Universal background checks: backdoor, illegal gun registration

Gun abiding
American Firearms Association, 2/26/2024:
Massachusetts Democrat Elizabeth Warren and Georgia Democrat Hank Johnson have introduced a monster Gun Control Mega Bill (S. 3407 / H.R. 6596)!
If passed, this legislation would:
>>> Create a national permit to buy a gun
>>> Establish a nationwide gun registry
>>> Institute a national ‘Red Flag Gun Seizures’ law
>>> Ban virtually every semi-automatic rifle in America
>>> Make it a felony to buy a ‘high capacity’ magazine
>>> Tax guns at 30% and ammo at 50%
>>> Put you in jail for buying more than 1 gun a month
>>> Force you to lock up your firearms at all times
>>> Criminalize the sale of firearms to adults under 21
>>> Ban the sale of suppressors
>>> Make it a crime to build a firearm in your own home
And that’s just the start, as this gun control monstrosity is well over 100 pages long.
Gun owners need to FLOOD Washington, D.C. with emails immediately.

Remington flees to a free state
By Mike McDaniel
The recent judgement for fraud against Donald Trump in a New York City Court, in a dollar amount higher than the GNP of some countries despite no one being defrauded, has revealed something many Americans didn’t know: New York State is driving out its most productive, tax-producing citizens and businesses. What happens to a state that, for leftist political reasons, purposely destroys its tax base? What happens to that self-defunding state when its federal Democrat/socialist/communist (D/s/c/) allies open the borders and send tens, even hundreds, of thousands of illegal immigrants to take advantage of the state’s self-imposed sanctuary? New York is finding out, and isn’t much liking it.
New England, since before the founding of the republic, was American’s primary gun-producing region. No longer:
The Remington gun factory nestled in New York’s Mohawk Valley is ready to shutter its doors and move to Georgia after more than 200 years in the Empire State.
"Two hundred and eight years of history. Gone, gone," Ilion, New York, Mayor John P. Stephens told the New York Times. "Ilion is Remington. Remington is Ilion."
Remington is the nation’s oldest gun manufacturer and told union officials late last year that company chiefs at RemArms, the current version of Remington Arms, made the decision to end its New York manufacturing come March. The remaining operations located in Ilion will move to Georgia, where company leaders say the firearms industry is supported and welcomed.
Even after the Supreme Court’s Bruen decision, New York D/s/cs, who control every lever of power, have continued to write blatantly unconstitutional anti-liberty/gun laws. Some have been quickly struck down—there are some New York judges who follow the Constitution--but others are working their way to the Supreme Court. D/s/c states do this to inconvenience law-abiding normal Americans, knowing it will take years to strike down their unconstitutional mandates. In the meantime, they can virtue signal, and even bankrupt and imprison Americans daring to exercise their Second Amendment rights.
"When Remington leaves, it’s not going to be like a facility leaving, it’s going to be like part of your family has moved off," Jim Conover, a retired Remington employee who began his career there in 1964, told The Associated Press.
A furnace operator and technician at the factory, Frank "Rusty" Brown, told the outlet that he and generations of his family worked at the facility and noted he and his wife will be out of jobs.
"My mom worked there. My dad worked there. My wife works there with me now. My daughter works there with me now. My second daughter works there with me now. And my son-in-law works there," Brown said. "So it’s a double-hit for me and my wife: two of us out of a job."
Many gun and accessory makers have fled their traditional New England Homes. Among them, Smith and Wesson moved to Tennessee, Kimber to Alabama, Winchester moved ammunition operation s to Mississippi, Stag Arms and Weatherby have moved to Wyoming. Remington already has facilities in Arkansas.
The closure of the New York location will result in about 300 people losing their jobs in a town of roughly 7,600. The mayor of Ilion told the Daily Mail that the village is expected to lose $1 million in revenue due to the move, in addition to other local businesses taking a financial hit.
Like other gun, ammo and accessory makers, Remington’s decision to move is not only financial. The anti-liberty/gun political climate is a major factor.
U.S. Rep. Elise Stefanik and state Sen. Mark Walczyk both previously blamed New York’s restrictive gun laws for the move.
"Hochul must stop her unconstitutional assault on the Second Amendment now," Stefanik said in December, according to the Times Union.
Walczyk pinned blame on New York’s Gun Industry Liability Law for pushing the company out of the state. The law, which was signed by former Gov. Andrew Cuomo in 2021, allows gun makers to be sued if they "knowingly or recklessly create, maintain or contribute" to violence.
"We are very excited to come to Georgia, a state that not only welcomes business but enthusiastically supports and welcomes companies in the firearms industry," RemArms CEO Ken D'Arcy said in a statement. "Everyone involved in this process has shown how important business is to the state and how welcoming they are to all business, including the firearms industry."
Remington’s move is part of a continuing trend of necessary and productive businesses moving to blue states that not only support, but embrace business, the Constitution and the rule of law, adding to their manufacturing and tax bases. More and more, red states are producers, while blue states are takers. Remington, setting up shop in a state with a more than willing labor pool, continues the American tradition New York has rejected.

LaPierre Attorney: AG James Wanted to 'Decapitate' NRA
https://www.newsmax.com/newsfront/lapierre-nra-gun-rights/2024/02/15/id/1153769/
Lawyers for the National Rifle Association and its former chief, Wayne LaPierre, said New York Attorney General Letitia James' goal behind her civil trial was to take down the gun rights group for political reasons.
"She wanted to decapitate the organization, and that was for political reasons," P. Kent Correll, a lawyer for LaPierre, said during closing arguments Thursday in James' lawsuit against the NRA and its former executives over years of questionable spending.
"This is a story made up by a person with an agenda that wanted him off the field," said Correll.
James, a Democrat, was not present in court Thursday.
"If this case was so important, why wouldn't she be here?" Correll asked.
"If this is a case about corruption, it wasn't corruption by the NRA," said NRA attorney Sarah Rogers.
She said the state's case showed the misconduct was committed "against" the NRA, not "by" the nonprofit.
"When the fraud was discovered, it dug in. It turned over the rocks it was told not to overturn. It took risks for the benefit of the organization," Rogers said. "The NRA left no stone unturned."
Correll argued that LaPierre's penchant for private flights was necessary for safety reasons, given his prominence in the contentious gun debate.
"He acted in good faith and with honesty, sincerity, and intention," he said. "There's no evidence that he received any benefits that he didn’t deserve.”
James filed her lawsuit in 2020, alleging LaPierre treated the NRA as his personal piggy bank.

Michiganders Beware: New Gun Laws Are in Effect
A look at the latest in gun control folly from the Great Lakes State.
by James Fite | Feb 13, 2024
As is so often the case, gun laws devised by gun-control advocates supposedly seek to make the world a safer place by disarming only the people who follow the rules.
Brace yourselves Michigan firearm owners: A bevy of new gun laws just took effect. From so-called safe storage requirements – which make home defense much more problematic – to the ineffective background checks and extreme risk protection orders that could see law abiding citizens disarmed without due process, it’s high time for a close look at the latest in gun control folly that makes the Great Lakes State a much more dangerous and less free place than it was just a day ago.
Safe Storage: Safer Only in Theory
Michigan residents are henceforth required to keep all firearms being stored or left unattended unloaded and locked away if it is “reasonably known” that a minor might be present. If a minor “possesses or exhibits” a firearm in a public place or in the presence of another person in a “careless, reckless or threatening manner,” the owner of the weapon is guilty of a misdemeanor criminal charge punishable by no more than 93 days in jail, a fine of up to $500, or both.
Should said minor then fire the weapon and injure themselves or someone else, that misdemeanor becomes a felony punishable by up to five years in prison and/or a fine of up to $5,000 – ten years and $7,500 if the injury is “severe.” If the wounded person dies, the punishment for the gun owner – not the minor who pulled the trigger – goes up to a potential 15 years in prison and as much as a $10,000 fine.
The real life-and-death issue here is in home defense. In theory, an adult with children living in the home could usually remain in compliance with this law and be ready to fend off a home invasion simply by keeping a firearm on their person even at home and locking any others away. That would work most of the time – taking a shower, changing clothes, or sleeping raises some issues, of course, as does playing with the kids while wearing a deadly weapon. But imagine all firearms but the gun-owner’s everyday carry piece are locked away unloaded where the kids don’t have access to them.
Now imagine the armed adult is away from the house while an older child is home, and a home invasion occurs. Even if the eldest has permission and access to where the weapons are stored, there’s the problem of retrieving that weapon from its locked location, loading it, and using it in self-defense before anyone with violent intent can act.
Michigan, at least, does address the issue of home defense by negating all this should the minor be acting in self-defense. Not all states do.
Virginia State Delegate Nicholas Freitas, the Republican representing Old Dominion’s 62nd district, asked that very same question just last month in the debate over Virginia’s own safe storage bill, HB183. In a short video posted to YouTube on Jan. 31, he explained the issue. Here is his own hypothetical question – and the insane answer to it:
“I said, ‘Look, I get what you’re trying to do here. You’re trying to make things a little bit safer.’ I said, ‘However, I live in the country, where the police are generally at least 15 minutes away on a good day. So, if my 16-year-old daughter, who has been taught to handle and use firearms responsibly since she was five years old, if she’s home alone and somebody – oh, I don’t know, maybe that you let out on parole, because you do a lot of that around here – is kicking in our door in order to harm my daughter and she uses one of my firearms in order to protect herself, am I now a criminal?’ And after a very, very lengthy, lawyerly explanation, the answer was, ‘yep, you sure are.’ Make it make sense.”
But the core issue remains: An unloaded firearm locked in a box is useless. That’s fine for hunting and sporting guns, but a home defense weapon must be reachable and usable by whoever is going to defend the home. The trick to this situation – as just about any rural gun owner with kids can tell you – isn’t to hide the weapons from the children, but to train the children in the responsible handling and use of the weapons.
Will the New Laws Work as Intended?
Safe storage requirements with both misdemeanor and felony penalties aren’t the only new Michigan gun laws that create crimes where none existed before or increase the potential for death by unintended consequences. One such law requires anyone who isn’t a federally licensed firearm dealer (FFL) to “complete a record in triplicate on a form provided by the department of state police” that includes either the buyer’s concealed weapon license number or, if they aren’t licensed, the dealer license number of the FFL who did the background check.
In short, all purchases – even between private individuals – must now go through an FFL for the sake of having a background check and a record of the sale.
The problem is that universal background checks don’t work. If a criminal is looking to acquire a gun for the commission of a crime, he already most likely plans to steal it or buy it from someone without going through an FFL – regardless of whether he can pass a background check or not. All this does is make a crime where no crime existed before. Those who plan to commit murder or robbery at gunpoint won’t be deterred. Don’t believe that? Just look at California’s atrocious record.
Then there’s the extreme risk protection order – or so-called red flag law – that just took effect. As is the case in most states with similar regulations, it is now possible for a judge to issue an order for police to confiscate weapons from a Michigan resident who has no idea that he or she has been ordered disarmed. What’s worse – again, as is the case in most of these states – Michigan allows no-knock warrants and pre-dawn raids. It shouldn’t take too much imagination to see how this could go horribly awry and cost the lives of law enforcement officers, residents who have committed no crime, or both. What reason in the world would an armed law-abiding citizen in Detroit have to believe that the gunmen knocking down their door at 3 a.m. without announcing their identity are police?
Foolish Gun Laws, Unintended Consequences
Another new Michigan law prevents people who have been convicted of domestic violence from buying, owning, or transporting a firearm for eight years after sentencing. This one may well save more lives than the others – but it also renders the convict, as all such “prohibited persons” laws do, unable to adequately defend themselves or their families. And of all the crimes for which people are falsely accused and convicted, domestic abuse ranks high, meaning there’s a much higher chance of disarming an innocent person than in most other situations.
The more astute reader has likely noticed the pattern here: Whether these gun laws achieve their stated goals or not, they all come with unintended consequences that could cost people who aren’t otherwise criminals their lives or their status as free Americans. As is so often the case, gun laws devised by gun-control advocates supposedly seek to make the world a safer place by disarming only the people who follow the rules.

YouTuber Booted From San Antonio Gun Buyback For Buying Firearms Off People In Line
This YouTuber is awesome......good article.........
Brandon Herrera, a firearm social media personality with more than 3 million subscribers on YouTube, visited San Antonio's first-ever gun buyback event last Sunday. He offered a more generous offer for those looking to dispose of their firearms: cash instead of the city's gift cards to supermarket chain H-E-B.
The city offered people $300 for semi-automatic rifles, $200 for handguns, $150 for a rifle or shotgun, and $50 for a malfunctioning or homemade gun. However, the gift cards were limited only to groceries at H-E-B.
Herrera published a video on his YouTube page that showed him and friends holding signs that read, "Licensed Gun Dealer ... $$$ CASH $$$ ... 4 Guns."
Then Herrera was booted from the property by police for buying the guns that were supposed to be turned into the city.
And others were doing the same.
The city handed out $175,000 in gift cards last Sunday. There was no word on how many folks traded guns for cash.
Studies have shown gun buybacks are ineffective. Only law-abiding citizens are handing over their guns - not criminals.

San Antonio, Texas to host ‘first-ever’ gun buyback so people can buy ‘food’ and ‘Christmas presents’
Think there will be proper ATF forms to fill out?

“Bidenomics” is working… if the goal is communism.
Yesterday, the San Antonio Express-News reported that the city would be holding its first gun buyback program this upcoming Sunday, and for every firearm sold to the state, a gun owner will receive a grocery store gift card—city councilman John Courage, a backer of the initiative, said this:
We can ask people to turn in weapons they no longer want, that they feel are a danger in their household, that maybe they’ve found, and exchange those for gift certificates so that people can go buy food for the holiday or go buy Christmas presents for their kids[.]
Now don’t forget, but the money for this buyback program comes from the taxpayer, because the government obviously doesn’t generate any wealth—they simply steal it—so about how much money are we talking?
There will be a limit of 20 weapons per vehicle.
The value of the gift cards depends on the firearm exchanged. The project will pay $50 for a nonfunctioning or home-manufactured weapon, $150 for a rifle or shotgun, $200 for a handgun and $300 for a semi-automatic rifle.
First of all, if a person would trade his right to self-defense and freedom from tyranny for a grocery run of bioengineered processed “food” or some catchpenny Chinese toys, well then, to take some creative license with a quote purportedly from Benjamin Franklin, “He who would give up essential Liberty to purchase a little ‘food’ or a few Christmas gifts, deserves neither Liberty, nor ‘food,’ nor Christmas gifts.”
Second of all, and this strikes me as oddly ironic, but the government and the gun control crowd of the left routinely decry the danger of private gun sales because no background check or paperwork is required, noting the buyer could be anybody. But what do we know about the government? Well historically, the government is the number one offender when it comes time to “gun violence.” Therefore, doesn’t it seem a little irresponsible, maybe even criminal, to sell firearms to a syndicate that you know is prone to using guns to commit violence against innocent people?
Now, if you look to history for retrospective insight, what have governments done after the people have been disarmed? The answer is democide, or state-sponsored murder (think Pol Pot, Mao Zedong, Joseph Stalin, Adolf Hitler), and we understand why the government wanted to disarm its people in the first place—murder was always the end goal, and buyback initiatives have long been a part of policies to disarm citizenries.
So when conservatives denounce “Bidenomics” as communism, we’re not just throwing out some dog whistle trigger word to whip up MAGA supporters into a frenzy, but we’re speaking to the very real financial destitution (people unable to afford the most basic necessity, food), and violent tyranny (what inevitably comes after the citizens have no more guns) that has accompanied every communist regime in history.
Like a lamb to the slaughter is anyone who exchanges their right to self-defense for cheap gratifications.

Federal Judge Strikes Down Two NYC Provisions for Gun Permit Issuance
Judge John P. Cronan struck down New York City gun controls that he found gave city officials unconstitutional discretion in the issuance of gun permits.
Cronan struck down NYC’s “good moral character” and “good cause” provisions, concluding that they gave city officials a degree of leeway in judgment sufficient to provide them cover in denying permits for law-abiding citizens.
He tested the two provisions in light of the Supreme Court’s Bruen (2022) decision, then wrote:
In sum, having considered Defendants’ proffered historical materials, and applying the standard set in Bruen, the Court determines that the magnitude of discretion afforded to New York City licensing officials … empowering them to evaluate an applicant’s “good moral character” and “good cause” in deciding whether to permit that applicant to exercise his or her Second Amendment rights, is not constitutionally permissible under the Second and Fourteenth Amendments.
Elsewhere, Cronan emphasized that allotting city officials the authority to judge “good moral character” and “good cause” in order to issue gun permits lacks “any grounding in our Nation’s historical tradition of firearm regulation.”
Moreover, Cronan found that the plaintiff, Joseph Spour, “suffered irreparable harm” in being denied his Second Amendment rights.

Gun Control: The End Results
By Civis Americanus
Albert Einstein said purportedly that "Insanity is doing the same thing over and over and expecting different results," and this applies squarely to restrictions on firearm ownership.
United Kingdom, June 1940
There was a time in the United Kingdom when there were few restrictions on firearm ownership. In 1920, however, the UK required people to get a certificate for permission to own firearms. "Applicants for certificates also had to convince the police that they had a good reason for needing a certificate." In 1937, "…the Home Secretary ruled that self-defense was no longer a suitable reason for applying for a firearm certificate and directed police to refuse such applications on the grounds that "firearms cannot be regarded as a suitable means of protection and may be a source of danger." ("Crime and justice since 1750" elaborates on this.)
Then Germany overran France and drove the British Expeditionary Force back across the English Channel minus most of its heavy weapons. Now Britain faced the possibility of invasion by Nazis who would have done to its population what they had already done to Poland and France. The British Lion accordingly got on its collective knees to beg American firearm owners to "Send a gun to defend a British home." Luckily for the UK, the United States did not have "common sense gun laws" so we had extra firearms to share with them.
Did anybody learn from this debacle? Apparently not, as shown in 2022.
Ukraine, February 2022
As I wrote here when Russia invaded Ukraine in 2022,
"Ukrainians are being urged to arm themselves to resist the unprovoked Russian invasion of their country. The immediate question is, 'with what?' noting that Ukraine has exactly the kind of gun laws the Democratic Left wants to inflict on the United States. Handguns are illegal unless licensed, and licensing is "may-issue" the same way it is in New York. It is also necessary to have a license to purchase a long gun (as is the case in Illinois with its firearm owner ID card), and authorities can exercise discretion as to who can have a license. There are at most thirteen firearms for every hundred Ukrainians…"
Ukraine should have seen this coming in light of previous Russian aggression in 2014 as well as Britain's example, but it's obvious that those who do not learn from history are condemned to repeat it.
Israel, October 2023
When Hamas attacked Israel on October 7, they went from house to house to slaughter unarmed families in their own homes. Hadar and Itay Berdychivsky, who had served in the IDF, apparently did have government-issued permission to own handguns and fifty rounds of ammunition, and they fought back. Both were killed, at a cost of seven terrorists, while defending their children. There are two obvious lessons here.
As stated by Colonel Jeff Cooper, "A handgun is merely a weapon used to fight your way back to your rifle -- which you shouldn't have left behind." It is quite likely that two Israelis with Army experience could have handled all the goblins (Cooper's term for violent criminals) with AR-15s, 30-round magazines, and spare magazines.
The fact that it took eight or more Hamas terrorists with automatic rifles to kill two Israelis who had only sidearms, and lost seven KIA to do it, underscores the inferiority of the Hamas invaders to the Israelis.
In contrast, this is what happens when terrorist rabble attack Israelis who have access to long arms and no ammunition limits: "The Hamas was no match for an intrepid 25-year-old Israeli woman -- who saved an entire kibbutz from harm by leading a group of residents to kill more than two dozen advancing terrorists, including five she slaughtered herself."
The BBC adds, "Israeli gun ownership is low at about 2% of the population. …Usually citizens are allowed to hold a pistol and a limit of 50 bullets" which underscores the gross incompetence of the Israeli legislators who were responsible for the laws in question. Ongoing attacks and infiltration by Hamas made the events of last week easily foreseeable but the government left this law in place. Israel's "commonsense gun laws" resulted in hundreds of preventable fatalities which brings to mind phrases like "dereliction of duty." Israeli voters need to hold those responsible for this disaster accountable in the next election.
Three Strikes and You're Out
"Commonsense gun laws" have three strikes against them, two with massive preventable fatalities in Ukraine and Israel; the UK got lucky because Operation Sea Lion never went forward. Anybody who still supports "commonsense gun laws" is a dishonest or incompetent quack like Joe Biden, who depicts knife-wielding assailants as "unarmed" and suggests that defenders shoot to wound. If your life is really in danger, you must shoot to center of mass to stop and, if your life is not in danger, you must not shoot at all. Advocates of magazine size limits are clearly incompetent quacks as proven by events in Israel and also Massad Ayoob's expert testimony in Fyock v. Sunnyvale.

SCOTUS Won’t Lift Block On Red State Law Preventing Police From Enforcing Federal Gun Laws
The state asked the justices early October to block a federal court’s ruling against its Second Amendment Preservation Act, which exposes local police that aid in the enforcement of certain federal gun laws to up to $50,000 penalties. The justices declined to do so in a brief order Friday.
“Like many States, Missouri has disagreements with the Federal Government about the correct interpretation of the Second Amendment—and thus how to interpret and enforce certain federal firearms statutes,” Missouri wrote in its application. “In light of this Court’s recent Second Amendment decisions, the Missouri General Assembly believes that a small number of federal statutes may be unconstitutional; that the doctrine in this area is changing…and that Missouri officials ought to strive to comply with the Second Amendment to the maximum extent possible.”
