Judge is also likely tasked with making sure the SEC resolved this in accordance to other, similar situations - i.e. precedent.

I would think that unless he sees something glaring, there won't be an issue. He's looking at fairness and consistency (with the penalty) given the SEC's findings, IMHO. Likely not looking at how the examination took place - he trusts the SEC has done that appropriately.
