apple has set itself up for a class action suit.

I hardly think so. People haven't said a particular battery time is of the essence in their buying - the question is if it fulfills reasonable expectations.

However I must admit if I had been in Apple's place I would have been tempted to install a power drain if I was going to put in different processors and program it to try and make the difference smaller! This sort of thing just causes trouble.
