If setting the trial date means that all the facts are in evidence(??), it seems like both parties would be ready to do some serious settlement negotiation.
Why risk a court ruling worse than what you are willing to offer or accept if you do not have to? Makes sense that both Lucent and IDCC would want to see how far apart they are before going to trial and risking a less favorable result.
