Corp_Buyer, for the last 2 1/2 years IDCC bulls have been claiming that Irwin Jacobs has acknowledged IDCC's CDMA IPR. I have been about the only voice that has been countering these false claims. Whenever I asked for evidence to support these claims the bulls would post the same article. I took the initiative and e-mailed that article to Julie Cunningham at Qualcomm IR and she passed it by Irwin Jacobs (the founder and CEO of Qualcomm) for comment.

I've posted the response below which proves that the bulls have been spreading what (to me) was obvious misinformation on this important point for 2 1/2 years. But my point is that I am the type of voice that most IDCC bulls would recommend be silenced by the new IDCC investors because I am the one who is most effective at correcting the hype and lies that portray IDCC to be something that it's not and will likely never be.

That's the real reason the IDCC longs want FREE filtering for all, so they can instruct the gullible newbies to filter out the voice of reason and they can continue to marginalize those who bring the real facts to the table.

Here is the letter that has corrected 2 years of lies:

Dear Xxxxx:

I was not aware of this article, but I believe it is incorrect because we do not believe that IPR claims from others will affect our IPR. I would note that we have concluded licensing agreements with all of the major equipment manufacturers and in every case those suppliers pay the same royalty to QCOM for 3G as they did for 2G - and they pay the same rate regardless of which technology is deployed (CDMA2000, WCDMA, TD-SCDMA).

I checked with Dr. Jacobs on the specifics of the article. While we have indicated that many companies have or will claim IPR since the WCDMA standard was constructed by a large committee, Dr. Jacobs does not recall ever specifically naming Interdigital. He may have responded to a question by saying that Interdigital is among the companies who have made claims, but generally we don't discuss the claims of other companies. Dr. Jacobs has said that an early intent in the design of WCDMA was to avoid QCOM patents, but clearly that has failed and our patents are required for any commercial CDMA system.
