as though that were the case, but it might've been the late adjournment or maybe the multiple hours spent dissecting the finer points between IRC 269 and IRC 382...
I'll have a much better feel in a few hours.

I like Seth, and I have seen him perform better previously than he did yesterday. No idea whether he'll be representing us with any of the hedgies. He's smart I think, but has not yet polished his courtroom persona.
Hard to say whether it was a tactical blunder or not. As you may recall, I greatly admire Sun Tzu and believe that an emboldened BR may be the easiest to surprise...
In any case, this case is too important for SG not to revamp the lineup if they thought harm would come. IMO

it was a great line of questioning...just so much more to it than meets the eye (that comes from structuring real estate deals and being in the investment business).
also, I will say that as I was told last December, these attorneys are among the best and they make it look easy...but once up at the lectern...not so much!!

Yes, I mentioned it. Both parties told me it was not something to worry about, timing wise.
Battle lines are drawn, and some that have been super friendly are less so now...too many potential issues of conflict. That came up in three conversations I had today...also, a third attorney has now confirmed that these boards are read and the suggestion has been made that matters of immediate courtroom strategy (maybe all, but that wasn't said) are best left off the boards. FWIW.

A very long day, and hopefully you all have the case's issues worked out over already...
A few general comments as I quickly read over the last few pages of ihub posts...
1. No one left that courtroom looking exceptionally happy (no, it wasn't just the long day or that arduous testimony about section 269 vs. section 382). We won a few, so did they (so the mood went).
2. This taxation stuff is confusing, and I have my ideas of what we might be trying to accomplish...but mostly the key here, I think, is what is possible. Since the IRS doesn't issue letter rulings on 269 in advance, we only to have to make the point that all the NOLs could be used if the deal is done correctly (and convince JMW).
3. Today was laying a foundation, and thankfully its over! Tomorrow will be meatier, Friday the best. We will continue into next week...
of course I will!! I will tweet all of the key players...but especially if there's a Susman sighting :)
