If your version is correct then why would Genzyme a $16 Billion dollar company have anything to do with CBAI.OB through it's partner Osiris; a past and present known fact? Why would BCBS name MSCs as the next cure for SCI, heart, and other ailments; presented Jan 2011? I listed the links to backup the vision... it's a future vision from the triology. Tooth pulp MSCs + placenta MSCs are the future for CBAI. MSCs have been the future for Genzyme/Osiris; fact! Osiris hasn't turned a profit yet it has a $16B dollar backer; fact! The attorney for CBAI wants to dismiss the case (according to his spelling) on the grounds of holding undoing paying having adequate power.

For the CEO (or any CEO) to describe a lawsuit as a 'nuisance' is unprofessional. Matt seemed to have been speaking to a message board audience rather than addressing the entire investment community as a whole.
I still think the CBAI lawyer made the spelling mistake, if it was me in Matt's shoes I'd fire that attorney immediately.
As for the other lawsuit you speak of that is what the courts are for to seperate fact from fiction. Some could easily come under Department Of Justice scrutiny for thier 'opinions' as well.

I think the misspelling occured from the company lawyers and not the court staff. 99.999% of the time inputed the information is exactly as it is presented to them because they read it directly from the court documents. It sure looks like CBAI hired a not so competent attorney. Laughable indeed.

Grant Date 12/31/2009 Matt received Option Awards (# of Cord Shares) of 242,929,000 shares at a excercise price of .01 (during the grand opening run) which he cashed in for $2,672,219, in addition to the bonus of $49,500 plus his $165,586 base salary.

Matt's total compensation was $3,586,093 in 2009. He received a annual base salary of $165,000 through July 14, 2009. It's in the 2009 10-K.
Matt receiving $3,586,093 for 2009 does seem a tad lop sided compared to the company's $3,237,183 total revenue for 2009.
Indeed, Matt mistakenly projected the company being cash flow positive by June 2009.
