The Aithentify case is a different company from Phonefactor
In reading the patent material, it appears that Authentify has a certain patent for which they applied in 2001, not sure when they were awarded it. SFOR applied for their patent later than that, but were awarded their patent post-Authentify. It seems that they must be two different types of technology in that SFOR was awarded their patent, defended it, and won in 2011 (don't hold me to the dates, this is just from memory, possible it was 2012)
It would be nice if one of you tech geeks or legal geeks could clarify some of this. Buzz, I believe you are one of those techies? Dman, you have an ongoing relationship with Kay, can you get some info for us?

For those of you interested in following the patent, here are some links which discuss SFOR's patent, and suit against Phonefactor, an authentification company which was recently acquired by Microsoft. Now, Authentify is suing SFOR. Any of you legal minds out there may want to discuss these latest events with Kay and let us more feeble minds know what the differences in the patents are -- two -faactor vs multi-channel?

Will StrikeForce Technologies become the next Data Treasury-filing suits against the industry's biggest banks and authentication vendors that it says are trampling all over its soon-to-be-issued patent on out-of-band authentication techniques?
Developments of recent weeks have me wondering whether CEO Mark Kay and evp George Waller will soon be buying property in patent-friendly East Texas and settling in for what could be years of litigation against competitors like Authentify and PhoneFactor, and banks with home-grown out-of-band solutions.
In early November, StrikeForce issued a press release highlighting the U.S. Patent Office's "notice of allowance" for its patent application titled "Multi-Channel Device Utilizing a Centralized Out-of-Band Authentication System." The release was a shot across the bow to out-of-band authentication vendors, and a smug victory dance for StrikeForce, which has been pursuing patent protection for nearly nine years. "It looks like our day has come," says Waller.
And maybe not a minute too soon. The publicly-held company produced just $48k in revenue in the last quarter, on losses of $1.5 million, and does little out-of-band authentication business anymore. Instead, StrikeForce is focusing on the keystroke encryption software market. When it comes to potential licensing and litigation, StrikeForce alludes to the high road. "We're the good guys. We want to work with everyone that's out there delivering out-of-band authentication," Waller says, adding more ominously, "We would like to work with them. We will also vehemently defend our patent and claims."
Authentify and PhoneFactor don't seem worried. Both own patents to their own technology. "If anything, we may take a look at their claims and determine what they, (Strike Force) may have to license from us," says Authentify CTO John Zurawski. Intellectual property law professor Paul Ohm, of the University of Colorado Law School at Boulder, says competing patent claims are common, and litigation can last for years.
Conveniently-for StrikeForce's claims anyway-the potential fight comes as out-of-band authentication gains traction, says Avivah Litan, Gartner analyst and resident security expert. And with Facebook and Google recently adding authentication with a one-time-passwords sent via SMS, the concept will soon have more exposure.
But for StrikeForce's Waller, this is a redeeming moment. "When I was out there in 2001, 2003 talking and showing people out of band, people were saying, 'You're out of your mind,'" he says. "Everyone was looking at me the way they look at the Galileos of the world when they say the world isn't flat, it's round."
I think all of us will want to know more about the litigation, how they are paying for it,any idea when it might settle or go to court.... and more about the share structure (i.e., 1.5 billion shares....yikes)
to pay for the litigation perhaps? Who would like to call Mark on behalf of the stockholders and ask why in hell they are doubling the authorized shares:
"On April 2, 2013, our board of directors authorized the increase of the authorized shares of common stock of the Company from seven hundred fifty million (750,000,000) to one billion five hundred million (1,500,000,000), $0.0001 par value.?"

The scam thing really doesn't work at this point, -- litigation with a respected law firm, --- Phonefactor who is infringing upon the real, and actual patent--, is probably quaking in their boots.... come on, you have to come up with something better than your normal bla bla drone
SFOR has been a potential client of Blank Rome for a number of years, and it sounds like the decision to move forward by SFOR is favorable in the current climate. Some have felt that PhoneFactor has been blatently using SFOR's technology and infringing against the patent for some time.....possible they felt that SFOR is the little guy and could never afford to take them to court over patent infringement.
PhoneFactor has had some arrogant responses to litigation by SFOR. (DD on the web from approximately 2009) This is great news. It could be that SFOR has finally come up with the cash to pay Blank Rome, or possible it is contingency payment to the law firm. Either way, this could be huge for SFOR, if they win, (and it sounds like it is definite infringement) for either royalties from Phonefactor, or a settlement. There are probably other companies infringing on the patent who could be in danger of royalties if this suit is settled in SFOR's favor.
I believe it was just last Friday. I was curious why no PR, since he had previously said he thought during the week (last week). He stated that some sort of news is forthcoming, suggested it will be this week, but not carved in stone. He is working with Investor Relations.
LOL, a lot of remarks on the board are off topic, but I quit removing so many of them because the whining got worse. You can only say "it is a real company", they really do have an address and they have a patent...blah blah....only so often.

- the pr was delayed and he hopes it will come out this week. But he is not in the business of pacifying the "bloggers" (his word), so it will come out when their investor relations puts it out. Sounds like soon. But he is apparently smarter than the pinkers think he is, because not getting boxed in a specific timeframe is the best thing a CEO can do.

Doesn't seem quite right. The good news though, is that this company is talking to all the national chains. Giant being one of them. Apparently they are taking their time, and not paying premiums to get shelf space so I guess it doesn't happen overnight. I have never been involved in the grocery biz, so not sure how it all works.
I can't see how online sales work with ice cream/frozen deserts... they would have to be packaged and shipped/trucked with a freezer. Wouldn't that be expensive to ship door to door? What am I missing here...
I wouldn't know. But those of us who have been in this stock for several years are familiar with this pattern. Insiders? Contractors? the norm, here in OTC.
This movement in price is probably not due to the financials. Clearly some PR or news is coming. My guess is next week. ;)

Exactly. I got and out the first day, with big bucks. And back in the second day which is when I think it crashed in the afternoon. Didn't have the guts to get back in after that.
Recovered a bunch in 2012, (not all) but just getting back in to a penny or two this year, busy as hell in the Fall and couldn't babysit the computer.

My opinion on this stock, and I'm not in it, is that it might not be a totally abandoned promo. I would not be surprised to see this recuperate next week.
Also, remember, that many of the posters here want nothing to do with TBX and APS. Personally, I wouldn't abandon this just to free up money for those two promoters. I'm fairly experienced with both those two outfits, and they are just as risky as any other play, even if you can get in early, in my humble opinion.

I specifically asked Sam if the product was going out of business, and that some stores were showing clearance tags, as if they would not be buying the product as of 5/4/13. He asked which ones, and I said Publix in Florida (hope that was the right one).
He said it is bad information. They are not going out of business and bloggers are attacking the stock. He did say they WILL be releasing a PR next week.
