I don't see it as a delay, Borgon. If anything, it should keep the process closer to schedule. Mr Guyer's decision to bring in experts should help provide verifiable information countering the requests of INFORM that more study be required. KP&Co can provide empirical evidence that the concerns raised are not really concerns at all.
As far as paying for the services, does it really matter as long as it gets the POW mill started? The next quarterly report will tell us how much and by what means KP& Co. are being paid. Not employing them at this point would be "penny wise and pound foolish".
To my viewpoint, this shows that Mr. Guyer is not playing around. He is bringing everything he can to bear so the DRMS is informed and satisfied with the proposed amendment.
See post #47731 by LJSilver. It seems the gentleman described (Bryan Ulrich) has just about every type of experience necessary to help CGI. (Paste tailings are the similar to Dry Stacking. A low moisture content is considered "Paste" if it can be pumped through a pipe. "Dry" or dewatered tailings need to be transported by conveyors or truck.)
I think the experience that Bryan Ulrich and KP&Company brings to the table is more for assurances to the DRMS. But after M-1984-049's amendment #AM-03 is approved, his services will be more valuable to CGFI's implementation of the process.
Thanks LJ. I may just go to that show in Las Vegas in September. It would be interesting to see what they have to say about the POW mill. (Assuming that any of their 750 employees that are helping POW or CGFI are there) Just in general, gathering information about the services they offer to further the dry stack process would be helpful. I think it might be worth the $100 registration fee for some 'one on one' conversation about gold mining in Colorado.
Small price to pay for that plus lots of neat freebies at a show like this.

The chopper ride is supposed to be fantastic.
A car ride to the Grand canyon from Sedona is not too long, about 2.5 hrs. But about an hour (I think) north is Williams. You can catch an older style (1940 -50's era) train right to the south rim of the Canyon. You need a whole day just to see the canyon from the rim. If you are going to the canyon floor, you really must stay down there and come up the next day. It's not mandatory, but it just adds to the fun & majesty of the experience.
Seeing it from the ground is fantastic, from the air must be breathtaking. (That's on my bucket list.)
Take lots of pictures.

Totally agree with that! Traffic in Boston is wicked. I could write books on the hair raising experiences I had there (and I'm more experienced in NYC traffic!)
The only thing that becomes a bit of a problem is transportation for the labor force during bad winter weather. However, I understand that there is a bunkhouse, or could be one, available with little effort. (how about Powell's cabin/house if more space is needed? )

The ask is at .2503 (no I didn't get that wrong but I think someone else may have.) and the open price for Monday is showing .0002!!!
At a little after 3 pm, the stock was trading @ .0002.

If there were a plan to corner the precious metals market in any way, it seems that buying CGFI and placing it in operation would be a better plan than blocking it. It would probably be cheaper, too.
INFORM isn't "objecting" really. I don't see them use that word in their letter at all. They "advise", and "suggest", but never "object". INFORM is trying to tell the DRMS how they want Colorado to change the rules to INFORM's way of thinking. The DRMS board meeting is not the place to do that. The legislature is.
You raise a good point, where have they been for the last 2 years? I think INFORM is much too late arriving at the party, and now gets no cake!
When dealing with activists, I think the best course of action is to let them have their say, if they are entitled to one, and then follow the rules as they are written.
What else can INFORM or the DRMS do? They both are bound by the same rules of law. Inform is bound by the law for the hearing proceedings, and the DRMS is bound by the same laws for the decision making process. Neither has any more or less power than what the law says they have. INFORM is being specious in their letter. They are presenting themselves as having more knowledge and information that the board has. (That does not go over well, as we saw back in December of 2010.)
When I read and re-read the INFORM letter, I didn't see anything showing how they or anyone they represent would be:
"directly and adversely affected or aggrieved by the conduct of a mining operation, proposed mining operation or order of the" DRMS.
CGFI should watch and listen. Save the comments and rebuttal for the board meeting. Asking too many questions can be dangerous. Every good lawyer knows, in a legal proceeding, "never ask a question that you don't already know the answer to". I would suggest that would be a good plan here.
Don't worry Biowise, our lawyers and engineers did a thorough job on the engineered plan.

GRIZZ, you will love Sedona. The rocky cliffs all around the town are like something out of a Walt Disney movie.
The town is very touristy, but it has a nice "feel" to it. There is a town to the south west, Jerome, used to be a copper mining town. It is built on the side of a mountain. The ride through it and the entrance and exit (on route 89A) would be a real blast on a bike.
We did that trip a couple times and enjoyed it every time. If you look at the map, you will see 89A does some hairpin switchback turns. That is just to get up the side of the mountain.
If you are looking for anything made of copper, pots, pans, trays, etc. Jerome has a few stores with some nice craftsmanship. But Jerome is a small town. Not really a place to stay, but the drive through is nice. A lot of old historic buildings and houses. 89/89A is a nice scenic road. Slower than the interstate, but really beautiful "back road" detour, particularly going west/northwest from Sedona to meet up with Route 40.
When you are staying in Sedona or the area, if you feel like a nice Italian dinner, I recommend Dahl and Diluca. (google it, you will find it) They are on the north end of Sedona, a bit off the tourist area. Its been a couple years since I ate there, but the food and service were outstanding. Good place to relax and have a nice quiet dinner with a bottle of wine after a long drive.
There are a lot of B&B's and regular hotels, most are along the creek that runs through the town. We always were with others when we did our trips. One time we stayed at the "Creekside Inn". They had a suite of connecting rooms prefect for our group of 6. (2 kids, 4 adults) good view of the creek and cliffs. But check out the Internet. There is just about any type of place you would want. Book ahead. Rooms can be tough to get during the summer.
Enjoy the trip.

I just wish to commend all of you for your insight and intelligent discussions that I have seen today. It is amazing to see everyone (yup, you too Kitt) research and dig through pages of information to size up the opposition. (and I am reluctant to use that word, because I really don't see INFORM as opposition.)
I see this as a "punt" for them. They need to show concern, and put their opinion on record. "Just in case something goes wrong," they can say "look we were right! We said it was not the way to do this".
Another facet of INFORM's stance, is their "anti-uranium" mining position. If CGFI gets money to start up the uranium claims they have, they will fight that like they did other attempts to open uranium mining. This is a "shot across the bow" of CGFI..... INFORM's way of saying "We ARE watching you!"
It is going to be difficult to stop CGFI's progress on POW as long as they keep answering the DRMS's requests. The permit is there already. The C&D will be removed as long as the DRMS is satisfied with the technical specifications of AM03 and the existing ponds are reclaimed and closed.
And that is my humble opinion on INFORM's letter.

Gold mines are not new to Colorado. The mill reopening will attract investors, and money usually trumps activists. We have seen it throughout our lives. At worst, CGFI will need to add a little change to the design of the dry stack facility. Really, no big deal.
I have a cousin who used to work as a metallurgist in a smelter in NJ. When the plant was closed (back in 1980's) his job was to supervise the last few workers digging up the floor (it was earth) in the precious metals smelting room. They recovered over $1,000,000 !!! And that was at 1980's prices for gold.
You will have to fight me for that job, Odega!
He kept a small nugget from the last smelting as a memento of his work there. (I figure it weighed about 1.5 oz.)
I wonder if he still has it?

One troy ounce is equivalent to approximately 1.09714 avoirdupois ounces.
In the present day it is most commonly used to gauge the weight of precious metals
The expected assay results were .60 ounces per ton, or less than half what the results showed.
So the recent preliminary assay was in fact 2.17 times what was believed to be the gold content.
Also, the silver was more than expected. Bonus! Or is that BONANZA!
If she faxed the letter first, and mailed it to the DRMS, then it is allowable. Scooter was told this by Wally when she called the DRMS.
Yes the deadline was 6/6/12, and it appears she may have sent it, or faxed it, to someone who was on vacation.
It looks like this organization is into opposing any mining operation that involves water. They filed in multiple mine's DRMS reviews. I do not think they fully understand the engineering report that CGFI filed. How do tailings with a 15% moisture content placed in a containment structure with a liner barrier covered by a clear span structure have an "overflow"? Any movement of the earth would take a major catastrophe like an earthquake. That is what the seismic studies and landslide studies were for.
I believe that the DRMS will find very little to object to in this amendment.
She is demanding impractical requirements. IMHO
I better do an inventory! Maybe that's the reason for the shrinkage?

If she is as you describe, I'll bet they will not allow her to be a "party" to the board meeting. Heck, I could claim I will be "damaged unless the mill is allowed to restart". Would my investment make that claim a legal one? IDK?
This "inform" organization may have a reputation as being a PIA, and the DRMS attorney may be fighting with them already. So far I don't think much from my research on them. I'm not an anti-environmentalist, but the information on their website seems contradictory. They claim to be protecting the environment AND economy of every Coloradan. Now which is the one to take precedence? The economy will benefit the most from reopening the mill. The environment will ultimately, also. The dry stack method will eliminate the tailings ponds that "inform"'s web page says it is so against. A cleanup of the tailings ponds is already underway at POW. More cleanups will be done if the dry stack process is approved.
Can't expect a small company to do cleanups without letting them operate. (and isn't what the environmental cleanup bond is for?)

Yup, albosafy, you are right on with that. That is the reasoning behind the letter / petition to Gov. Hickenlooper. One call from someone in his office and I'll bet all the red tape will melt away.
It only has to be an aid calling to ask a simple innocent question, or his office gathering information for the Governor, and the impression it will have on the DRMS worker bees will be significant.
It could also bite us. But I'm guessing with unemployment being as high in the area as it is, jobs will trump activists.
It's still a battle.

I noticed that she was named in the list of people that are to be notified of the pre-hearing conference. Many people sent in letters, not too many are being notified.
I think that pre-hearing conference will show the extent of her involvement as a "non-Party". It seems that the list is somewhat arbitrary. (Anyone who sent a letter using a certain type of wording was listed???)
I'm not to concerned.
We will see what comes of it at the hearing.
Since she is part of the same organization as CGFI, I think the opposing views will be self canceling. It is the DRMS' decision that will determine the weight to give to her comments.

My last set of figures for the board held shares put us at about 12% of the O/S. I believe it is far over that since those shares are from about 170+/- shareholders.
Now, we have 400 followers of this board. So I think it is relatively safe to extrapolate the shares held to 25% of the O/S.
That represents a sizable and influential block of shares.
Some people will sell early, taking the profit they can. Others will sell because they have to.
But I believe that the majority will ride the wave and look for true penny land.
The circumstances and news that is released will be crucial.
The assay numbers are a long awaited figure. That will entice more buyers if the figures are equal to or better than expected.
CGFI may just speed through those levels you mentioned.
Timing will be critical for that.
I intend to hold for at least .05 before selling anything.
But that is just my own personal plan.
Anyone else have any thoughts on this question?

No one here is claiming "party" status since it does not apply to simple shareholders of CGFI stock.
