Well the whole thing is fishy IMO. But that's what happens when big money talks. Wouldn't be a bit surprised to see some off the wall ruling by HJJ. That's why I lowered my risk today. It's a mess with no real hard info to help sort it out. I'm only still here cause of what I believe should happen. Not what I expect to happen. The only thing you can expect is the unexpected to happen the way it has through this whole fiasco called a justice system.

The whisper number for a Microsoft settlement was $500 million not $1 million plus probably another $30 to $50 million for 5% of google settlement...


There definitely were some over the top estimates of a MSFT settlement. In April, Maxim published a $71 million net (which translates to roughly $135+ million gross) settlement projection. And there were many other forecasts, some on SA where the numbers came in at $300-$400 million.

Personally, I have gone on record to say a settlement with GOOG (and not the lesser infringer MSFT) could be in the $75-$125 mm range. So obviously MSFT would represent only a fraction of the amount attributable to GOOG.

This was another wake-up call for any new patent investor who dreams of hundreds and hundreds of millions (some even for billions) in settlement amounts. The reality is that jury verdicts rarely award hundreds of millions of dollars for past damages and settlements are generally agreed to at a steep discount to potential jury awards. Moreover, settlements commonly forgive much (or sometimes all) past usage in lieu of more generous/favorable future royalty terms.

Nevertheless, the takeaway from today's agreement is positive. It's good for VRNG in many ways. It's just not the super-duper catalyst so many convinced themselves it would be, despite all the logic in the world telling them it was not going to be.
