Good point.
My interpretation of the FDA communication is that marketing CBD for ingestion is illegal in the US. I'm guessing that TAUG has not contacted the FDA, for clarification about marketing their CBD gum, nor will they.
Many supplements were exempted from FDA regulation because they didn't appear to have any deleterious effect (and there was a huge lobbying push to reduce regulation that couldn't be justified). BTW, I applaud that decision.
Will CBD follow a similar path? It's up to our elected representatives. My guess is that it will take a couple of years, before CBD will be treated like other legal supplements, assuming there aren't any significant dangers to over the counter distribution.
CVS, et all, won't be selling over the counter CBD products until, the profit potential significantly exceeds the regulatory hassle and risk.
IMO, CBD is the modern equivalent of snake oil. Other than relief from some forms of childhood epilepsy, there are literally no, reasonably sized, double blind tests, showing efficacy for anything.
My best guess is that the investment trajectory for companies targeting CBD consumer products will be similar to the pet rock.

This direct communication from the FDA doesn't specifically mention CBD in soda or snacks. Since there may be some ambiguity, surely APYP has asked the FDA for clarification - right?

I'm completely convinced that The Theater Building has no tenant and is currently up for sale.
In my mind, that is the primary fact that really matters. The Chicago funding was for an entertainment center at that location. It was for something that no longer exists and has been explicitly removed from their list of funded projects. It's not a clerical error of omission. It was intentionally removed. Why?
If you disagree with this perspective, do your own research. Don't ask those of us, that have already done enough research to form firm opinion, to do it for you.
As for the assertion that we just need to sit back and wait for further details from Ed, we disagree. If Ed still has an agreement for Chicago funding, it would be easy for him to provide credible proof without divulging details that would be imprudent. Why hasn't he? The only plausible reason I can come up with is that the no-funding allegations are true.

I'm not against CBD. The seizure reduction evidence, for some children, has been compelling for several years.
Since CBD doesn't appear to be harmful, I'd prefer our Federal government to back off. No laws against it. And most importantly, no laws that make real medical trials difficult.
I suspect we largely agree.
But, most of today's CBD products are being marketed as modern day snake oil.

Thoughts on CBD Products
The biggest risk with CBD is that it's a modern version of snake oil, with the single exception of helping with a rare form of childhood seizures. There doesn't appear to be any unbiased proof that it provides pain/tension relief or anything else beyond that of a placebo. "Studies" by CDB marketing companies or affiliates don't count. It appears to be a fad, but looks like it will last a lot longer than the Pet Rock. It may be like homeopathy.
The legal constraints and barriers appear to be rapidly dissolving. That will reduce the cost of distribution and the risk of retailing. It will also increase competition and reduce market prices/margins.
TAUG is late to market. It doesn't much matter whether the form is roll-on, gum, lotion, lip balm ... There are MANY established small competitors already selling all of these CBD products. A broader choice of flavors or hype like "Gluten Free" isn't likely to significantly differentiate TAUG's version(s).
So what to do?
How about picking a niche within the "CBD market" and concentrating on that niche. Strawberry gum lovers is probably too narrow. And anyone interested in trying CBD gum, is probably too broad.
An approach that created a viral buzz would help.
