Since it has become abundantly clear that the FDA is in bed with BP (GSK in my opinion) they would have rejected NCE already if prompted to do so. With this in mind, it appears GSK has future plans for Vascepa and will eventually prompt the FDA to declare EPA a new chemical entity...But, it won't happen until GSK gets their grimy hands on the patents. IMHO
Yes, the FDA is a corrupt now criminal organization. They clearly can make a decision to rescind a the SPA but exclusivity is just too difficult to call. Or...part of the corruption and Criminal Antitrust violations against the FDA, centers around exclusivity.
It's finally starting to be clear to all involved and not just a wacko theory of mine.
