I like the Idea of filing this lawsuit. But I'd love to know the thoughts that went into the decision to file. We already had some claims that passed the ptab a long time ago. Thom sold some shares of MRMD which gave Worlds cash to help start this suit quite a while ago. I'm hoping a little birdie told him... it's a go.
Time to finally dig this case out of the old dusty/rusty ptab file cabinet and make a ruling? The dust must be an inch thick by now.

If remands are considered open ended as per a recent post, how long does a plaintiff have to wait to file a complaint for abuse of judicial expediency. If I read the post right, open ended can mean indefinite postponement. If the Judges were dirty,(not saying this one is) are there any rules that could apply here. The 6th Amendment mentions speedy trials for defendants in criminal cases, but not for the court systems themselves. Just wondering if anyone has ever come across this in a patent case before. And yes, it is also my opinion that they are dragging their feet on this one.

I agree, definitely a delay. If Chanbond had filed all the suits separately, the 13 would have complained that they weren’t filed jointly. I hope the judge sees past this game.
Separately, Comm doesn't go bankrupt all at once. It gets dissected a little at a time over a longer period. Does anyone think the judge will grant this? and what about judicial efficiency? Nice way to bog down a court system that is log jammed already.

I think tomorrow sounds like a good day for a decision. The Judge has been back from vacation for more than 2 weeks and the clerks have been working hard to get this thing out before the weekend.

The judge ruled obviousness on VRNG. Do you know if Bungie/Activision are claiming obviousness as a factor in this lawsuit? It's been a long 8 years. I can't remember.
If this were like criminal court, Would Bungie's evidence be stricken from the record and the jury told to disregard their testimony. I'm thinking yes. They should have not been allowed. You may be right. With this thing taking so long, it almost feels as if they are trying hard to find a way around us.
The money to be made is based on the lawsuit. I would expect most if not all would abandon WDDD if the suit was lost. The marijuana stocks are losing their shirts. MRMD will not keep Worlds pps propped up.

I'm not sure how UOIP would ever open back up after a win. If they ever did go public again to collect on future royalties, (from the 13 and others) what's to stop the cable companies colluding together (not that they would do that. haha) to short the hell out of the new symbol. And also, why would Carter risk having his millions of shares manipulated?
After listening to the CAFC hearing again, it appears as if World's told the court that it was up to their discretion if they deemed opening discovery back up was warranted, but a decision on real party of interest could still be reached without doing that from their court. My opinion was that additional discovery is exactly what was going to happen if they remanded the case back to the ptab. Either that, or a total vacate. The burden of proof of the contract being put on Bungie without them having a way to defend themselves was a most pleasant surprise.

IBB just posted recently that in June of 18, Worlds sold some MMRD for $1.3 million. The ptab process can't be that expensive. Is it? All we're doing now is waiting.
Does Worlds have any bills except for Thom's salary? I thought all else was on contingency.
If I recall, It ultimately worked out in Worlds favor. But the Judges made that decision by themselves. I think Worlds initially wanted discovery. They argued about it and the judges chastised Activision/Bungie for not bringing the contract with them. The judges then decided to not open discovery, which put the burden of proof on Activision/Bungie to prove that the contract didn't show control/privy. Activision/Bungie couldn't prove their case without it.
We've followed this since before Whitey Bulger (just watched Black Mass again recently) That guy deserved what he got. Been thru the bad financing, the stock split and now this big precedence setting delay. I have absolutely no thoughts on capitulation since I sincerely believe that Thom was wronged by these companies when they would not compensate him for using his patents. I'm getting ready to paint a few rooms in my house. I guess i'll just pull up a chair, have a beer and watch them dry.(Same effect as waiting on this lawsuit to finish up Haha!) Yes, us natives are getting restless. 7 years of watching this play out can get on ones nerves. I thought I read somewhere that there were other lawsuits that were denied discovery by the ptab. I might be wrong. Any thoughts on if they would be entitled to a do over? Maybe that's what they're afraid of.
Thanks for the google search Eagle. "Remanded" means that the appellate court sent the case back to the lower court to decide the case again. I'm not sure how worlds does not come out ahead after the ruling that just happened in the VHC vs Apple case. What is taking so long? This decision should have been out long before vacation season ever started.
The only other way we would get answers to those questions would be to open discovery back up. Which is not gonna happen.(please tell me that's never happened before) The Ptab shot themselves in the foot on this one. Does anyone have any guesses on how they rule on this or how esstoppel can even come into play based on what just happened in the VHC case? I am as confused as you on this one Quilt.

This thing should have been out already. It reminds me of that job that we all hate doing and just keep putting it off, hoping it would just go away. I think they painted themselves into a corner and are having a hard time figuring their way out. I honestly didn't believe that we really would be waiting until this Judge got back from vacation, or wherever he went. I hope they do the right thing.
MRMD is a dead subject here. ZZZZZZZZZ. The only thing important is the Ptab decision. Perhaps you should invite them over to the MRMD board and discuss it there.
