Your point 1A is the key: FDA approved 6 month PFS as the primary endpoint for the trial. That was announced May 17, 2012, which is after IMUC received the letter (2011) they published excerpts from yesterday.

So IMUC is IMUC, and NWBO is NWBO; they are very different.
