Maybe. Let's assume that it was all one big fraud. The issue is that the claim is so far removed from TSNIGRI that they may not take it seriously. You have a small Canadian metals company that they never heard of, that is listed on the pinksheets in the USA and incorporated in Delaware making a claim on it's website that TSNIGRI (a quasi-Russian goverment agency) performed a NI43-101, which is a Canadian instrument,which states that the pyrite ash dump in Russia, whose ownership is unclear, is worth millions in iron and other precious metals.

They probably wouldn't give it any credibilty and they wouldn't know where to start with a rebuttle if they thought it was neccessary.

Okay. Here is the the update on the cases.

The 2005 case is still out with the jusge. It is a very technical case so the judge may be seeking some third party expertise before making a ruling. The longer it stays out the better our chances for a settlement imo.

The 2007 case actully had a hearing for assesment of damages on 2/11/2008 (not the 14th as I thought). I assume that at least one side was un-happy with the outcome because they went ahead with scheduling a final pre-trial for 7/31/2008.

Let's hope they settle...soon!

Yes, both parties waived their right to a jury trial on 01/28/2008 for the 2005 case. They agreed to let the judge hear both sides and the take it under advisement and then come back with a decision. We are awaiting a decision at this time. In the meantime Tiax has to decide whether they want to wait for the Judge's decision of try to settle before that. It's a gamble because they could get a better outcome by settling now. We just have to wait and see.

As far as the court case goes. When I checked with the clerk, she said that the 07-589 case had a Damages hearing scheduled for today and a "Final pre-trail" scheduled for 7/2008. I will call tomorrow to verify this info and get an update on the 05-4344 case.

Bottom line is that the cases are related and I think if they reach a settlement it will include both cases and cover any future litigation as well IMO.

I agree with Q that, regardless of what has transpired between the two companies, it seems like TIAX is cutting off it's nose to spite it's face.

Let's see if the keystone cops can put this litigation to bed and everyone can begin to make some money.

Without seeing the actual complaint and civil action cover sheet it is difficult to say. However, going by past USGA filings it seems that the case from 2005 involves royalties Tiax says USGA owes them as part of the original licensing deal. Usga claims that either party had the right to end the contract at will.

The 2007 case appears to stem from the announcement that All-clear received EPA approval and USGA intended to liicense the product to Kidde without involving TIAX in anyway

Cape, I have E-mailed him as recently as yesterday but the last time I got a response from him was just after the Mineweb article. The only problem with Slava is if you believe that his job is to feed us garbage, as other posters have indicated, then it doesn't make a lick of sense to get info from him.

His track record of follow through is what it is and you can speculate why he sets deadlines that he misses. In fact, it is my opinion that Kuznetsov is not even his real name but I don't have the proof yet.

I doubt we hear anything from Aurc today but if we do I doubt it will be via Dovgan. The two Slavas are controlling all the info that is released IMO. Btw, I forgot to ask Tom if he actually saw the two of them in the same place at the same time on his trip to Montreal.

Our quest to find the truth here is so difficult that it's like taking a knife to a gun fight. We get info in dribs and drabs and it is all very difficult to verify. This is the nature of the AURC beast.
