Personally I do not expect a decision by the CAFC. I believe the CAFC knows the USPTO approved the new patent claims desciption on the patents in the appeal. These new claims decription are different that those included in the appeal briefs. The CAFC knows these patents are the subject of a new ITC case. Why should the CAFC perform its own claims construction on outdated information when the ITC is going through the same process on the updated claims.
The above is just a thought and my current opinion. Given that the CAFC shall now issue a decision tomorrow to prove me wrong. LOL.
