UN Plans for Global Gun Control

A UN conference on small arms trading began last week in New York, with the goal of creating global standards for the manufacture, sale, export, and possession of guns. While UN spokesmen claim that any proposals arising from the conference will not be legally binding, the organization's own website details an earlier conference in Vienna (March 2001) where delegates agreed to a "legally binding protocol against the illicit manufacturing of and trafficking in firearms" (italics added). Furthermore, UN Secretary-General Kofi Annan has been outspoken in advocating global gun laws, even proposing that small arms be supplied to governments only, and not individuals (as though governments use weapons wisely!). So it's obvious that the UN ultimately seeks to impose global gun control on individuals everywhere, despite any benign rhetoric. Clearly, every American who cares about the 2nd Amendment and the steady erosion of gun rights should be very concerned by this latest UN outrage.

The gun control conference merely represents the newest UN threat to our national sovereignty. The Constitution clearly requires Congress to enact U.S. domestic laws. No treaty or international agreement can transfer this legislative power from Congress to UN bureaucrats, and the 2nd Amendment plainly prohibits restrictions on private gun ownership by U.S. citizens. Yet the trend toward unconstitutional international laws already is firmly established. The UN wants to generate the same acceptance for global gun laws that it has established for global environmental and labor laws. As the global government trend intensifies, the conflicts between internationalism and sovereign constitutional government will only increase. The UN gun control conference provides Congress and the American people with an opportunity to affirm the supremacy of the Constitution and the 2nd Amendment over the dictates of global gun-grabbers.

The role of small arms in defending against aggression should not be overlooked. Gun control proponents like to characterize light weapons as ineffective in wartime, but history proves they are critical to the self-defense of nations. For example, badly outnumbered and outgunned Afghan rebels succeeded in creating havoc for the massive invading Soviet army using only light rifles and even handguns. By contrast, Jewish civilians in Germany who had been stripped of all weapons were unable to mount any resistance to Hitler's terror. UN gun control advocates ignore history when they attempt to link guns only with crime, and never with heroic resistance to tyranny.

The simple truth is that the UN is not concerned with our Constitution or our system of government. It is concerned only with expanding its power. It's hardly surprising that global government planners seek to impose global gun control, because disarmed nations will be that much easier to rule. Remember, the UN has much more power today than anyone could have imagined 50 years ago. So while it may seem far-fetched today that the UN could ever force U.S. citizens to turn over their arms, the current gun control conference could be planting the seed for such tyranny in decades to come. UN supporters like to ridicule the notion that the UN represents the beginning of one-world government, but what other label can be applied to an organization that seeks global laws, global courts, centralized legislative power, and a worldwide army?

With the stroke of a pen, the U.S. Justice Department has just subjected hundreds of thousands of Americans to a lifetime gun ban.

In an open letter to all licensed firearms dealers, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) unilaterally decided that any person who is prescribed marijuana for medical purposes is prohibited from possessing a firearm.

That means over 300,000 people in the states that allow medical marijuana suddenly cannot buy or possess a gun. Oh yeah, and for the many who already own firearms, watch out. They are now felons and could be subject to lengthy prison terms of up to ten years.

Gun Owners of America is not going to wade into the marijuana debate, but the fact that such a large group of people are losing their constitutional rights without even seeing the inside of a courtroom leaves a lot of people scratching their heads.

After all, this is the same Justice Department that, in 2009, basically advised federal prosecutors to turn a blind eye to medical marijuana use.

And, in a bit of twisted irony, the ATF itself has helped thousands of guns to get into the hands of known and dangerous drug cartels in Mexico through their operation “Fast and Furious,” which has led GOA to call for anti-gun Attorney General Eric Holder’s resignation.

The Justice Department makes it perfectly clear in the letter what it expects from gun dealers and gun purchasers, even though the Department and ATF obviously consider themselves above the law—both at the federal and state levels. According to the agency:

Any person who uses or is addicted to marijuana, regardless of whether his or her State has passed legislation authorizing marijuana use for medical purposes, is an unlawful user of or addicted to a controlled substance, and is prohibited by Federal law from possessing firearms or ammunition. (Emphasis added.)
Notice that persons need not be regular users of the prescribed drug; just the mere possession of a prescription card from a doctor is sufficient to trigger the gun ban. Firearms dealers are further instructed by the ATF:

If you are aware that the potential transferee is in possession of a card authorizing the possession and use of marijuana under State law, then you have “reasonable cause to believe” that the person is an unlawful user of a controlled substance.
As far as the overbearing, overreaching federal government is concerned, there is no need for a finding in a court of law that the person is a criminal, and there is no need for a finding that a person is a danger to self or others.

In fact, the gun ban is not even limited to when a person is actually using the drug for medical purposes. If you have the prescription card, you can’t own a gun—period.

This is just one example of how the government uses various existing laws to sweep people onto its gun prohibition list. The same thing occurred over the past decade to more than one hundred thousand military veterans who were prohibited from owning guns because of ailments such as Post Traumatic Stress Disorder (PTSD)—in this instance, too, without the benefit of due process of law.

The fact that the ATF is acting against a state-sanctioned medical issue is also particularly troubling. The reason Gun Owners of America has opposed ObamaCare so vociferously is over the concern that medical records databases could be abused by the government.

How many other heretofore legally prescribed drugs could be frowned upon by federal agencies and subject masses of people to a lifetime gun ban?

If the ruling in the ATF letter is allowed to stand, we will have allowed the federal bureaucracy to arbitrarily carve out—with no input from the peoples’ representatives in Congress—an entire class of persons for whom civil rights may as well not exist.

And, to make matters worse, this letter looks like more proof that the ATF is doing all it can to draw attention away from its own “gunrunning” scandal and to avoid investigating and punishing official wrongdoing along the U.S.—Mexico border.

Firearms training is essential to gun safety. The National Rifle Association teaches in their Basic Pistol training program that the two main causes of accidents are ignorance and carelessness. By ignorance, they mean a lack of knowledge of the fundamental rules of gun safety (always keep guns pointed in a safe direction, keep your finger off the trigger until ready to shoot, keep guns unloaded until they are ready to use, etc.), and by carelessness they mean a failure to apply those rules each and every time a firearm is handled.
The best way to be able to consistently handle a firearm safely is through training, whether it be informal training from a friend or relative or formal training from a certified instructor. Firearms training saves lives.

Gun and ammunition sales are hot

Start with a president who concerns gun-rights advocates and throw in a pending state bill that would require records be kept for handgun ammunition sales, and it's easy to understand why gun shops are doing a brisk business.

"Yes, we are benefiting because of an individual I didn't vote for, nor did anybody I know vote for. It is kind of ironic, isn't it?" Rich Howell, general manager of Olde West Gun & Loan, said of President Barack Obama's impact on his business.

Guns and ammunition sales at Howell's shop in Redding jumped about 50 percent in the first three months of 2009 compared with 2008.

The fevered sale pace has cooled. But business could pick up again as Assembly Bill 962, a bill that directs all California handgun ammunition vendors to keep records of ammunition sales and make them available to law enforcement, moves through the Legislature.

Authored by Assemblyman Kevin de Leon, D-Los Angeles, the bill also would require all handgun ammunition sales to be conducted face-to-face and vendors to be licensed by the Department of Justice.

The Assembly approved the bill 42-31 on June 3. It's moved to the Senate Public Safety Committee for a hearing later this summer.

"I'm not saying AB 962 and some other aggregate bills simmering in Sacramento don't put fuel to the fire. They do to a certain extent," Howell said. "But on the other hand, we have seen a tremendous increase in ammunition sales and gun sales since after the election, and really after the first of the year it took off."

The state reported that 9,512 guns were sold in Shasta County in 2008, a 3.3 percent increase from the 9,211 that were sold in 2007.

There were 425,244 guns sold in California in 2008, up from 370,628 in 2007, state statistics show.

[Tennessee] Senate passes Firearms Freedom Act:
The State Senate approved legislation today "that seeks to combat the destruction of the 10th Amendment of the Constitution by the Federal government in their attempt to infringe upon states’ rights."

Senate Bill 1610, known as the “Tennessee Firearms Freedom Act,” sponsored by Senator Mae Beavers, "takes a step in the right direction to restore to the states control of intra-state commerce and the regulation of firearms manufactured and sold within Tennessee," she said.

“Be it the federal government mandating changes in order for states to receive federal funds or the federal government telling us how to regulate commerce contained completely within this state – enough is enough,” urged Judiciary Chairman Beavers.

The state House of Representatives passed the companion bill (HB 1796 by Ben West and Henry Fincher) last week and the bill will now head to the governor’s office.

There were 87 representatives and 21 senators who voted in favor of the bill.
