I wonder why Cisco didn't buy the patents? Who owns the patents should not even be a consideration, either you use them or you don't and if someone was smarter than you and bought them, then shame on you for either not buying them or for using them. What do you think John Chambers does when he pays a toll road tariff? He didn't have to use that road he could take a different route. The users of any patents can take different routes or pay to take the better route.

I didn't know that the owner of the patent had to invent it, I thought all they have to do is own it. I am sure most of the toll roads were not invented but followed the path of the first toll road ever used, which dates back to England and the collectors. Hence one would think every toll road is based on prior art and no one should have to pay.

My opinion and one would think it should be the courts and all sane peoples opinion if you use what someone else invented regardless of who owns it you either pay to use it or work around it. No exemptions should be given any company for prior art or any other reasons, simple answer DON'T USE IT OR PAY FOR IT.

In fact maybe the patent owners should use the toll road example in court. Why are states and counties allowed to use prior art to make money and patent owners not?
