Yep. Just before it was unsealed, Pence spoke briefly. He really needs to make up his mind. He started out by saying he didn't know what was in the indictment, but that he felt the DOJ was way too aggressive, yada yada, but then on the other hand, no one is above the law.

Trump will have trouble finding lawyers qualified to defend him in Florida: report
One of the first challenges former President Donald Trump will face now that he has been indicted for the mishandling of classified information in the special counsel investigation of Mar-a-Lago is that he needs to assemble a legal team — and the trial will be taking place in South Florida, rather than Washington, D.C., where people were expecting the case to be filed.
And that could be a problem, argued legal affairs correspondent Paula Reid on CNN Thursday, because there simply won't be a lot of lawyers willing and able to work for him.
"One of the things that struck out to me today as we pointed out what Trump is doing at Bedminster is one of the aides that was at the center of this, Walt Nauta, was with him in Bedminster," said anchor Kaitlan Collins. "What is Tuesday going to look like? It raises a question about what the legal team will look like on Tuesday, who goes in with him."
"That's a great question," said Reid. "Off the top of my head, I believe only one of his attorneys is barred in Florida. Depending on which legal team is taking this week, one or two people barred in Florida. But they will likely be looking, and I know some folks who have even volunteered to potentially be on the case down there, thinking it would be interesting. Hey, it could even be an adventure to join this case. I said, you have no idea. They will absolutely likely need to bring in additional counsel in Florida, people with expertise in this matter who are barred down there, who know the judges. So it will be interesting to see."
"As we know, he has had a little bit of difficulty retaining lawyers," Reid continued. "There are a lot of law firms who won't take him on. They're worried their bills won't get paid. But there are some interesting constitutional questions here. But he will absolutely have to recruit likely one or two more lawyers, because I don't think he has the right team to bring this in Florida."
Conservative attorney George Conway interjected to concur.
"Not only he has had difficulty — not only has he had difficulty obtaining and retaining lawyers, the lawyers that he has are mostly witnesses against him," said Conway. "So they can't. They can't. There is a lawyer advocacy rule that you cannot be an advocate and a witness in the same trial. So these guys are conflicted out."

Trump aide Walt Nauta indicted in classified documents case
An aide to former President Donald Trump has been indicted in special counsel Jack Smith’s investigation into the mishandling of classified documents from the Trump White House, two sources familiar with the indictment tell CNN.
Walt Nauta’s indictment is the second in the special counsel’s investigation after Trump was indicted on seven counts on Thursday.
An attorney for Nauta declined to comment. Nauta was with Trump at his Bedminster, New Jersey, golf club this week.
The specific charges against Nauta have not been revealed.
Trump responded to Nauta’s indictment on his social media Friday, writing, “They are trying to destroy his life, like the lives of so many others, hoping that he will say bad things about ‘Trump.’ He is strong, brave, and a Great Patriot. The FBI and DOJ are CORRUPT!”
Nauta’s involvement in the movement of boxes of classified material at Trump’s Florida resort had been a subject of scrutiny of investigators. Nauta, with the help of a maintenance worker at Mar-a-Lago, moved the boxes before the FBI executed a search warrant on the Palm Beach property last August.
According to court filings last year, the FBI found more than 100 documents marked as classified during the search, which took place weeks after a Trump lawyer signed a statement attesting that the Trump team had complied with a May subpoena seeking production of all documents with classified markings.

Once the surveillance footage was turned over, however, Nauta changed his story, CNN previously reported, and, after changing attorneys, the aide stopped talking to investigators all together last fall.

As long as Reinhart's name is also on the summons it remains unclear which of the two judges will preside in the trial.
And Cannon can't help but be mindful of how hard she was slapped down in rulings by two conservatives courts RE her special master bullshit.

The summons sent to former President Donald Trump and his legal team late Thursday indicates that U.S. District Judge Aileen Cannon will be assigned to oversee his case, at least initially, according to sources briefed on the matter.
Cannon's apparent assignment would add yet another unprecedented wrinkle to a case involving the first federal charges against a former president: Trump appointed Cannon to the federal bench in 2020, meaning that, if Trump is ultimately convicted, she would be responsible for determining the sentence – which may include prison time – for the man who elevated her to the role.
A federal grand jury voted to indict Trump on at least seven federal charges late Thursday as part of an investigation into his handling of classified documents, sources familiar with the matter told ABC News. The indictment comes after more than 100 documents with classified markings were found at Trump's Mar-a-Lago resort in August 2022.
Trump has repeatedly denied any wrongdoing and claimed again late Thursday that he was innocent.
Cannon is no stranger to the case. The 42-year-old judge appointed a "special master" last year to review those materials seized from Trump's Mar-a-Lago estate. Legal experts accused Cannon of handing Trump a series of head-scratching victories over the course of those proceedings.
ABC News left a voicemail with Judge Cannon’s chambers Friday morning seeking comment, but did not immediately receive a response.

In one instance, Cannon restricted the FBI from using the seized classified documents as part of their ongoing probe until she completed her review. Cannon's order was ultimately thrown out in its entirety by an 11th Circuit Court of appeals panel, which found she overstepped in exercising her jurisdiction in the probe.

In addition to Cannon, Magistrate Judge Bruce Reinhart's name also appeared on the summons sent to Trump on Thursday, the sources said.
Reinhart, who was sworn in as a magistrate judge in 2018, is also familiar with the proceedings against Trump: he signed off on the initial search warrant of Mar-a-Lago last year and later ruled to unseal the search affidavit – decisions that made him the target of antisemitic jabs on the internet.
Judges in most federal cases are assigned at random. But the apparent nods to Cannon and Reinhart on the summons for Trump might actually reflect the fact that both have already played roles in the proceedings, experts said.
"If the case is being overseen by the same district and magistrate judges, that means the court likely considered the indictment to be 'related' to the search warrant and intentionally assigned it to those judges," former senior Justice Department national security official Brandon Van Grack told ABC News.
ABC News was provided a case number that was part of the written summons and according to the federal court filing system PACER, that case number matches a docket under "Judge AMC." Cannon's full name is Aileen Mercedes Cannon.
Apart from her own previous involvement in the investigation of Trump, Cannon's assignment would put her at the center of one of what is likely to be one of the most consequential and scrutinized criminal cases in American history.
Her rulings on everything from procedural motions to Trump's planned efforts to have the case thrown out before trial will have vast implications for the course of the case leading into an election year where Trump currently holds the status of the Republican party's front runner.
I think people might be misinterpreting the Judge Cannon thing.
Court filings for the arraignment include her name. People assume she's been assigned to hear the arraignment.
The arraignment is in Miami.
Judge Cannon sits in Fort Pierce, which is over 100 miles north of Miami.
It would make no sense for one judge to travel 100 miles down to a place where there are multiple judges available to hear the case.
However, Judge Cannon did notoriously oversee the review of the documents that formed the basis for these charges.
Therefore, it's possible--and likely even, considering the logic of the situation--that her name was included simply because of her prior involvement on the case, not because she's been assigned to hear it.
Electronic court filings typically have a broad service list that includes all lawyers and individuals who have been involved in the case at some point.

After a lifetime of surviving close calls and acting with impunity, could it be that Donald Trump is finally about to be held accountable for his actions?
Media reports indicate that Trump has been indicted once again—this time in relation to the Mar-a-Lago classified documents investigation. The news is also historic in itself: this time, Trump will be a federal defendant, having been charged by the Justice Department.
Politically, it’s unclear whether this latest development will hurt or help Trump. He’s already using the event to fundraise and inspire his base, who see him as a victim. And already, Trump is referring to the indictment as “the Boxes Hoax” on Truth Social, while saying he’s “INNOCENT,” and insisting that “THEY’RE NOT COMING AFTER ME, THEY’RE COMING AFTER YOU—I’M JUST STANDING IN THEIR WAY!”
These sound like the ravings of an hysterical man who has always skated, yet may slowly be realizing that he could actually be held accountable—either legally or electorally. Clearly, Trump still doesn’t get that we live in a society of laws, or that such a thing as the rule of law applies to him. He soon might.
Still, there’s nothing about an indictment—or even a conviction—that would prevent him from running for president (although court appearances will likely keep him off the campaign trail for much of the 2024 primary campaign).
Trump’s first indictment out of Manhattan seemed to have ironically boosted his support among Republicans, inspiring once-and-possibly-future allies to circle the wagons. Indeed, the indictment seemed to halt the polling momentum that Florida Gov. Ron DeSantis was gaining on the former president.
This second indictment comes on the heels of former New Jersey Gov. Chris Christie and former Vice President Mike Pence entering the Republican primary, raising the prospect that there will be a second “rally around Trump” effect that could prevent this latest wave of Republican primary rivals from making gains.
If that doesn’t happen—or if the Trump boomlet is short-lived—it will be because this is a much more serious charge than the Manhattan District Attorney’s indictment having to do with payments to Stormy Daniels, and that Trump really has no good defense.
It seems very clear that Trump took classified documents and then refused to return them. Moreover, early reports are that this will be a “speaking indictment,” which means details of the charges will be included in the indictment and entered in the public domain. The more serious nature of these charges could cause political problems for Trump in a way that the Bragg indictment did not.
But if Trump does manage to pull off yet another Harry Houdini act in the legal realm, it will probably be because the trial will be in Florida, which is where the crime occurred. This is obviously a much better venue for Trump than, say, liberal Manhattan.
Anyone who has watched Trump closely has to realize that he is an escape artist, and that whenever someone says “the walls are closing in on him” they aren’t.
The culture of New York real estate allowed him to escape accountability for years, and then being president made him essentially above the law. Whether it’s his “perfect call” with Ukraine’s president or his incitement of the Jan. 6 Capitol riot, his pattern is to call accusations a “hoax” or a “witch hunt.” This latest indictment is no exception.
And then, once denial becomes untenable, Trump’s next move is to say that “other guys do it, too.”
Trump is trying out this move on Truth Social, saying, “Joe Biden has 1850 Boxes at the University of Delaware, additional Boxes in Chinatown, D.C., with even more Boxes at the University of Pennsylvania, and documents strewn all over his garage floor where he parks his Corvette, and which is ‘secured’ by only a garage door that is paper thin, and open much of the time.”
Never mind the fact that Joe Biden and other former officials like Mike Pence seemed unaware the documents existed, and immediately returned them when discovered, while Trump spent months refusing to give hundreds of documents back, and according to reports, some of the documents he had were highly sensitive.
Nobody should assume Trump has finally been brought to heel. He has nine lives, so to speak. But this indictment feels much more critical than Bragg’s indictment and more legally perilous that the E. Jean Carroll civil trial. Indeed, sources tell The New York Times: “The seven counts against the former president include conspiracy to obstruct, willful retention of documents and false statements.”
But it's the potential Georgia indictment (regarding his “perfect call” with Georgia Secretary of State Brad Raffensperger) that will probably be the biggest of all. That’s the one where he’s attempting the coup. On tape.
Will this third indictment be “three strikes and you’re out”? Or might this second one do the trick? Stay tuned. Trump will have to appear at the Federal Courthouse in Miami, Florida, on Tuesday, at 3 p.m.
That could be the beginning of the end for a career of criminality, or the beginning of another Trump escape act.

Here's what we know about the 7 counts Trump is facing in classified documents indictment
An attorney for former President Trump said Thursday night that the former president is facing charges on seven counts related to his handling of classified documents.
While Trump lawyer Jim Trusty told CNN that the former president’s legal team has not yet seen the actual indictment, he said the summons they received suggested that the counts “basically break out from an Espionage Act charge” and “several obstruction-based type charges and then false statement charges.”
Trusty also said he believed there was a conspiracy charge — a sign others could face charges in the matter.
Espionage Act
The Espionage Act, passed in 1917 during World War I, sought to crack down on activities considered dangerous or disloyal, including passing defense-related information to the country’s wartime enemies.
The law bars the “gathering, transmitting or losing defense information.” A record does not need to be classified to trigger the statute. A charge under this section carries up to 10 years in prison.
Obstruction
Trusty also cited a violation of Sections 1512 and 1519 of the U.S. Code, which fall under the larger category of obstruction of justice.
Section 1512 involves “tampering with a witness, victim or an informant,” while Section 1519 involves the “destruction, alteration, or falsification of records.”
Conspiracy
While Trusty did provide specifics on the conspiracy charge, several of the known charges include conspiracy provisions.
The witness tampering law includes a conspiracy provision that encompasses any of the actions barred under the statute, which includes several manners of obstructing an investigation.
The Espionage Act also includes a mention of such an offense.
False statements
Trump’s attorney did not refer to specific violations for false statements, which are a crime to provide to a law enforcement officer, but said that such a count was included in the summons.
The language of the statute specifically refers to a person who knowingly “falsifies, conceals, or covers up by any trick, scheme, or device a material fact.”
