Everyday that the settlement news is delayed gives the shorts the opportunity to cover. IMO the MMs hold the most short positions and have control in keeping the stock depressed until they have covered. Only the announcemnent and a rush of new buyers will generate the price we all want. Even now they have walked us down since the opening.

For some reasons I have the feeling that Nokia will settle first as they have more to lose. Their footprint in the US is small at this point and with 3G about to begin they cannot afford a delay through an injunction which will hurt them permanently in the US market. Secondly, they lost in the UK on the essentiallity of IDCC's patents but now the shoe is on the other foot, so to speak, where their declared essential patents will now be publicly displayed and analyzed through IDCC's countersuit. Any loss of essentiallity for them would be detrimental to their fiefdom. Thirdly, IDCC has patents across the telecommunication arena, WIMAX, LTE, etc. and Nokia will need to be friendly with KOP. The $6 per phone unfortunately would be for only those 3G phones in the US and not worldwide. And with Nokia near the tail end of US phones sales we need to ask for more than $6.

With 3G coming soon to the US and looking down the road to the Christmas season and no Nokia 3G phones on the shelves, what is one to do? Buy a different brand?
Yeah, but you can also look at RIMM and APPLE. I can understand NOKIA as from an outsiders viewpoint they are not doing well in the ITC.
Evidently the shorts are in control. If we were trading with the NAZ we would definitely be trading in the 18.25 range.
I wish I had the smarts to tell you how they can do it. Maybe someone with more knowledge can jump in. I only am reporting what I have been watching. I do know that if writer can keep it pegged at 17.50 then those options that they wrote become worthless and they can pocket the money.
Looks like the option boys are trying to keep us pegged down near the 17.50 mark. Every time we try a run to 17.60 they bring us back down.
I think someone was a little premature. Ask is lower now. I for one would appreciate a little upside today and more importantly a little news from our homeboys at KOP.

I recall years ago, Paul Winchell the ventriliquist, who invented a heart valve pump, having to go to court to protect his invention. He won, but without his resources and his name going into court, he probably would have lost or dropped his suit. That is what these big companies do, steal, stall, delay until it hits them in the groin.
Maybe the IDCC attorney should characterize Nokia as thieves, conspirators and purveyors of stolen property.

Fast Money: IDCC has 3,000 patents and 9,000 pending! 9,000...9,000...never heard that number before. We should have all bases covered...LTE, Wimax, 4G, etc, etc, etc.
I only see 911,000 shares traded not 2 million. (Ameritrade)
The number of shares being traded in between the bid/ask is amazing, even when there is only a one cent difference between the two.

I did not miss the earlier post. I do understand that Nokia missed the deadline date on the amended complaint but instead of answering the complaint they initiated another motion. Nokia for sure is not on the good side of the ALJ.
And now they are crying that they don't have sufficient time to complete their discovery. They would have had time if they hadn't been submitting all those other requests that the administrative has denied. They knew they were pissing in the wind when they submitted the requests but now want to cry that they have insufficient time to complete the known requirments. Sorry! You lose again.

I know that the license stated "and future phones" but it did not say 3G phones. But I agree that there would probably not be a PR. Did Infineon announce that they were supplying the initial chip for the iPhone? I don't think they did. Too much secrecy in Apple development.

I believe that IDCC's lawyers are searching for a rate that is comparable to what IDCC offered Nokia. If one is found the jig is up on the frand rate issue that Nokia is attempting to raise in these hearings. IMO.
