Y’all see the news out? Anyone who lost money here should get a nice little payout out from the class action
Do u have this date ? Usually 12 months from the filing deadline to the distribution date.. I thought it was October . Have u received any new emails ?
They keep delaying distribution.
Thanks King ... I was hearing before the first of the year but who knows I just hope they're sharing all that interest money in this settlement
I emailed the 'Biozoom Fair Fund' people yesterday (Dec. 6) and this was their reply;
'We are in the process of finalizing this case and plan to distribute in the next couple of months when we receive Court approval.'
Has anyone heard anything or received a refund?
I just received a call back from my contact handling the Biozoom distribution today 10-23-17. He stated that there were a couple of loose ends that were just tied up, he felt that the eligibility list would be sent off to the S.E.C by this Thursday 10-26-17. I asked him for his thoughts on a time line for final approval and distribution? He asked me not to hold him to it, but he thought within 5-6 weeks. This would mean around December 1st. He went on to say that it has a good settlement and could be in the 60% range or slightly north of that, but the S.E.C still has to sign off on the final settlement. He asked me to call him in one month, so I will follow up with him 11-20-17 just before the Thanksgiving holiday.
I have not. Have you?
Did anyone receive a check?
I too called the administrator's office. I explained about the email I received and asked about my claim. I was told that my claim was valid and would be paid, however there was no time frame. So we wait.
Ok, thanks for the info. We will see what happens in the near future.
the email that I copied and pasted here
I spoke with an individual who is working on the Biozoom distribution case today 8-22-17,, he stated that they were finalizing two "large" claims and then they would submit to S.E.C. He thought it would be a couple more weeks before they completed the large "one for one" claims. He asked me to call him back after Labor day for an update. Hope this helps all who are wondering.
Good news. Did you call or get an e-mail?
Your claim is in good standing and eligible for payment when we begin distribution.
Our goal is to finish administration and hopefully distribute by October 2017. There are many parties involved in the approval of distribution, so there is no exact date set at this time.
Please let us know if you have any additional questions.
Thank you,
Fund Administrator
Apparently claims are still being considered. Time keeps marching on.
SEC Bars Lawyer Who Committed Fraud
FOR IMMEDIATE RELEASE
2017-127
Washington D.C., July 19, 2017—
The Securities and Exchange Commission today barred a New York-based attorney from appearing or practicing before it and acting as an officer or director of a public company after finding that he made false and misleading statements in corporate filings.
The SEC’s order finds that David Lubin committed fraud while serving as a director and corporate counsel of Entertainment Art, a public company in which Lubin also was a large shareholder. Lubin negotiated the sale of all of the outstanding stock of Entertainment Art, including both restricted and previously registered shares that were purportedly “free trading,” to an acquaintance interested in purchasing shell companies. Absent a valid exemption, common ownership of all of the shares of a public company would require the owner to register the shares for resale to the public. According to the SEC’s order, Lubin fraudulently misrepresented in Entertainment Art’s corporate filings that the purportedly free-trading shares had not been purchased by the acquaintance. This left the false impression that those shares remained immediately available for public resale. During the next two years and until he left the company, Lubin drafted and signed SEC filings that continued to lie about the true ownership of the company’s stock.
According to the SEC’s order, soon after the company was renamed Biozoom, more than 14 million shares were resold to the public in an illegal unregistered distribution for illicit proceeds of $34 million. The SEC froze assets from the unregistered sales in 2013.
“As the SEC's order notes, Lubin drafted and signed misleading public filings and masked the true ownership and restricted nature of a significant portion of the company’s stock,” said Antonia Chion, Associate Director in the SEC’s Enforcement Division. “Lubin’s deception led to many of these same shares being illegally resold to the general public by others a few years later.”
The U.S. Attorney’s Office for the Southern District of Florida today announced criminal charges against Lubin.
The SEC’s order finds that Lubin willfully violated Section 10(b) of the Securities Exchange Act and Rule 10b-5, imposes a cease-and-desist order and an officer-and-director bar. The SEC’s order also prohibits Lubin from representing clients in SEC matters, including investigations, litigation, or examinations, and from advising clients about SEC filing obligations or content. The SEC ordered a public hearing before an administrative law judge to prepare an initial decision determining what, if any, disgorgement or monetary penalties are in the public interest.
The SEC’s investigation, which is continuing, is being conducted by Marc E. Johnson, Jennie B. Krasner, and Deborah A. Tarasevich, and the case is being supervised by Ms. Chion. The SEC appreciates the assistance of the Federal Bureau of Investigation and the U.S. Attorney’s Office for the Southern District of Florida.

Well.. I don't expect much, however it's so quiet here..meaning no one received their check yet..
They usually take 30-40%. I wonder what the deal is for this type of action? Perhaps the SEC has a cap on attorney's fees. Or more likely perhaps not.
The Attorneys will milk this until there is nothing left. Don't count on much, if anything.
They have time until Nov. Hopefully, I get something this summer.
Please note, these cases can take up to 12 months from the filing deadline to the Distribution date. If you have questions in the future, please email us at info@biozoomfairfund.com. Thank you for your patience in advance.
I think that is an accurate assumption. I was able to correct my deficiencies and the account administrator told me that there would be no further communication until they issue a letter on distribution.
Since some people received rejection notices (due to insufficient paperwork) about a month ago but others (including me) have received nothing I am taking that as a positive sign that my claim (and the claims of others who have not yet heard anything) is NOT rejected. Always an optimist that we'll get something back.
Has anyone heard anything or seen anything?
I have not received anything....
It's strange that I too received a letter saying my claim was rejected for the same reasons. I had sent them a package which included each transaction as well as a summary of my purchases of the stock which supported the time frame. Along those lines I also sent a follow up confirmation email that the package had been received. I received a vague confirmation back. So I have resent a signed summary of my purchases from my broker and a letter explain my previous support and asked once again for confirmation. We'll see how this goes.
No it means that they feel some documentation is missing and I have 20 days to supply it. What is missing is listed. Best to call them if this happens.
Meaning your case isn't qualified to get the money back???
Just received a rejection letter from Fair Fund. I will deal with that but just to let folks know that you will be receiving something very soon in the mail.
Thank you for the update
Go to biozoomfairfund.com I emailed and received emails from Dan who is the distribution agent. Dan said it would "most likely" be around June 1-17 before the distribution occurs. You will see on the web site the money has already been transferred to the distribution agent and as soon as they finalize their due diligence they will submit the final distribution plan to the SEC, following that the distribution is to occur!
Did anyone get a check by mail yet?
We are currently processing the claims that we’ve received. If your claim requires any additional supporting information, we will reach out to you by mail. Please note, these cases can take up to 12 months from the filing deadline to the Distribution date. If you have questions in the future, please email us at info@biozoomfairfund.com. Thank you for your patience in advance.
Sincerely,
Fund Administrator
The lawyer said April.. Just waiting
Nothing yet...I'm thinking March. Got any ideas?
I emailed the Biozoom fund regarding my submission. The response was that it wasn't in the system yet. Basically they told me that if they need anymore information they would let me know. Sounds like there's no incentive for them to do much of anything.
Did you get a confirmation?
According to the lawyer, it'll happen in April next year.
I contacted the Biozoom Fair Fund about getting confirmation that my paperwork had been received. I got a response that confirmations wouldn't be sent until after the 10/31/16 close date. As of today I have not heard from them, so I expect like every other bureaucratic organization, it will take a while. Hopefully we'll see some response before the end of the year.
Did anyone receive the check from SEC?

Biozoom is dedicated to the advancement of reflection spectroscopy as a commercial technology. Today's Biozoom technology can be used by anyone, anywhere, as a health and wellness diagnostic tool. The company is constantly researching new applications and innovations.
The Biozoom scanner is the result of more that eight years of investigation, innovation, engineering and collaboration. This remarkable handheld unit is used in concert with Biozoom’s equally sophisticated and medically validated analytical algorithms. At the press of a button, the scanner collects and sends spectroscopic data to Biozoom’s servers, which instantly returns biofeedback to the user.
The founders of Biozoom have been engaged in developing cutting edge optics since 2004. Over the past several years, the founders were involved in a variety of ventures, each dedicated to evolving the efficacy and practical use of optical scanners. Working with European telecom giant Vodafone, the founders developed an application for two-way remote telemedicine through cellular phone devices. In 2007, they undertook an engineering and development partnership with Carl Zeiss, which succeeded in miniaturizing the optical system considerably. After a period of grant-supported research and development, Biozoom's executive management established the company in 2013 to bring this extraordinary technology to the market.

Whether you’re a doctor or a patient, using the Biozoom Biofeedback Scanner to measure blood chemistry levels is as easy as 1-2-3:
1. Hold the palm-sized Biozoom Scanner against the skin.
2. Press a button.
3. Read the results on your smart phone, tablet, laptop, or PC screen.
Biozoom is fast: the analysis takes only 16 milliseconds. And it’s completely noninvasive. No blood samples are required. And there is no puncturing of the skin.
The Biozoom Scanner uses a beam of light to detect and measure antioxidant levels … vitamins … oxidative stress … and cyotochrom oxidase, a critical enzyme that aids in the production of energy in your cells.
The noninvasive optical scanner also measures VO2 max, the maximum amount of oxygen your body can use in one minute per kilogram of body weight – an indicator of your body’s endurance for physical activity.
Planned upgrades to the Biozoom device will enable measurement of blood alcohol, cholesterol, drugs, chronic venous insufficiency, blood pressure, smoke poisoning, and oxygen saturation HbO2.
The Biozoom Scanner is also being developed to be calibrated to measure blood sugar levels – an essential daily test for diabetics that currently requires a pin-prick with a sharp needle. The cost of treating diabetes in the United States is $220 billion a year.

MAYBE you’re old enough to remember Dr. Leonard “Bones” McCoy, the surgeon aboard the U.S.S. Enterprise starship from the original “Star Trek” TV series.
During a field mission, when a crew member was ill, Dr. McCoy used a “tricorder” – a tiny handheld medical diagnostic instrument – to read the patient’s vital signs in seconds. And he didn’t have to take a blood sample or puncture the skin with a needle to do it.
Well, now a technology company that recently went public – Biozoom, Inc. (BIZM) www.biozoom.net – has developed a real-life tricorder: the Biozoom Biofeedback Scanner.
The Biozoom Biofeedback Scanner is the only handheld diagnostic device of its kind worldwide that tests for your health WITHOUT blood tests or piercing your skin.
But the Biozoom Scanner, developed in partnership with Carl Zeiss and Vodafone (VOD), isn’t science fiction. It exists now. Units have already been built and used by doctors in hospital settings – with gratifying results. The product will soon be available to other health care professionals and the general public.
That means you’ll be able to monitor your blood chemistry at home – in seconds – without having your blood drawn through a needle at a diagnostic lab, and then waiting 3 to 5 days for the results. Or paying a big lab bill for the test.
The Biozoom Biofeedback Scanner has already been successfully tested on 1,200 patients. And the next generation of the device is being developed to revolutionize many areas of medicine ranging from biofeedback and oxidative stress to blood pressure and diabetes.
Already in development is a nanotechnology version of the Biozoom scanner technology. The apparatus will be miniaturized to the size of a microchip, enabling Biozoom’s biofeedback scanning capability to be integrated into smartphones and virtually any other small consumer device. Annual nanotechnology revenues are forecast to reach $1 trillion by 2015.
