That's exactly my point - what if the FDA doesn't settle and insists to fight the case? In essence - they can call Amarin's bluff and said, see you in court - which they are entitled to do.

This thing won't be quick, and would probably get pretty ugly.

Neither side is going to come out of it well though. For the FDA, they would probably lose the case. For Amarin, it's more a matter of how much the time- and financially-consuming case would drag on the depleting finances of a small biotech.
