Why should the intention of the person make the sentencing any more or less severe than any similar crime? Whatever the person committing the crime thought at the time, the result is the same. Whether a person is beaten or shot because someone did not like the way they looked or for no reason at all, the victim is still beaten or shot.

OK, well I flat out disagree. If you have 2 people that commit the same crime except one did it out of hate for a group and one did it out of hate they should serve the same amount of time should be served. Just cause one's crime was backed by an ideology that our government doesn't agree with, doesn't mean they should be penalized by there opinion. Please don't give me, oh but the crime is being punished not the thought. If one man sevres 20 years and another serves 25. Then that man got 5 years taken away for his beliefs. That is simply unconstitutional.

If anyone wishes to discuss other problems with Hate crime legislation such as the damage it would cause race relations, let me know.
