Ronnie..Question..How will the $20 Million Kyocera check be accounted for , when IDCC announces its Third Quarter Report since it is not included in your 3rd Quarter Revenue analysis? TIA
Under the terms of the new patent license agreement and subject to certain KYOCERA options to convert the license to a royalty-bearing basis, KYOCERA is obligated to pay InterDigital a license fee of $50 million, which covers licensed product sales up to a specified threshold dollar amount. The $50 million fee is payable in four installments, including an initial payment of $20 million due in the third quarter of 2005, and three additional $10 million installments due no later than the third quarters of 2006, 2007, and 2008, respectively.

Preliminary EARNINGS projection for third quarter as follows:
Total Revenues $48.5m (midpoint of latest guided range)
-Operating Expenses -37m ($36.2m 1st quarter + $0.8m repositioning charge)
+Interest Income +0.6m
=Income Before Tax =12.1m
-Income Tax Expense -4.8m (at estimated 40%)
= Net Income =$7.3m
Basic EARNINGS per Share at 53.4m weighted shares = 14 cents per share
Diluted EARNINGS per Share at 56.5m weighted shares = 13 cents per share
