"JBI is however REQUIRED to PAY Rocktenn a portion of the proceeds earned from the sale of any fuel/sludge product etc produced from the Rocktenn site..."

Is this the term of the agreement that you are relying on for that statement?

4.3 Revenue Sharing

Gross Revenue resulting from the sale of Fuel generated by the JBI Machines operating at the RockTenn Facility to third persons [***]. Gross Revenue resulting from the sale of Metals generated by the JBI Machines operating at the RockTenn Facility to third persons shall be [***]. Within [***], JBI shall provide RockTenn with [***] and together with RockTenn’s [***]

Or is it described more specifically elsewhere?

It's akin to having someone come and offer to remove all the dandelions from your lawn for free, because they want to make dandelion wine, and give you 20% of their wine sales.

Who would turn down that deal?

The only problem is that not too many people like dandelion wine =)

and given the FACT that JBI is solely responsible for any and all costs associated with the purchase of the processor and related equipment as well as installation, upkeep and any other expenses related to running the processor(s) including labor costs...along with any and all costs related to securing permits... it would be prudent to ask JBI's Mgmt what percentage of revenue is due Rocktenn... after all... if RockTenn's percentage is too high.. then perhaps shareholders will come to realize that any contract "similar" to the Rocktenn contract means disaster.
