#38143 RE: piratica #38142

I believe the judge can do whatever he wants. Judge Jackson will rule when he is ready. Everyone can guess why he hasn't ruled yet, but in the end they are just guesses and nobody really knows for sure why he has yet to rule.

It is highly unlikely his delay is related to or will affect the USPTO & PTAB/BPAI re-exams and re-exam appeals for all claims of both patents ('420 and '664). There are years remaining in the processes, especially the '664 which (by my last check) hasn't even been rejected by the re-examiner.

Some dots just shouldn't be connected. The judge hasn't ruled yet, and like our own JJ Seabrook posted in message #37796: "The ball is still in HJJ's court, and no party is going to jump the net and go and try to make him shoot it."

In general, waiting for courts to make important rulings takes 3 things:

1) Patience
2) Some more patience
3) Even more patience than you ever dreamed necessary
