The FDA broke contract... And are going to lose quickly and badly in federal court... The FDA lost their absolute power when they signed a contract.


The law that creates the concept of a SPA specifically states that the FDA can void it in the event of new substantial science. It specifically gives the determination of what is new substantial science to the FDA.

They can off course go to Court. But they will certainly not win on the argument that "it is a contract". They will also not win on the basis that the decision was simply wrong. They will need to convince the Court that the decision was somehow improper or such. And that is a difficult job.
