The appellate court is not going to throw out GOOG's appeal. Validity was only one point of their appeal, which is now a moot point, but it's not their only point of error. I think it likely they are allowed to amend their brief, but even if not the remaining points of error will be ruled upon by the appellate court.

Also the appeal court could based on googles opening throw out the case, making them refile the entire case or find no appeal granted, could be wrong here but that is what i interpret could happen.
