My uneducated opinion is that CIRC or the Judge is making the motion to dimiss the case because Playboy INT continues to not provide any evidence indicating CIRC is in the wrong. Looks like they may not have separate hearing to determine to dismiss. Not sure what proof of service means though.

Im not a lawyer so all of this in stickly opinion.
