US legislators have responded to the Prodigy judgment by enacting legislation to protect ISPs that take affirmative steps to remove, filter and edit material hosted by them from liability. Congress added to the Telecommunications Act of 1996 a new Title V, known as the Communications Decency Act of 1996. One source of protection for ISPs is found in section 230(c) of the Act, which provides as follows:
230(c) Protection for “good Samaritan” blocking and screening offensive material.
(1) Treatment of publisher or speaker
No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.
(2) Civil liability
No provider or user of an interactive computer service shall be held liable on account of – (A) any action voluntarily taken in good faith to restrict access to or availability of material that the provider or user considers to be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected; or (B) any action taken to enable or make available to information content providers or others the technical means to restrict access to material described in paragraph (1).
A number of ISPs successfully used this section as a bar to defamation action. In Zeran v America Online Inc.8 the plaintiff became the target of a malicious hoax perpetrated through the Internet. Someone posted a message to AOL’s bulletin board suggesting that the plaintiff was marketing a line of apparel called “Naughty Oklahoma T-shirts” that sported messages in extremely poor taste about the Oklahoma City bombing. The plaintiff received a flood of intimidating phone calls and contacted AOL demanding that the posting be removed and a retraction published. AOL agreed to remove the posting but refused to publish a retraction. After the posting was removed, and after assurances by AOL that the source account would be cancelled, additional messages were posted which persisted for several days. The plaintiff subsequently sued AOL for defamation but the claim was successfully defended by reliance on section 230(c) of the Communications Decency Act...

It's amazing how a little exposure by Our-Street.com helps improve the thoroughness of a company's disclosure. This paragraph was added to the company's most recent 10Q filing. It was not included in previous filings.

I think there's more than just coincidence and a glitchy RB at work here. USGA was also featured in the Our-Street spotlight and bashers didn't last long on that board. RB seemed happy to terminate bashers for asking questions but tolerated mindless pumping and cooperated with gang-TOS campaigns.
Bruzzone was "protecting" CYPT by stalking bashers around the message boards. She used her "PI" story to hook up with the likes of Treffry, slurp and Dobry, and then posted numerous personal attacks until she got terminated when RB ran out of excuses. She resurfaced with new aliases, did little at CYPT, and then turned up on USGA just before RB 'locked' the board and threw away the key without any explanation. She then parked herself on UGHO with the clear purpose of attacking anyone who mentioned Our-Street or Skellern's legal and credntials problems.
USGA is still down and I have a suspicion that RB closed it at the request of USGA management and touts. It's notable that the board shut down just before the release of a pathetic, overdue 10QSB, thus stifling any discussion of USGA's lack of revenues and outright lies about sales which never happened.
I think we'll see more 'censorship' and 'controlled access' on RB message boards until the RB insider cooperating with the stock touts and scammy companies is identified and stopped. Failing that, I think Lycos will try to quietly shut down RB hoping to avoid public exposure and criminal charges.

The Securities and Exchange Commission today filed a civil injunctive action against Aqua Vie Beverage Corp., a beverage company based in Ketchum, Idaho, and its CEO, Thomas Gillespie, as well as a major shareholder, Joseph Wozniak. This action follows the Commission's 10-day suspension of trading in Aqua Vie common stock on May 2, 2003. Aqua Vie stock formerly traded on the over-the-counter bulletin board.
The Commission's complaint alleges that Aqua Vie and Gillespie fraudulently promoted Aqua Vie's common stock from by means of millions of one-page tout sheets faxed to homes and businesses. Aqua Vie, Gillespie and Wozniak also offered millions of shares of Aqua Vie's common stock publicly, without any registration statement in effect as to the offering. The unregistered public offering included 2,750,000 shares offered and sold from November 2002 through May 2003 by a company that distributed Aqua Vie's faxes, Fax.com, Inc. According to the complaint, the defendants dumped millions of shares into a market reflecting demand created by the fax promotion, without disclosing the increase in the public float of Aqua Vie securities. The unregistered offer and sale effectively kept afloat a struggling company that was far more successful at marketing its stock than its only product, bottled water.
According to the complaint, the tout sheets presented Aqua Vie, a boutique bottled-water company, in an unrealistically favorable light, projecting high revenues and stock prices, and excluding a dismal history of sales and the expected termination of Aqua Vie's bottling agreement. Neither Aqua Vie's Commission filings nor the tout sheets disclosed the company's substantial and prolonged unregistered offering of securities, nor its arrangement with Fax.com. Further, Aqua Vie has not publicly filed any current financial information with the Commission. The company is delinquent with respect to its most recent Form 10-K and its Form 10-Q for its quarter ended October 31, 2003. The Complaint alleges that Aqua Vie and Gillespie violated the anti-fraud provisions and certification provisions, and that they, along with Wozniak, violated the registration requirement. In addition, Aqua Vie and Gillespie are alleged to have violated the reporting requirements (for the late filing of the company's annual and quarterly report). The Commission is seeking injunctive relief with respect to all three defendants; disgorgement, pre-judgment interest, civil monetary penalties and penny-stock bar from Gillespie and Wozniak, and with respect to Gillespie only, a penny-stock bar.

Happy holidays to all. Had a little chat with Rich this morning. Just to thank him and the company for the PR. We both wish you a very happy holiday season, except a few and you know who you are. Also, Rich thanks the guys who took the time and effort to dig up the information that wasn't obvious.

No, 'cause it was late and I wanted the additional shares. I bought some awhile ago to paint the tape at .04. I got 'em but at 4:01 and it didn't paint. I'll keep doin' it my way, but thanks.
