Second Amendment Advocates Say Federal Government Engaging in Gun Control by a Thousand Cuts

Millions of Americans face the prospect of becoming lawbreakers overnight, pending a decision by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) on the status of pistols equipped with stabilizing braces.
“It’s not an exaggeration; it’s not hyperbole,” said William Kirk, an attorney from the state of Washington. “Everyone is deeply concerned about this issue.”

“We now await the publishing of the Biden administration’s rule attempting to turn millions of law-abiding citizens into felons unless they comply with the ATF’s vague reinterpretation of what constitutes a short-barreled rifle, despite Congress taking no action to amend Federal law on this matter.
“My bill is the only way to ensure the Constitutional rights of gun owners are protected against the ATF’s reckless abuse of the NFA to justify its pistol brace rule,” said Marshall.
The number of Americans impacted is difficult to determine. The ATF estimates that 3 million pistol braces have been sold. Second Amendment advocates say the number is closer to 40 million.
At issue is a device introduced in 2012 to assist shooters with disabilities and others who may need help shooting pistols built on the AR 15 platform.
The stabilizing brace attaches to the rear of the pistol and the shooter’s forearm. This allows the shooter a steadier aim while holding the pistol with one hand.
In 2014 the ATF received requests from law enforcement and firearms dealers about the possible reclassification of pistols equipped with stabilizers as short-barreled rifles (SBR) under the National Firearms Act (NFA).
Those who contacted the ATF were concerned that the brace could be used as a stock, allowing the shooter to shoulder the pistol like a rifle.
The NFA was written in 1934 to address gangland violence.
The gangsters of that era often shortened the barrels of rifles and shotguns to make them more concealable. So, the government outlawed such weapons unless the owners paid a $200 tax and registered the gun.
ATF Considers Intent of Gun Owner
The NFA defines an SBR as “a weapon made from a rifle is such weapon as modified has an overall length of fewer than 26 inches or a barrel or barrels of less than 16 inches in length.”
In an open letter dated Jan. 16, 2015, the ATF indicated that the stabilizing brace alone did not reclassify the weapon as an SBR. Instead, the intent of the person who installed the brace was the determining factor.
In part, the letter reads, “Any person who intends to use a handgun stabilizing brace as a shoulder stock on a pistol [having a rifled barrel under 16 inches in length or a smooth bore firearm with a barrel under 18 inches in length] must file an ATF Form 1 and pay the applicable tax because the resulting firearm will be subject to all provisions of the NFA.”
This did little to settle the debate.
The AR15, reportedly the most popular rifle in the United States, is popular specifically because it can be modified to suit the shooter’s tastes. Various manufacturers sell kits and specialized parts for AR15 owners to customize their firearms.
Harmsen said the AR15 pistol with the stabilizing brace is one of the most popular items in his store.
“They’re used for self-defense, they’re used for hunting, they have a variety of uses,” he said.
The confusion has resulted in the ATF issuing, then withdrawing rules that didn’t answer all the questions raised.
The most recent rule was issued in 2020 and called for a worksheet to determine if the item in question constituted an SBR.
The government stated that items that didn’t garner enough points to avoid the SBR classification weren’t necessarily in the clear.
Points May Not Matter
On the worksheet, he first note clarifies that the ATF “reserves the right to preclude classification as a pistol with ‘stabilizing braces’ for any firearm that achieves an apparent qualifying score but is an attempt to make a ‘short-barreled rifle’ and circumvent the GCA or NFA.”
The rule gave those who owned the newly-illegal items options for correcting the situation.
First would be replacing the short barrel with a legal one at least 16 inches long. This would convert the SBR to a legal rifle under the NFA.
The next option is to remove the brace and modify it so it can’t be reattached to a pistol.
In an instructional video on his website, Kirk said this doesn’t necessarily mean destroying the brace, but it would have to be rendered useless for its original purpose.
Finally, the rule called for an “amnesty” period in which the new SBR owners could pay the tax and register their firearms without fear of prosecution.
Kirk takes issue with the idea of amnesty for an action that was legal when it was first undertaken.
“Now, with the stroke of a pen, the ATF is going to do an about-face on that?” Kirk said.
This, and other aspects of the rule, including claims that the ATF has no authority to regulate accessories, resulted in the ATF withdrawing this rule. The rule is currently being revised.
Second Amendment Advocates Expect Litigation
Erik Longnecker, deputy chief of the ATF’s Public Affairs Division, would not comment on the rule. Longnecker said the rule is still being written, but he expects it to be released this month as scheduled.
“Once the final comes, and barring any litigation, we’ll be free and ready to talk about it,” he said.
Harmsen and Kirk said litigation is guaranteed. Both warn that the real issue has little to do with braces or helping disabled shooters.
“Gun control is never about the guns,” Kirk said. “It’s always about control.”
Kirk said the Biden administration makes no bones about its desire for stricter gun control.
The strategy is to hammer away at the industry by increasingly tighter rules and regulations to achieve what cannot be done through legislation.
Kirk said Congress has shifted its authority to federal agencies and allowed them to issue rules with the weight of the law.
“The ATF routinely supplants acts of Congress. How is this not a violation of the separation of powers?” Kirk said.
‘You’re a Free American’
Harmsen agreed. Stressing that he is not an attorney, Harmsen pointed out that he—like most gun owners—can read and understand the constitution.
They also want to comply with the law. But that is made difficult by government agencies, he believes are focused on denying citizens their constitutional rights.
“The Second Amendment doesn’t say [a firearm] has to be practical. We have to fight this,” Harmsen said.
Kirk said the best course of action is for individuals to educate themselves and others and to vote.
“This is an all-out war on this right. We need to get out and vote; we need to nominate good candidates. We have an obligation to start educating people,” Kirk said.
Harmsen agreed. He said that people come to his store every day and ask what they should do in light of what appears to be an assault on their constitutional rights.
“We are not in a position to offer legal advice, and we won’t tell people to break the law,” Harmsen said. “We do urge people to be politically active. You do what you feel is right. You’re a free American.”

I remember one particular Christmas (68 years ago) when I was just 12. A neighbor had taken pity on me and took me small game hunting for the first few times the preceding fall. I had mowed lawns and done various chores to save up enough money to buy a 16 gauge single barrel shotgun so I could go with him, but had always wanted a .22 rifle. Up to that time I hadn't saved enough to buy one.
On Christmas morning there was a package under the tree with my Father's name on it. Mom had told me he was thinking about taking up golf, and the package held a couple of golf clubs. The shape of the package was such that her answer made some sense to me, so I bought it, hook line and sinker. When we got around to opening gifts, Dad asked me to unwrap his. When I removed the paper and boxing, lo and behold a Savage .22 rifle stared back at me. It was the best Christmas gift I ever got.
I still have that old .22, and take it out squirrel hunting on occasion. I also use it to keep the local groundhogs in check. The rifle is so old that it doesn't even have a serial number, but I love it.
It's a keeper. There's some youngun's out and about in this country

A Christmas Story – A Rifle for Christmas
The following story makes the rounds on the internet. I don't know if it is a true story or not but the story reflects the Christmas spirit and, to me.
Pa never had much compassion for the lazy or those who squandered their means and then never had enough for the necessities. But for those who were genuinely in need, his heart was as big as all outdoors. It was from him that I learned the greatest joy in life comes from giving, not from receiving.
It was Christmas Eve 1881. I was fifteen years old and feeling like the world had caved in on me because there just hadn't been enough money to buy me the rifle that I'd wanted so bad that year for Christmas.
We did the chores early that night for some reason. I just figured Pa wanted a little extra time so we could read in the Bible. So after supper was over I took my boots off and stretched out in front of the fireplace and waited for Pa to get down the old Bible. I was still feeling sorry for myself and, to be honest, I wasn't in much of a mood to read scriptures. But Pa didn't get the Bible, instead he bundled up and went outside. I couldn't figure it out because we had already done all the chores. I didn't worry about it long though, I was too busy wallowing in self-pity. Soon Pa came back in. It was a cold clear night out and there was ice in his beard. "Come on, Matt," he said. "Bundle up good it's cold out tonight."
I was really upset then. Not only wasn't I getting the rifle for Christmas, now Pa was dragging me out in the cold, and for no earthly reason that I could see. We'd already done all the chores, and I couldn't think of anything else that needed doing, especially not on a night like this. But I knew Pa was not very patient at one dragging one's feet when he'd told them to do something, so I got up and put my boots back on and got my cap, coat, and mittens. Ma gave me a mysterious smile as I opened the door to leave the house. Something was up, but I didn't know what.
Outside, I became even more dismayed. There in front of the house was the work team, already hitched to the big sled. Whatever it was we were going to do wasn't going to be a short, quick little job. I could tell. We never hitched up the big sled unless we were going to haul a big load.
Pa was already up on the seat, reins in hand. I reluctantly climbed up beside him. The cold was already biting at me. I wasn't happy. When I was on, Pa pulled the sled around the house and stopped in front of the woodshed. He got off and I followed. "I think we'll put on the high sideboards," he said. "Here, help me." The high sideboards! It had been a bigger job than I wanted to do with just the low sideboards on, but whatever it was we were going to do would be a lot bigger with the high sideboards on. When we had exchanged the sideboards, Pa went into the woodshed and came out with an armload of wood---the wood I'd spent all summer hauling down from the mountain, and then all fall sawing into blocks and splitting. What was he doing? Finally I said something. "Pa," I asked,"what are you doing?"
"You been by the Widow Jensen's lately?" he asked. The Widow Jensen lived about two miles down the road. Her husband had died a year or so before and left her with three children, the oldest being eight.
Sure, I'd been by, but so what? "Yeah," I said, "why?"
"I rode by just today," Pa said. "Little Jakey was out digging around in the woodpile trying to find a few chips. They're out of wood, Matt." That was all he said and then he turned and went back into the woodshed for another armload of wood. I followed him. We loaded the sled so high that I began to wonder if the horses would be able to pull it. Finally, Pa called a halt to our loading, then we went to the smoke house and Pa took down a big ham and a side of bacon. He handed them to me and told me to put them in the sled and wait. When he returned he was carrying a sack of flour over his right shoulder and a smaller sack of something in his left hand.
"What's in the little sack?" I asked.
"Shoes. They're out of shoes. Little Jakey just had gunny sacks wrapped around his feet when he was out in the woodpile this morning. I got the children a little candy too. It just wouldn't be Christmas without a little candy."
We rode the two miles to Widow Jensen's pretty much in silence. I tried to think through what Pa was doing. We didn't have much by worldly standards. Of course, we did have a big woodpile, though most of what was left now was still in the form of logs that I would have to saw into blocks and split before we could use it. We also had meat and flour, so we could spare that, but I knew we didn't have any money, so why was Pa buying them shoes and candy?
Really, why was he doing any of this? Widow Jensen had closer neighbors than us. It shouldn't have been our concern. We came in from the blind side of the Jensen house and unloaded the wood as quietly as possible, then we took the meat and flour and shoes to the door. We knocked. The door opened a crack and a timid voice said, "Who is it?"
"Lucas Miles, Ma'am, and my son, Matt. Could we come in for a bit?" Widow Jensen opened the door and let us in. She had a blanket wrapped around her shoulders. The children were wrapped in another and were sitting in front of the fireplace by a very small fire that hardly gave off any heat at all. Widow Jensen fumbled with a match and finally lit the lamp. "We brought you a few things, Ma'am," Pa said and set down the sack of flour. I put the meat on the table. Then Pa handed her the sack that had the shoes in it. She opened it hesitantly and took the shoes out one pair at a time. There was a pair for her and one for each of the children---sturdy shoes, the best, shoes that would last.
I watched her carefully. She bit her lower lip to keep it from trembling and then tears filled her eyes and started running down her cheeks. She looked up at Pa like she wanted to say something, but it wouldn't come out. "We brought a load of wood too, Ma'am," Pa said, then he turned to me and said, "Matt, go bring enough in to last for awhile. Let's get that fire up to size and heat this place up." I wasn't the same person when I went back out to bring in the wood. I had a big lump in my throat and, much as I hate to admit it, there were tears in my eyes too. In my mind I kept seeing those three kids huddled around the fireplace and their mother standing there with tears running down her cheeks and so much gratitude in her heart that she couldn't speak. My heart swelled within me and a joy filled my soul that I'd never known before. I had given at Christmas many times before, but never when it had made so much difference. I could see we were literally saving the lives of these people.
I soon had the fire blazing and everyone's spirits soared. The kids started giggling when Pa handed them each a piece of candy and Widow Jensen looked on with a smile that probably hadn't crossed her face for a long time. She finally turned to us. "God bless you," she said. "I know the Lord himself has sent you. The children and I have been praying that he would send one of his children to spare us." In spite of myself, the lump returned to my throat and the tears welled up in my eyes again. I'd never thought of Pa in those exact terms before, but after Widow Jensen mentioned it I could see that it was probably true. I was sure that a better man than Pa had never walked the earth, save One.
I started remembering all the times he had gone out of his way for Ma and me, and many others. The list seemed endless as I thought on it. Pa insisted that everyone try on the shoes before we left. I was amazed when they all fit and I wondered how he had known what sizes to get. Then I guessed that if he was on an errand for the Lord that the Lord would make sure he got the right sizes.
Tears were running down Widow Jensen's face again when we stood up to leave. Pa took each of the kids in his big arms and gave them a hug. They clung to him and didn't want us to go. I could see that they missed their pa, and I was glad that I still had mine.
At the door Pa turned to Widow Jensen and said, "The Mrs. wanted me to invite you and the children over for Christmas dinner tomorrow. The turkey will be more than the three of us can eat, and a man can get cantankerous if he has to eat turkey for too many meals. We'll be by to get you about eleven. It'll be nice to have some little ones around again. Matt here, hasn't been little for quite a spell." I was the youngest. My two older brothers and two older sisters were all married and had moved away.
Widow Jensen nodded and said, "Thank you, Brother Miles. I don't have to say," 'May the Lord bless you,' I know for certain that He will."
Out on the sled I felt a warmth that came from deep within and I didn't even notice the cold. When we had gone a ways, Pa turned to me and said, "Matt, I want you to know something. Your ma and me have been tucking a little money away here and there all year so we could buy that rifle for you, but we didn't have quite enough. Then yesterday a man who owed me a little money from years back came by to make things square. Your ma and me were real excited, thinking that now we could get you that rifle, and I started into town this morning to do just that. But on the way I saw little Jakey out scratching in the woodpile with his feet wrapped in those gunny sacks and I knew what I had to do. So, Son, I spent the money for shoes and a little candy for those children. I hope you understand."
I understood, and my eyes became wet with tears again. I understood very well, and I was so glad Pa had done it. Just then the rifle seemed very low on my list of priorities. Pa had given me a lot more. He had given me the look on Widow Jensen's face and the radiant smiles of her three children.
For the rest of my life, whenever I saw any of the Jensens, or split a block of wood, I remembered, and remembering brought back that same joy I felt riding home beside Pa that night. Pa had given me much more than a rifle that night, he had given me the best Christmas of my life.

Fortunately I live in a County in Pennsylvania where it is relatively easy to get and renew a carry permit. both my wife and I have them. IMO it is more important now than it has ever been. As we are in our eighties, we could easily be targets for the young thugs who are becoming more numerous by the day.

Glenn Suddaby, a District Judge in the Northern District of New York, dismantled on Thursday many of the more outrageous provisions of the law the state’s Democrat-controlled legislature hastily passed following the U.S. Supreme Court’s ruling in Bruen in June.
New York Governor Kathy Hochul called an emergency session of the legislature following that ruling (which affirmed the right of every citizen to carry a firearm in public and in the process ended New York’s previous restrictive law) in order to nullify it.
Without separation of powers whereby the judicial branch is called to counterbalance the legislative branch and rein in its natural propensity to overreach, the governor of New York and Attorney General Letitia James would immediately disarm every citizen in the state in the name of “keeping the citizens safe.”
Here is the siren song of tyranny sung by Hochul when she learned of Suddaby’s emasculation of the state’s new law: “It is deeply disappointing that the judge wants to limit my ability to keep New Yorkers safe.”
This is the same song sung by the state’s Democratic Majority Leader Andrea Stewart-Cousins when she presented the bill to the governor for signing back in June: “We are confident that we are providing New York, again, an opportunity not only to be able to have their concealed carry, but also to make New Yorkers safe.”
And the state’s far-left attorney general, Letitia James, plans to appeal: “While the decision preserves portions of the law, we believe the entire law must be preserved as enacted.”
Suddaby wrote:
Simply stated, instead of moving toward becoming a shall-issue jurisdiction, New York State has further entrenched itself as a shall-not-issue jurisdiction. And, by doing so, it has further reduced a first-class constitutional right to bear arms in public for self-defense … into a mere request.

On June 23, 2022, the Supreme Court held that N.Y. Penal Law … which conditioned the issuance of an unrestricted license to carry a handgun in public on the existence of “proper cause,” violated the Second and Fourteenth Amendments by impermissibly granting a licensing officer the discretion to deny a license to a law-abiding, responsible New York State citizen based on a perceived lack of a special need for self-protection distinguishable from that of the general community.
On July 1, 2022, New York State passed the Concealed Carry Improvement Act (“CCIA”), which generally replaced the “proper cause” standard with
(1) a definition of the “good moral character” that is required to complete the license application or renewal process,
(2) the requirement that the applicant provide a list of current and past social-media accounts, the names and contact information of family members, cohabitants, and at least four character references, and “such other information required by the licensing officer,”
(3) a requirement that the applicant attend an in-person interview,
(4) the requirement of 18 hours of in-person and “live-fire” firearm training in order to complete the license application or renewal process, and
(5) a list of “sensitive locations” and “restricted locations” where carrying arms is prohibited.

The CCIA’s “good moral character” standard appears fatally flawed in two respects.
First, it omits the qualifying phrase “other than in self-defense.”…
Second, and more importantly, the Court interprets the Supreme Court’s decision in [Bruen] as endorsing a standard that effectively compels (or at least expressly permits) a state to issue a carry license unless the licensing officer finds that the applicant is likely to use the handgun in a manner that endangers oneself or others (other than in self-defense) according to a standard that can fairly be called “objective”.
However, instead, the CCIA [the New York law] expressly prohibits the issuance of a license unless the licensing officer finds (meaning unless the applicant persuades him or her through providing much information, including “such other information required by review of the licensing application that is reasonably necessary and related to the review of the licensing application”) that the applicant is of “good moral character,” which involves undefined assessments of “temperament,” “judgment” and “[trust].”
Setting aside the subjective nature of these assessments, shouldering an applicant with the burden of showing that he or she is of such “good moral character” (in the face of a de facto presumption that he or she is not) is akin to shouldering an applicant with the burden of showing that he or she has a special need for self-protection distinguishable from that of the general community, which is prohibited under [Bruen].
In essence, New York State has replaced its requirement that an applicant show a special need for self-protection with its requirement that the applicant rebut the presumption that he or she is a danger to himself or herself, while retaining (and even expanding) the open-ended discretion afforded to its licensing officers

There it is, in black and white: The citizen applying for a license to carry is presumed to be unqualified and of poor moral character unless he or she “persuades” the licensing officer that he or she is of good moral character.
Under New York’s now-emasculated law, it would be one short step away from demands for “papers please!” by the Gestapo under Hitler’s National Socialism in the 1930s, if not for the separation of powers provided in New York State’s constitution.
