States may not take tribal land by eminent domain

Lands owned by Indian nations and held in trust status cannot be taken by the states by eminent domain, although federal statutory authority allows states to take "allotments" held by the United States in trust for individual tribal citizens for public purposes including utility easements. 25 U.S.C. §357. The Tenth Circuit has held that if the tribe (in this case the Navajo Nation) owns a fractional interest in an allotment, then the state (or its service companies) cannot use eminent domain power to take a utility easement from those allotment owners. Public Serv. Co. of N.M. v. Barboan, 2017 U.S. App. LEXIS 9204 (10th Cir. 2017).
BUT THE UNITED STATES CAN:
The only way to acquire such an easement is for the land to be taken by the eminent domain power of the United States or in a voluntary sale with the consent of the relevant Indian nation and required consent by the United States generally exercised by the Bureau of Indian Affairs.

U.S. House bill aims to boost domestic mining of strategic minerals

(Reuters) - Republicans in the U.S. House of Representatives plan to introduce legislation on Thursday to bolster domestic mining and processing of minerals used in high-tech equipment, a sector currently dominated by China.

The bill, which contains provisions worth roughly $2 billion over 10 years, is the latest in a string of recent U.S. legislation attempting to craft a national strategy to produce more lithium, rare earths and other so-called strategic minerals.
The cornerstone of the bill is a provision requiring federal agencies to streamline the mining permit review process. It can take 10 or more years to get a mining permit in the United States, though the process in Canada and Australia typically lasts two to three years.
The federal mining review process “is arduous,” Representative Paul Gosar, a co-sponsor of the bill and a member of the House Committee on Natural Resources, told Reuters. “We can do things better.”

The bill would also require the U.S. Geological Survey to complete fresh studies of mineral deposits on federal land. Regulators would then have to weigh production of those minerals against other potential land uses, like recreation and conservation.
Three other Republicans have co-sponsored the bill, known as the American Critical Minerals Exploration and Innovation Act. No Democrats have, though Gosar said he is hopeful some will.
The bill expands the U.S. Department of Energy’s existing research into strategic minerals, including ways to extract minerals from old electronics through recycling.
It also funds grants at U.S. mining schools, which have been facing declining enrollment in recent decades.

Ted Cruz seeks to end US dependence on China for rare earth metals

Senator Ted Cruz said he plans to introduce legislation on Tuesday that aims to end US reliance on China for rare earth elements used in the manufacturing of products including consumer electronics, electric vehicles and fighter planes.
The bill is part of a push in Congress to shift supply chains, particularly in industries critical for national defense, away from China and back toward the US.
THE BILL WOULD CREATE TAX INCENTIVES FOR COMPANIES TO BUY RARE EARTH ELEMENTS WITHIN THE US
“Much like the Chinese Communist Party has threatened to cut off the U.S. from life-saving medicines made in China, the Chinese Communist Party could also cut off our access to these materials, significantly threatening U.S. national security,” Cruz, a Texas Republican, said in a statement. “The Ore Act will help ensure China never has that opportunity by establishing a rare earth elements and critical minerals supply chain in the U.S.”
The bill would create tax incentives for companies to buy rare earth elements within the U.S. It would also require the Defense Department to do so, and would provide money for pilot programs to expand the American rare earths industry.
The legislation is among a number of proposals to strike back at China — whom many Republicans, including President Donald Trump, fault for not acting sooner to prevent the spread of the coronavirus. which led to more than 280,000 deaths worldwide and more than 80,000 in the U.S.
Cruz and other Republicans have already introduced measures to reduce U.S. dependency on China for drugs and other medical equipment. They have also sponsored legislation to let U.S. citizens sue China over harm caused by the virus and have called for banning live wildlife markets where the virus may have originated.
China provided 71% of the global rare earth elements produced in 2018 and was the top supplier to the U.S. that year, according to the Congressional Research Service. Some members of Congress have been pushing for years for the U.S. to reduce its reliance on China for the elements, particularly after trade restrictions in 2010 that sent prices spiking around the world.
The U.S. was once a major producer of rare earth elements — which are relatively abundant but difficult to extract — until China became a major low-cost producer in the mid-1980s, according to the CRS. Cruz and others in Congress have argued that Chinese state subsidies allowed that industry to flourish, killing off American competition.
The bill is called the Onshoring Rare Earths Act.
