After the Supreme Court’s decision in New York Rifle & Pistol Association v. Bruen, which essentially blew up one of the left’s favorite methods of limiting the right to keep and bear arms, blue states are trotting out new ways to enforce onerous gun control laws. While the court’s ruling has effectively eliminated “may issue” states in which officials could be more stingy with issuing concealed carry licenses, Democrats are trying other avenues to limit the number of law-abiding Americans who can arm themselves.
Blue States Continue Gun Control Agenda
After the Bruen decision was handed down, states like California, New York, and New Jersey passed a slew of measures designed to curtail the carrying of firearms in their states. They enacted legislation limiting the places one could legally have a firearm. In essence, they responded to the Supreme Court’s ruling by saying “Okay, you can get a license, but we won’t let you carry your gun anywhere.”
These laws are already facing legal challenges from pro-gun rights groups, who argue they violate the Second Amendment. But another method the anti-gun crowd is employing involves making it more cost-prohibitive and time-consuming for people to get a license to carry.
In California, state law “establishes a floor of $44 to be delivered to the state by the local licensing authority” and imposes a limit of $120 to obtain the permit, according to The Reload. It also allows local governments to require a psychological evaluation and imposes a 16-hour training requirement for which the applicant must also pay.
The city of La Verne revamped its application process to make it more expensive for residents to obtain licenses. It is charging over $1,000 for all first-time applicants. The Reload noted:
“The breakdown of fees is listed on the local police department’s website as $398 for ‘processing,’ a $150 administrative fee, a $93 licensing fee, $20 for fingerprint scanning, $150 for a department-approved psychological review, a $250 estimated cost for an approved safety and training course, and a $20 fee for the physical CCW card. All in, the city’s residents would have to fork over $1,081 just to carry a firearm in public for self-defense.”
New York allows licensing agencies a wide berth when determining how much they can charge for concealed carry permits. This means that the amount a New Yorker might spend to exercise their Second Amendment rights vary depending on the area in which they reside.
The New York Police Department requires applicants to cough up $340 for the initial application fee and for renewals, which are required every three years. It also levies $88.25 for fingerprinting and background checks. Residents are required to pay for an 18-hour training course, which can also cost hundreds of dollars.
Finally, we have New Jersey. The Garden State has a $200 application fee, along with another $20 to perform a criminal background check. One must pay $50 to receive the permit and also cover the costs of the training required by local police. Each department can impose its own fee for the training.
Increasing the burden even more, those who carry concealed will be required by law to “maintain liability insurance coverage insuring against loss resulting from liability imposed by law for bodily injury, death, and property damage sustained by any person arising out of the ownership, maintenance, operation, or use of a firearm carried in public.” The Reload notes that “ecause such a policy does not yet exist, and may never exist, the additional costs to comply are still to be determined.”
Discrimination and Constitutional Violations
By raising the amount of money required to exercise one’s right to bear arms, these states are engaging in a brazen attempt to prevent Americans from possessing the means by which they could defend themselves if the situation arises.
These new fees will be especially difficult for low-income black Americans, who typically live in areas with higher crime rates. These requirements call to mind the Saturday Night Special laws passed in the 1960s, which banned the sale of cheap handguns. The laws were specifically intended to prevent African Americans from becoming gun owners, as many could not afford to purchase the higher-priced firearms.
With all their talk of “equity” and “systemic racism,” one might think progressive politicians would be loath to enact measures that disproportionately oppress black Americans. Indeed, if this were truly about equity, would they not offer reduced fees for those who earn less than a certain amount each year? Each of these states has these types for programs for those wishing to obtain driver’s licenses, even though driving is not a natural right specifically protected by the US Constitution.
Nevertheless, the anti-gun left still maintains that fewer law-abiding Americans arming themselves is somehow making civilians safer from violent criminals, the vast majority of whom commit gun crimes using illegally-obtained firearms. As with the other Second Amendment infringing laws being put into place by Democrats, it is not a stretch to think these will also face challenges in court.

FOIA Request Uncovers FBI Effort to Get Hospitalized Americans to Forfeit 2nd Amendment Rights
The Washington Examiner reported new information Tuesday from a Gun Owners of America (GOA) Freedom of Information Act (FOIA) request showing the FBI “coordinated secretly with hospitals and medical centers to strip U.S. citizens of their rights to own, buy, or even use firearms.”
This news comes just months after a GOA FOIA revealed information about a form used by the FBI in an effort to secure forfeiture of Second Amendment rights.
On September 7, 2022, Breitbart News noted Ammoland.com warned of the FBI effort in 2019, after GOA discovered the “NICS Indices Self-Submission Form” in December 2019. The form gave Americans the opportunity to “voluntarily” give up their Second Amendment rights, allowing no means by which the forfeited rights could be resecured.
GOA responded to Ammoland’s warning by filing the FOIA and the Daily Caller subsequently observed that the FOIA request showed the FBI actually took the form to the homes of some Americans, presenting those Americans with the option of giving up their Second Amendment rights:
The forms were presented by the FBI to people at their homes and in other undisclosed locations, according to bureau documents unearthed through the Freedom of Information Act by the firearm rights group GOA…At least 15 people between 2016 and 2019 signed the secret forms, which ask signatories to declare themselves as either a “danger” to themselves or others or lacking “mental capacity adequately to contract or manage” their lives.
Now the Washington Examiner points out the use of the forms went beyond merely going to the homes of some Americans by actually using the forms in conjunction with some hospital stays.
For example, “Facilities in New Hampshire, Delaware, Massachusetts, and Oklahoma, used the gun forms and supplied signatory records to the FBI. The forms are from 2011 and 2019, the year the FBI has said it discontinued their usage.”
The 2011 usage of the form was done in November of that year and was signed by an Oklahoma “medical professional,” who included “their state license number.” The Washington Examiner indicated the form was submitted to the FBI by the “Oklahoma’s Northwest Center for Behavioral Health, a mental health clinic.”
Rep. Andrew Clyde (R) commented on the newest revelations regarding the FBI’s work to help citizens forfeit Second Amendment rights: “Make no mistake — the FBI is weaponizing NICS forms to advance the Left’s dangerous agenda of dismantling our Second Amendment liberties and disarming our nation. Congress must thoroughly investigate this troubling matter and hold all unelected, anti-gun bureaucrats involved accountable for forcing Americans to relinquish their constitutional right to keep and bear arms.”

Federal Judge Strikes Down Missouri Law That Blocks Local Gov’ts From Enforcing Federal Gun Laws
A federal judge Tuesday struck down a Missouri law that blocked local police and governments from enforcing federal gun laws, according to court documents.
U.S. District Judge Brian Wimes ruled that the Second Amendment Preservation Act, which allowed law enforcement agencies to be sued up to $50,000 for assisting in the enforcement of federal gun laws, is unconstitutional and violates the Supremacy Clause, further saying that it is “invalid, null, void, and of no effect,” according to the ruling in United States District Court for the Western District Of Missouri. The Department of Justice (DOJ) previously sued the state over the law, saying Missouri could not “simply declare federal laws invalid,” according to a DOJ press release. “State and local law enforcement officials in Missouri may lawfully participate in joint federal task forces, assist in the investigation and enforcement of federal firearm crimes, and fully share information with the Federal Government without fear of H.B. 85’s penalties,” Wimes wrote in the ruling. “The States of Missouri and its officers, agents, and employees and any others in active concert with such individuals are prohibited from any and all implementation and enforcement of H.B. 85”
Republican Missouri Attorney General Andrew Bailey plans to appeal the decision, according to KY3.
“As Attorney General, I will protect the Constitution, which includes defending Missourians’ fundamental right to bear arms. We are prepared to defend this statute to the highest court, and we anticipate a better result at the Eighth Circuit,” he said.
Other states have been working to adopt similar legislation to the Second Amendment Preservation Act following recent final rules for pistol braces and ghost guns by the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF) and calls for so-called “assault weapon” bans by the Biden administration.
Republican Ohio state Reps. Mike Loychik and Jean Schmidt introduced House Bill 51 into the Ohio Legislature on Feb. 15, saying the bill was a protection for police officers who did not want to enforce President Joe Biden’s “brigade against Ohioans.”
Republican Montana Gov. Greg Gianforte sent a letter to U.S. Attorney General Merrick Garland In February, saying that Montana will not enforce the ATF final rule for pistol braces. Gianforte believes the final pistol rule “erodes the Second Amendment,” further reminding Garland that Montana passed legislation in 2021 that blocks Montana law enforcement and employees from enforcing any federal law on guns, according to the letter.
Bailey did not immediately respond to the Daily Caller News Foundation’s request for comment.

Harvard gun study leads to unexpected results

A recent study came out claiming that states with tougher gun control showed lower levels of murder and suicide. News media outlets are all over this, but they missed a critical phrasing in their report: those states had less suicide and murder by gun. Their murder and suicide rates were not lower overall. In fact, in many cases, it was higher.
A study by Harvard took a look at firearm ownership, gun laws, and violent crime, and suicide rates around the world. It found that more guns do not equate to more deaths and fewer guns do not equate to fewer deaths. That's not surprising when you realize that someone who wants to kill themselves or other people, will find a way to do it no matter whether they have a gun or not.
The study shows that the rate of murder and suicide has nothing to do with whether someone has access to a gun or not. It looked at gun ownership in the U.S., Norway, Finland, Germany, France, and Denmark. The high murder rate in the U.S. is the exception, not the rule when comparing homicide rates to gun ownership rates.
In Luxembourg, for example, guns are banned, but the country’s murder rate is nine times that of Germany’s, despite Germany having gun ownership rates 30,000 times higher than Luxembourg.
The USSR took everybody's guns away. But by the 1990s the USSR had the highest murder and suicide rate in the world. Ukraine, Estonia, Latvia, and Lithuania along with countries in Europe showed the same results.
The UK banned most guns. Then the murder rate -- involving knives -- went up. People had just switched tools.
“Homicide results suggest that where guns are scarce other weapons are substituted in killings,” said the study’s authors.
The study concludes that “where firearms are most dense violent crime rates are lowest, and where guns are least dense violent crime rates are highest.”
When guns aren’t available for killing people, criminals just find another tool.

Biden and His Rogue ATF Better Brace for the Backlash

During his recent State of the Union address, President Biden demonized AR-15s as “assault weapons” even though they aren't.
That's obvious enough for anyone with knowledge of firearms.
With AR-15s, only one cartridge is expended each time the trigger is pressed, and these rifles are used for lawful purposes every day, with more than 24.4 million in circulation today. Biden failed to mention that more than half of the country opposes his proposed ban on millions of firearms, as the National Shooting Sports Foundation recently reported.
But this is only the tip of the iceberg for the Biden’s war on the Second Amendment.
With the exception of the Bipartisan Safer Communities Act (which didn’t ban or place restrictions on specific types of firearms, but did dump hundreds of millions of taxpayer dollars into mental health programs), Biden’s administration hasn’t made much headway with gun control through Congress. So the commander in chief and his stewards decided to weaponize the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) instead.
Start with the ATF’s crackdown on firearms parts and serial numbers.
Biden’s ATF appears to be the latest government agency to reenact George Orwell’s 1984 with their language alterations. Case in point is their sudden reclassification firearms parts as 'firearms.' They have now changed the definition of “firearm” to “include unfinished pistols that would only require a small amount of time and effort to complete.” They are also punishing gun manufacturers that sell firearms without serial numbers.
Over the past year, we have seen the CDC change the definition of vaccine, Merriam Webster change the definition of “anti-vaxxer” and then the White House redefined the term “economic recession.”
Now this mirroring of 1984’s Newspeak is impacting the firearms industry and citizens’ right to bear arms.
Under the ATF’s new rules, a pistol frame that has no associated jig and doesn’t even operate as a firearm, is now defined as a firearm and requires serial numbers and background checks, simply because such parts can be used in a crime.
From an open letter from the ATF to federal firearms licensees dated December 27:
"[P]artially complete Polymer80, Lone Wolf, and similar striker-fired semiautomatic pistol frames, including, but not limited to, those sold within parts kits, have reached a stage of manufacture where they 'may readily be completed, assembled, restored, or otherwise converted' to a functional frame," the letter reads. "Therefore, even without any associated templates, jigs, molds, equipment, tools, instructions, guides, or marketing materials, these partially complete pistol frames are 'frames' and also 'firearms' as defined in the [Gun Control Act] and its implementing regulations."
I discussed these new developments with Philip Smith, founder and president of National African American Gun Association (NAAGA).
He says that in theory, he understands the concept of concern over criminals having access to guns. But, Smith says, “when you have people that are just building a gun for their own leisure and their own home and they’re not selling that gun, I really do not see the harm in that, and I’m not trying to be dismissive or flippant.”
In the end, he says these regulations interfere with American liberty and not only endanger law-abiding citizens, but remove their favorite pastimes and passions as well. Smith likens individuals who build firearms as a hobby to someone that enjoys building and breaking down cars. “And I just think that takes away from the spirit of this country that I know, where people are allowed to enjoy the merits of being an American. And I’m not trying to be super patriotic but I am trying to be realistic that folks like building guns at home, a lot of them. So that’s just my perspective.”
There's more: The ATF has also redefined “rifle” in order to place it under new pistol brace regulations.
As many suspected, the crusade to “close the ghost gun loophole” by requiring serial numbers was only the beginning of this power grab by Biden’s ATF.
Now, they have gone as far as to criminalize handicapped gun owners. In the latest set of shenanigans from this new trend of bypassing Congress to create laws, the ATF has created a rule that now requires pistol brace owners to register their pistols as “short barrel rifles” (SBRs) with the federal government. If these legal gun owners fail to comply, they could spend up to 10 years in jail and face a fine of up to $10,000.
So here we go again with the Biden ATF’s Newspeak.
Once again changing language as they redefine “rifle” to be any weapon that is “designed or redesigned, made or remade, and intended to be fired from the shoulder.”
The ATF is giving gun owners 120 days to register their gun as a short barrel rifle, and they will also be slapped with a $200 tax. Aside from registering their gun as an SBR, the only other option for pistol brace owners will be to dismantle the firearm, surrender it to authorities, remove the brace or convert the gun with a different barrel. If the brace is removed, gun owners will also have to make sure the attachment is destroyed, making it unable to be reinstalled, or else they will be in violation of the ATF’s rule.
Second Amendment Foundation founder and Executive Vice President Alan M. Gottlieb told the Daily Caller News Foundation that it’s Congress that has the authority to define what a firearm is, not the ATF. The NRA says that the ATF has no authority to regulate braces separate from a firearm.
I asked Mark Oliva, Director of Public Affairs at National Shooting Sports Foundation, his thoughts on this latest move to regulate pistol braces.
Incidentally, the ATF had a booth at Shot Show, which is the NSSF-sponsored trade show for the firearms industry that just took place in January.
“There are concerns that some of these regulations have no foundation in law, it is up to Congress to decide what is law, and what is especially criminal law,” says Oliva.
“So when we talk about the definition of firearms and punishments that can go with it for illegal possession and illegal manufacturing for firearms, that is up to Congress.”
Oliva said that since the ATF is the industry’s regulating body, the NSSF tries to maintain a professional relationship with them and work with them in whatever capacity possible while also staying within the confines of the law. He says that the ATF’s booth tends to be one of the busiest at Shot Show, and he thinks it’s important the retailers, manufacturers, dealers and others from the gun industry have the opportunity to ask the ATF any questions they have. But regarding concerns over whether these new ATF regulations are unconstitutional, he likens this situation to the Supreme Court decision in June which restricted the EPA's authority to mandate carbon emissions reductions:
“The US Supreme Court said that the EPA was promulgating their own rules with force of law that had no foundation in law, they had to go back to Congress to do that so there are concerns, we expect there to be some challenges,” says Oliva.
“In the meantime we’re trying to make sure that we’re doing our best to ensure that our manufacturers, our retailers and dealers can stay within the confines of the law, make sure they’re not running afoul of that, and [that these organizations are] able to stay in business.”
Now let's look at the pistol brace backlash.
Many fear that these ATF regulations would leave the door wide open for the Biden administration’s previously-expressed desire to create a national firearms registry and confiscate weapons. This is why patriotic lawmakers like Louisiana Sen. John Kennedy and Florida Rep. Matt Gaetz brought the backlash in a heartbeat.
Senate Republicans Kennedy and Roger Marshall of Kansas immediately got to work with a Congressional Review Act they plan to introduce, which would render the ATF pistol brace rule null and void if it passes with a simple majority.
Marshall stated:
"The Biden administration’s war on every American’s fundamental right to bear arms is relentless and an offense to our founders. Congress must use every tool at its disposal to stop the Biden ATF from enacting this unconstitutional gun grab and creating its newly proposed anti-2nd Amendment gun registry. The Congressional Review Act is one of those important tools, and I’m pleased to co-lead this effort with Senator Kennedy."
A corresponding Congressional Review Act was drawn up by the House as well, spearheaded by Republican Rep Andrew Clyde of Georgia.
Another member of the House, Republican Dan Crenshaw from Texas, is reintroducing the ATF Accountability Act with bipartisan support, thanks to the bill’s co-sponsor, Democrat Texas Rep. Henry Cuellar. This legislation would create a formal procedure for firearms dealers, importers and manufacturers to appeal ATF regulations, which the ATF must respond to within 30 days of the appeal. Then the attorney general is required to respond to these inquiries within 90 days, and business owners appealing ATF regulations will also have the opportunity to have an administrative law judge hear their appeal.
Rep. Gaetz wants to take this all a step further and completely abolish the ATF. A few weeks ago, Gaetz introduced H.R.374, the "Abolish the ATF Act."
The ATF has claimed that the rule regarding pistol braces doesn’t apply to the stabilizing braces used by disabled gun owners. Instead, they claim these new regulations apply to the pistol braces that are used for shouldering the weapon as a rifle.
But Gaetz told Fox News Digital that "the people at the ATF making these rules fundamentally don't understand firearms."
"I think they are under the flawed conception that a stabilizing brace increases the lethality or danger of a pistol,” says Gaetz. “It seems the ATF is on a snipe hunt for regulatory action that virtue signals to the anti-gun left, but that has no real practical safety impact on Americans."
The Wisconsin Institute for Law and Liberty estimates there are over 40 million of these braces in the United States. And a lawsuit has been filed against the ATF on behalf of three military veterans who own these stabilizing braces. One of them is Darren Britto, a marine combat veteran and manager of training at Silverback Independent, LLC, Darren Britto. After suffering a rotator cuff injury, Britto had his pistol brace custom made.
“By having the brace I can affix it to my forearm and be able to have better control of the fire arm,” says Britto.

One thing is clear: Biden’s ATF has certainly entered new territory. And in coming weeks and months the firearms industry, members of Congress and other concerned citizens and businesses are likely to turn this pistol brace backlash into a full-on riptide.

The MSU shooter should have been in jail, but he got a plea deal for prior gun crimes

A shooting at Michigan State University left three people dead and five others wounded.
Once again, it was a preventable shooting. No, it could not have been prevented by passing more gun control laws, but it could have been prevented if local prosecutors had only enforced existing gun laws.
The shooter, Anthony McRae, was arrested in 2019 and charged with “carrying a concealed pistol without a concealed carry permit.” This is a felony that carries a potential five-year prison sentence and would have prevented McRae from being permitted to own a firearm once his sentence was up. Instead, he pleaded down to possession of a loaded firearm in a vehicle, which is a misdemeanor. Prosecutors dismissed the felony charge, and he served just 18 months probation instead. Also, and most importantly, he remained eligible to purchase and own guns.
None of this matters to Michigan Democrats, though. They have already begun standing on the corpses of the people McRae killed in order to deliver speeches in favor of more gun control. State House Majority Whip Ranjeev Puri began his official statement with “f*** your thoughts and prayers” while ludicrously claiming there had been 67 mass shootings in 2023 already. He wants “common sense gun reform,” which is never defined and, of course, never addresses the shootings that its advocates shamelessly exploit to promote it.
Today, we begin to collectively heal from the horrific events which transpired, tomorrow we work.

Had McRae simply been convicted of the felony he was charged with, this would never have happened. A five-year sentence would see him behind bars until 2024, meaning he wouldn’t even be able to commit this shooting. If he were a convicted felon, he also wouldn’t be able to legally own a firearm, which he has been able to do since his probation ended. Illegal gun possession is a red flag when it comes to criminals who pose a threat to the community.
The real question is why aggressively prosecuting gun criminals is so shockingly low on the Democratic Party’s agenda. They almost seem to oppose it, even though it is the one thing that could prevent shootings and reduce crime.
Instead, Democrats like Puri will continue to shame and smear people who point out the obvious — that gun control would likely have done nothing to stop this shooting, just like the vast majority of high-profile shootings we have seen. The common thread in these incidents is that of men with (often violent) criminal histories and countless behavioral red flags. If Democrats wanted to stop these shootings, that is where we would begin.
Instead, we will continue to get lectures about AR-15s and “expanding background checks.” We don't even know at this point what kind of gun he used (authorities did not release this information), but apparently, psychic Democrats already know which gun to ban — the one they always want to ban. It is the AR-15, a rifle, even though all rifles combined (not just AR-15s) are used in only about 3% of all murders.
In most cases, the gun laws already on the books are more than sufficient to prevent shootings like the one that happened at MSU. In this case, it is undeniable, as the perp would have been behind bars as a convicted felon. You would think that “common sense gun reform” would mean doing something meaningful — that is, cracking down on gun crimes and ensuring that gun criminals are not able to be free and legally own a firearm. Democrats still don’t see it that way.
