He is a graduate of "International Management Institute of Glion-sur-Montreux, Switzerland" per PR's.
I can't find it. I did find "International Hotel Management Institute of Glion-sur-Montreux, Switzerland" that offers a two year degree, has 24 employees, and it's own night club. Seems like Aziz would have bragged about any kind of business degree by now. Is he a certified mixologist by any chance?
I also googled one of Aziz first business partners back in the wood barron days and see he is now a night club owner, Peter Maharaj, runs a posh club in Hawaii.
I've also been told he came from a wealthy family. This guy knows how to live, huh?

We are a manufacturer, not a contractor. I've never had a problem with a customer I couldn't resolve till this. I don't know UCC well, you're right, don't need to usually. I did 250 tank farms overseas for the military without one gliche, all on time, no warranty claims, no held payments, nothin!. If you are fair and do what you say you don't need law books. I'm also selective in who I work for, very. Helping Allen trumped out my gut on this one, I'm still learnin'.
Tex won't back it up, he can't. He's in way over his head on this stock and grasping at straws in my opinion. I'd love to stay on verifiable facts, logic, history, links, etc. His only defense seems to be attacking my credibility. I've been in the petroleum equipment industry for over 20 years. If I'm such a scammer he should have no trouble finding someone that has something bad to say. He won't.
Performance was a non issue. The material inventory list doc'd where every nickel had gone. They never once communicated a problem with our performance, not 'til the lawsuit hit.
Tex, you say I do shoddy work. Prove it. Find one shoddy piece of work I've done, name one job, client, project, etc.

I can't build it or finish it until I have all the equipment. It doesn't make sense to start and stop. The required labor for assembly is cheap, maybe 30k, which is small in the overall scope. It also needs to be tweaked to meet it's application, feedstock type, location, heat source, electric source, etc. It's not as simple as you may think. It's twice the machine than is contracted (per their requested changes) and the scope changes would need to be agreed and added before it would ship. The start up, freight, install, crane, electrical, training, tank farm, loading, unloading, electric for that, etc is all on top of the 375k.
I'm sorry, I don't understand what you are saying. Believe it or not profit isn't a luxury when you are running a business. This project was sold at or below our cost. Shop around. Also, our "profit" or markup was easily consumed the first time I had to pull it out of production. Try coordinating mechanics and equipment at 100k/week and you'll understand. The scope changes also increased the cost and were never covered. I was looking to get out at cost after about 2 months into it.

They gave me money, I bought equipment and gave that money to the equipment vendor. I now have the equipment, not the money.

Consider that you may have not made a good decision.

I closed the loop holes in the contract, I was driving the train, they had defaulted once already. The 300k isn't pocketed, it's sitting in a pile of equipment. I've stated this to you several times and you still insist on attacking me (with malice). Allen has never gotten a dime from me.
One more time.....They gave me a new funds forecast every two weeks and never hit it. The original deal was for 125k/mos for 3 mos starting in feb 07 with us having it done june 1. Their PR's confirm this. Four months later we had only received 187k, not 375 as agreed. I insised on a new contract with a payment commitment. They tried to put loop holes in the agreement that gave them the out not to pay me based on perceived performance. I ain't dumb, I said no way and made them refine the language to eliminate grey areas. I also agreed to doc the progress for them, and instructed our book keeper to isolate this project. I then setup a nutz'd acct'ing on every nickel including setting up a separate bank account just for this project as I had seen the writing on the wall. They missed their payment agreements again as I guessed they would and we went in to a holding pattern. Whenever money would show it went in to that account and then paid for a new piece of equipment, I'd update the report, put the ball back in their court and wait. Every couple of weeks/months they'd have a new home and scope for it and want estimates to accomodate the new plan. Meanwhile, they never caught up the payments as they didn't have the funds to plug it in, left me hanging while they paid for PR's to raise more money from you. We do 20-50 projects a year, and have for 10 years. All, I repeat all of the others are completed and paid for with less dicking around cumulatively than I've had on this one project. This project represents about 10% of one years avg sales volume. Do the math fly.
I was there, I know. Allen is a great guy, very very smart, works hard, etc. I've known him since 2003. He inherited the Nashua project and he and I both knew it wasn't a good plan/site, etc. He was doing other business plans and trying to get them financed without success (soy climbed and killed the numbers). I remember the day he called me to say Aziz couldn't afford him anymore and he was worried about his future. I reassured him that he would be much better off. It appears I was right, he's doing great now.
They looked legit when they hired Allen and me too. Eventually the promises turn to dust and they move on. I agree with you on the hedge funds being the real criminals. Aziz is mickey mouse compared to them.

The SEC called me last week and is looking in to this company. I think they should look in to paid promoters selling this to the gullible on internet message boards as well.

It was an "Answer and Counterclaim" to their "complaint" (I'm not a lawyer) Index No. 106102/08, Supreme Court of New York, County of New York. I take offense to those that are questioning my intent, integrity, etc. I have been on the level, I am not anonymous, I have a sterling reputation, and I don't promote pinkies. If you'd rather believe those that do good luck. If you believe Aziz I suggest you re-read the last 10 yrs of PR's. I tried to help this company and my friend and got taken for a ride (like many of you).

If you had ever seen our operations you'd know I don't have an "assembly yard", it's a multi-million dollar factory with overhead cranes, 3 paint booths, and 9000 sq ft of offices. I have never had an employee lose a day of work due to a work related injury, never had a reportable spill, never been sued by a customer and the govt represents about 20% of our work, 80% is repeat business, and we have over 10 years under our belt.
Tex, one had nothing to do with the other. My pricing is calculated on my cost plus overhead, it's absolutely fair. I was saying my costs have almost doubled.
It was a min 100k for this and another 150k for that, those are minimums, we left final amount open.

I am just redoing my pricing. Between utilities, freight costs, steel doubling, our pricing has almost doubled in one year. I can't be alone. The energy cost downstream ripple will skyrocket inflation I think.

Biodiesel is less toxic than table salt. It would consume oxygen as it broke down, wouldn't hurt ocean. It could hurt a river or pond as it depleted oxygen.

There are others like Rohm and Haas that are addressing oxidative stability. I use a floating roof or a nitrogen blanket in the tank to minimize the problem. Biodiesel contains more oxygen than diesel which is why it burns more complete/cleaner. As it looses the oxygen it becomes more like diesel.
They funded the Stamford study that Time and everyone else quoted. It made broad assertions that were skewed big time. They stated that biodiesel increased NOX; look into how and they based it on clear cutting a forest, growing rape seed with nitrogen fertilizer. Everything was skewed liked that which shows me they had an agenda.
