according to michigan supreme court. the dominoes are starting to fall. nothing to stop other courts like michigan from reaching the same conclusion based on the facts of the case.
Now, I am not good at this, but it seems to me there is where the government assault on Fannie & Freddie comes into play. No, I do not know how, but IMO there seems to be something here which explains why the Fed (under Geithner) changed their rules of conservatorship against both Fannie & Freddie.
