#113973 RE: RSPennyStocks #113971

Yes I was apart of that class action conversation with you and at the time I too agreed that we should wait. The Board members are resigning at the conclusion of this chapter 11 and the time to pursue a suit against them is now. The truth is that the SEC may not be investigating because they RARELY prosecute in these matters. The truth is that it is my complaint with the FBI that sparked the SEC involvment into the dispute filed in bankruptcy court. The truth is that if criminal charges are filed it will most likely be brought by the FBI and not the SEC and since neither agency will confirm whether they are still investigating or not we should proceed as if they are not and hope that they are. This means doing everything possible to protect our investments. I think that the Board members are not sleeping well and we should keep the pressure on them. A class action should be our next immediate move. Slyder has requested the information from you to take the lead. It would be helpful if you were to send it to him.

Case Updates
In general, the Government attempts to identify each victim in a given case, and to provide those victims with the information relevant to the case through the Department of Justice’s Victim Notification System. In cases where, due to the number of victims involved, or for other reasons, such notification is impracticable, the Government may use other methods to communicate with victims, including posting relevant information online.
