Thanks for posting. I am still holding.

I find her below response to be a little bogus:

"the NOA was filed only for the purpose of the trustee given time to review the case"


Maybe none of the large creditors filed because they knew this was done.

However, one thing I noticed is the Company's old audit firm was approved by the BK court to prepare and file the 2012 return, so there could be tax refund monies available.

Also, what about the BAC monies?

That's why BS withdrew the appeal, they were working for free to long and they decided the 60m to line their pockets was not worth it anymore. Their advice had to have been to withdraw the appeal. Funny, after it was to file a NOA.

SANDLER, BUFFY, and GUY finally sobered up and said "what, we filed a NOA? Why would we do that, we have nothing, we've been playing poker here. We have nothing."

Yuuuuuup. That's it.

guess i was right re; settlement, not gonna happen in the USA. See ABCP settlement only arrived AFTER a favorable ruling against the FDIC. They will only settle after a case is lost not before. INFACT the settlement there was for less then the judgement.

Glad I pulled out after i put a few things together.

1) stock was moving up on cult board memebers buying and thats it.
2) Settlement theories were baseless and did not make sense.
3) Freds posts while he sat on the ask

Trade, keep in mind the Government attorney told you they would not, did not and would never settle or something like that BUT HE DID NOT SAY THAT First Citizens DID NOT settle.

So in typical Government fashion put the blame on somebody else and force them to settle, making the Government look victorious and then pay them back later as is their norm. AIMHO!!!

What, if any, is the liability for this attorney and/or her firm if there is actually a settlement? She is a legal professional involved in this case and this cannot be overlooked, that she gave out previously unknown information. She has told a shareholder that there is no settlement and that information was used as a basis for others to sell their stock. Would she put this information out as fact if she knew it to be either wrong or misleading? I believe she and her firm would open themselves up to lawsuits if this information was false in any way. She did not say "there is no settlement from the FDIC", she said "there is no settlement", which opens the door up to other entities (FC) being included in that statement.

Docsavage- respectfully, this is far from a dead horse. The pps is the dead horse, not the fact that material information leaked from the FDIC to a single shareholder.

T- Ask Tyson if there is ANY form of agreement on the table or in process? http://en.wikipedia.org/wiki/Non-disclosure_agreement She will not be allowed to expose the facts of the agreement, but since you already publicly shared her thoughts on the status of a settlement, I'm sure she's allowed to share if an NDA has been signed or is in the process.
