Workaround will not be at play in appeal, they didn't mention it either because you cannot appeal something not ruled on they have to get hearing in district court be denied then they can appeal. Also the appeal court could based on googles opening throw out the case, making them refile the entire case or find no appeal granted, could be wrong here but that is what i interpret could happen.
