I looked for it on USPTO Mary, must have missed it.
Was it anything close to FDA proposed new class of devices, vis a vis 510K application and FDA assessment in the same product area as BIEL? TVM
It's OK ezy - I'm ok with half a buck if BIEL has 20X the shares of Arena.
No one knows for sure, guaranteed, what's going to happen with BIEL. I'm patiently waiting for the FDA to receive comments until May 21st and then issue its decision on its proposal to create a new class of devices, into which BIEL products would domicile, if approved for OTC sales. Tick tock, tick tock.
Am I correct in saying that Arena Pharmaceuticals has only 219.26Million shares outstanding as at February 24, 2014? Not necessarily a problem for me, just want to clarify.

Me, me, me is always trumped by team, team, team. Often not a question of right or wrong, or success or failure, but, as you opine, the stimulation by an effective leader for others to conjure up other ideas, opinions and options produces a more fruitful way. Applies to everything we do, in business it's called increased sales, profits or team member satisfaction.
If Whelan now truly 'gets it' and can limit his, I believe, genuine desire for BIEL to succeed, he clearly has the horsepower on board now for that to happen. If not, then the degree of diminished success of BIEL will be exactly proportionate to the degree of his intervention in processes he should stay well out of. It's pretty simple stuff, theoretically, but awfully difficult for the impatient who feel they are all-knowing. We will see what style emerges. He needs to stay quiet, trust the people he recruited and radiate calm.

Many of us feel the same way - most of us have resolved prior issues and prefer not to tow the baggage of them around behind us and have moved on to the current situation; FDA hosted a public meeting to hear and receive comments on these devices, its star-studded Advisory Committee produced what I thought was a very positive report of that well attended meeting, FDA has recently proposed a new class of devices, BIEL fits into that proposed class, FDA asks for comments to close May 21, decision to create the proposed new class of devices or not, a new BIEL 510K application for Class II, OTC designation will be made, more trial data, FDA does its assessment and decision. Next?

Good thing the folks at the FDA know what they are doing. Where were these pseudo detractors when the Rx and OTC painkillers were being assessed? Non of the websites for those purportedly being represented disclosed sources of funding - oops. What are the real motives, other than money and funding for these non-profits? I believe this diatribe presented to the FDA is reckless disregard for the American people concerning the pain drugs that are killing people.
I am very confident the FDA knows exactly who they are and what, if any, serious scientifically factual trial evidence has been provided, and not! No indication of frequency of occurrence from what I've seen in the rhetoric. haha - bingo art, your, "this is my baby.......etc" reminded me of a most interesting situation I was asked to assist on a number of years ago. It relates to BIEL and other management scenarios and shows how things can go downhill very quickly if not nipped in the bud. Hope I don't bore you to tears.
President of a very successful company became engaged in a long test of wills during a very substantial development opportunity with one of his VP's, whom he had personally recruited away from a competitor, at substantial annual costs, together with larger mid and long-term contractual costs; equity, profit sharing and the like. Millions in compensation were involved, the development project many 10's of millions. He had appointed the vp to head-up the project.
The VP knew his stuff, was an excellent and diplomatic negotiator and was bringing the project along nicely toward a very successful conclusion. But, they debated on a particularly pivotal and lucrative issue and that escalated to arguing over a period of three months., The VP was on safe ground pursuing his carefully planned tactical approach, the president would not let it go and felt he was right, the other wrong, when, in fact the VP was right. One day, the president became quite irritated, his façade vanished and he resorted to quickly and irrationally exerting his authority (power). No reason, pure power.
"Listen, we've been going back and forth for quite a while on this and I've let you get away with challenging my authority. There's something you have to understand. This is actually a dictatorship and I'm the dictator and this is the way you're going to do this, how do you like it so far?"

The vp remained silent, the president said, "That's better" and left. I was asked to become involved in a resolution process. I listened to the two models and advised the president that I believed his tactic would backfire and the vp's would not. We did some serious role playing in a small group setting of a number of Exec - VP's to prove my theory, after which I concluded by advising the president his tactic would fail and the bonus was that he would lose the vp as well. He relented, begrudgingly, the project was concluded successfully, the return was much higher because of the VP and the use of his correct tactic and he abruptly left the company post-completion, a far wealthier man. The president was asked if it was time to 'pursue other interests' a few months later by the board.
The situation was made more interesting by the underlying reasons for the president having placed the very large project in serious jeopardy in the first place. He was not an inventor, but he was an entrepreneur. He was not narcissistic, although he made people around him uncomfortable, at risk of reprimand.
He was a perfectionist, created as such by the fact that his biological father had abruptly left the family when he was young. He inferred that it was somehow his fault because his father didn't love him and had been trying to have people love him ever since, on the mistaken theory that if he was right all the time and made no mistakes, ever, people would love him. I had the interesting challenge of determining the causes and the unenviable task of remediation with the president. I had noticed a small picture in his study and asked who the man was and he told me the story - the penny dropped. He had achieved big successes because he was a pretty good listener, he 'got it' and within an hour he promised he would make as many mistakes as he could so people would think he was human and like him more. He is a better man and laughs a lot, at himself, while leading a strong management team. The vp did as well or better.
I too grimace when I put someone on ignore whitten, but welcome to not seeing in the first place what you've been wishing you hadn't, I'll wager, for a long time.
The benefit of iHub giving us the ability to 'ignore' is that if everyone does so, then no one will respond to the idiosyncratic bumbling and those on ignore may run out of gas, or not, but who cares, they cease to exist, a fitting end to a nuisance.
Think of all the time you have spent reading the incessant posts of those you now wish you hadn't. Time is a non-renewable resource and I have little of it in the first place. Simple. 'Ignore' gives me more time I would otherwise not have - bonus! As usual, silence is wonderfully powerful.
Nothing first-hand, unfortunately, I may have been able to help on the first go-around. Your words touch on it though, "intractable personality". It's an inescapable profile yankee and it will require a lot of effort and honest verbalized observations from others to stifle it. If accomplished, he has many 10's of millions involved.

You will recall 2 zany thoughts from foregone days I wrote of, with a couple of variations to update to current.
1. Does anyone here know anyone at the FDA who might write to the company, Whelan, while cc'ing the good Dr. Dumas, the Chairman and the lead scientist, or whomever makes sense, suggesting/requesting that the FDA and the company establish open two-way access and communication in order to expedite the process? The potential results are obvious and don't require elaboration; and
2. Seems to me there may be a slight, or greater, indication of 'Founder's Syndrome' here. With the greatest of care in tip- toeing through this diplomatically, Founder's Syndrome is diagnosed to be mild in some cases, not detrimentally affecting progress or levels of success to any great degree, to severe in others, completely crippling amazing ideas and breakthroughs, which crash and burn, with all the catastrophic ramifications to investors, inventor, developers and support staff at all levels. The 3 most common questions asked, as people pack up their things and sadly exit are, "What just happened?, "Where did we go wrong?", and "Why couldn't he have just trusted us and let us do the jobs he hired us to do?" Reason? The Founder couldn't get out of his own way, as the baby, 'his baby', came flying down the birth canal toward almost assured success!
The worst of these occurs when there is a mild touch of narcissistic behavior to contend with and the guaranteed disasters occur when the brilliance and imagination of the founder is crippled by NPD, Narcissistic Personality Disorder and he absolutely cannot and will not help himself. It's an interesting read to learn of such impediments to success and when one is familiar with the area, "What the hell just happened?" becomes, "Oh no, we could have seen this coming, if only we had known, damn!"
When I first touched on this, the thoughts were bashed and I said no more. We all know what happened. But what do I know, I've only studied, written about, lectured and consulted on the subject . . . . The one thing I do know is that if the appearance of stubbornness is at all masking a touch of narcissism, or worse, then firmness is the order of the day, in order to give the Founder some daylight on reality, let his people do their pointed jobs thereby allowing him to succeed.
A serious caveat yankee:
Agree that lead scientist, Dr. Christine Dumas should be at all meetings plus other experts in the field as necessary. Whelan to attend, but not all meetings and on the undertaking that he not speak, at all. His mouth and screw you I'll do what I want to work around you attitude, called arrogance in some circles, got the company into trouble last time. His demeanor is cast and it is not that of a diplomat which this process requires. He must be contained. If not, he will screw it up again. Only a fool doesn't change his mind!
You hit the nail on the head whitten- any professor worth his or her tenure appreciates effort, respect, preparedness and presentation. iHub could well be a thesis for a double doctorate! The posts for the last 6 years or so make an interesting chronicle of events.

Don't I do that? Or, don't I delegate that task to one of my illustrious scientists? Is it even remotely possible that such initiatives have not been taken? Speculate for me please. Just part of patiently waiting for paint to dry. . . . .

I have read the Investor Update and, on balance, find it to be professional and businesslike. Bigger than those prerequisites to a reasonably well managed corporation is the fact that Whelan doesn't use a specific date in the above paragraph, thereby making it a more prudent comment to investors and respectful of the FDA process. It also appears that the pertinent data for the 510K application will be assembled and ready in a timely fashion, more evidence that this is coming together. I like this style better than has been shown in the past. Kudos to the BIEL management team. Have I grasped this correctly?

To color it a little more, I believe there was information published by the FDA wherein they generally forecasted a period of 60 or 90 days (can't recall which) to process applications and reach a decision, as part of an expedited application processing timetable for the future. Was this well thought out and realistic, or just wishful thinking to placate one's masters? Who knows, but it is dangerous ground to estimate one thing and rarely, if ever, deliver. One of the most costly aberrations in industry and government in our country is the lack of realistic estimates, from budgets to promises of delivery. I regularly advise people submitting items to me to please tell me the truth; don't tell me what you think I may want to hear because it corrupts the decision-making process. I, and thousands of other decision makers constantly fight against the natural human tendency to gild the lily.
I prefer to deal with facts and logic when speculating (and I regularly screw that up!):
Is there activity within BIEL related to the proposed new device classification by the FDA? You bet there is. Has to be.
If so, does it concern assembling trial and other data for a new, or amended, 510K application? Yup
Has Whelan learned from the first FDA fiasco and become wiser and more humble? One fervently hopes so.
Will he assume a more appropriate CEO role and allow his expert team to make this happen? Same answer as above.
Any timing estimate right now is pure speculation. I think that answers your question, but it's sometimes fun to ponder such things, no?

Thanks slaw - I also wrote at that time, seems long ago now, that Alex Gorsky head of J&J Devices division before his appointment as CEO HAD to have known of BIEL and the FDA status. And that if the folks in the devices division did not know all about BIEL, then some heads should have rolled.
Mary H. posted here recently that she had called Whelan at BIEL with questions sometime around the New Year, give a month either way, and Whelan stated they were discussing with GSK. Mary wisely posted she wished to keep her post "short and sweet".
Let's see, J&J is the unquestioned leader in device sales globally. My logic meter says there must be talks somewhere here and, if I'm correct in that assumption, it's also reasonable to infer that Whelan and whomever it is are under an NDA. Appreciate your thoughts slaw.
BTW, someone asked me recently in a sidebar why I was putting effort into posting my thoughts on iHub as to them it did not seem characteristic of me. My answer was that I stumbled onto iHub as a discussion forum, had a whack of BIEL stock and watched and read quietly for a long, long time before posting as Simpsonly. I watched a large number of a group I named the 'Good Guys' (Male & Female) post thousands of times and watched the positive and bashing responses, so I decided to take up the slack when they became observers, no doubt tiring of the incessant bashers. I learned a lot from them, I felt I owed them. Simple as that. They know who they are, rich, sausage and too many to name, all 'Good Guys'

I'm confident that Whelan will assume a proper leadership role and put the best BIEL player out there for any upcoming PR. Not cynical here, he put his, yes those, up on the table, took huge risks, placed his family in financial jeopardy, stayed the course when most would have fallen by the wayside, made some errors, did some things correctly and deserves the rewards. All well and good hustle, but in order for volatility and upward movement to combine, there first needs to be a significant PR by the company and/or a significant news release by the FDA. I can't think of much else that will cause the stock to go hard as Riceman has mentioned a couple of times such stocks do under positive circumstances.
Patience is king and has been for almost 5 years, but a lot has been accomplished. Does anyone else know of a similar situation where the FDA has proposed creating a new category of drug or device. I call that game-changing and we're right in the middle of it, now!
(1)New category proposed by the FDA; (2)will it be created?; (3)new 510K application by BIEL; (4)FDA consideration; (5)will it be approved for OTC sales in the U.S.?; (6)patented; (7)BIEL products work well; (8)no drugs; and (9)no side-effects.
Seems like 9 steps to me and between the FDA and the company 6 have been accomplished or will be very easily. That leaves (2), (4) and (5). I feel we can eliminate (2), why would the FDA make such a proposal if they did not intend to do so, makes no sense. Patience rules.

I have long wondered who was buying and selling shares. Was it MM's or others? Is there accumulation going on? If so, we certainly wouldn't know as it would be done through different entities to maintain secrecy. At some point, we will know.

I hope you didn't seriously infer that I made any comparison between Apple and BIEL, because I didn't, except to say that the performance of Apple exceeded my expectations and I hope BIEL does too.
What I attempted to do, and failed miserably at, was to indicate through logic that you and I have absolutely no idea what BIEL will rise to, therefor, by logic, you and I also have absolutely no idea what it will not rise to.
I feel empathy that you are annoyed and somewhat gratified that you are worried, but let me assure you with my opinion that no potential investor will be alienated by this innocent speculation amongst posters as to what BIEL will grow to in Market Cap. I, for one, appreciate and respect the dialogue of others, except the incessant bashers. Hope this helps you appreciate I made no comparison between Apple and BIEL, except I really blew it on my low Apple estimate long before I sold my shares, and thankfully so. Hope you and I both do the same with BIEL.
Seems like years ago I suggested here that it might be a good idea in the future if employers provided ActiPatch units to employees as a benefit, after assessment and where appropriate.
Pretty stupid huh? No payback there! And something doctors and larger insurers would never, ever endorse in helping to keep Americans working pain-free and without drugs. Especially when we're just fine with the painkillers we have.
Hey Riceman - you may not be wrong.
But, if I had said to you more than 10 years agoi that I had invested a chunk of money in a young company run by a couple of wing-nuts and had bought shares at around $13 telling you I thought the thing might grow to a market cap of a few $Billion, you may have said, "C'mon Simpsonly, this 'just suggests that anyone in their right mind should never listen to any opinion of yours.'.
And, you would have been right and I was so far off base that I've been laughing at myself for my stupidity ever since, what was I thinking! Those wing-nuts grew that disruptive technology piece of crap to a current market cap of over $500Billion - I stayed long AAPL for quite a while. The one thing I know for certain is, nether you or I know for sure. BIEL could go to 25 cents, or the company, or an acquisitor could buy back a couple of billion shares, or, or, or. None of us really knows, do we?
"Perhaps", being the operative word yankee. Confidentiality restrictions preclude further elaboration. At a couple of dollars and perhaps trading elsewhere, a get-together of the 'Good Guys' (both genders, of course) would be very cool, wouldn't it?

How many TV slots do we see for pain management where, at the end of the 30 or 60 seconds of watching the absurdities of couples having fun bouncing in the waves, running on a beach, riding bicycles, or smiling like idiots, do we hear, "sorry, no negative side-effects". Never? But, I have found one negative side-effect to all of BIEL's products and what I believe may qualify as a disruptive technology just waiting in the wings - you may just sleep-in for the first time in years! Or how about through the night. Or, no more menstrual cramping or pain? Or, grogginess, or, or, or, or! :)
Ha! Like your humor hooker. He read a few hundred posts on iHub, at my suggestion, and opined that the doodling of 3 or 4 naysayers on iHub, big or small, would have zero effect on anything and felt that most folks assessing BIEL, old or new, are intellectually way above being influenced by such unsubstantiated rhetoric and innuendoes in making investment decisions.
His focus was on 3 more relevant issues: (1)do the products fall short of, live up to, or exceed, all claims and expectations, i.e. reliability, trust, efficacy, side-effects; (2)what alternatives might consumers have, now and in the future, vis a vis competition; (3)current regulatory approval processes in the U.S. and abroad; and (4)strength of the IP at USPTO and elsewhere.
When satisfied with the DD on the issues above, he addressed the matter of the Pinks vs other trading venues and the lack of exposure and resulting interest within the financial investment community and concluded "very well kept secret." He wasn't critical of the Pinks, said it is a necessary forum, just that brokers and financial advisors don't usually focus there when looking for investment opportunities for their clients.

I do know I recently asked an astute and learned friend to assess BIEL. He took a few days and came back to me with a single comment/question, "I can't figure out why this isn't trading at north of 50 cents, I must have missed something, do you know why?
I responded with a question asking him where he had gone in his DD.
We agreed it's a combination of trading domicile, almost no exposure to the investing public in the US and media coverage. He observed that BIEL therefor qualifies as a very well kept secret and is acquiring shares. I'll say no more.
