That may be correct that the detrebling statute has no temporal aspect. However, MU can only remain in this leniency program if they're truthful and forthcoming throughout the investigation. If Rambus asks MU if they conspired to kill RDRAM, then they must answer truthful. They can't say no to the question now, and later come up with a different answer to avoid treble damages.
