A RRC representative paid a visit to the site of the well and reported back with the following. The well will be sealed and the responsible parties will be contacted.

Subject: Eberle et al # 1
Lorenzo-
Our field inspector located the well yesterday and noted the following:
1. No signs posted at any required locations.
2. Well # 1 shut-in with flow line valve shut with 300 lbs. pressure on the tubing gauge.
3. Two tanks on location - one tank approx. 1/2 full and the other 1/3 full of fluid. See attached new photo's.
I made a few phone calls yesterday and discovered the following:
a. According from Phil Mc Cool with Gene Day, Inc. (consultant), the well was re-entered on 03-09-2007 and re-completed on 03-30-2007. Perforations at approx. 4990'. He was to file Form W-2 for the operator, but they never called him back. He had hand written notes from a phone call in November 2009.
b. I called Randy Neirdfrof with Bulldog Well Service and he stated they were called to the location in October 2009 to "deepened the well" approx. 700'. They rigged up, moved in all their equipment in and was ready to began drilling operations. The operator (Thomas Gouger, Sr.) opened up the well ( 400-500 psi on the gauge) and it flowed. They were instructed to watch the well. After two days rig time, they were instructed to rig down, move off location. They never performed any work on the well in October 2009.
Tejones Operating Corporation is a delinquent P-5 / SB 639 operator.
We will send letters to the operator and I will instruct our field representative to seal the well next time he is in that area,
