Remember it was based on an old 2001 AMD64 spec.

While I can confirm the insurance policy idea from what I heard back then, I also heard Intel had an own implementation of X64, much less sophisticated than AMDs instruction set to protect IPF, and tried to convince MS to "adopt the least common denominator."
MS did not follow this but said it would write code for AMD64, not for less than that. This came to a surprise of Intel, not the challenges of the 90nm node.
