Not pessimistic, but realistic. Courts, as a general matter, do not rule on dispositive motions like this one from the bench. While it's not impossible, i highly doubt it will occur.

The Level II quotejust recently showed an open order for 10K shares at 19.30. Now it's gone.........either a sign of support or that someone decided to wait til the judge get's off the throne..........
