China is a problem for any company with intellectual property. However in most of the western world, governments do try to prevent the sale of products manufactured in China (or anywhere else) that violate legitimate IP. My take is that Star will face the same IP challenges as any other company.

Yes, I have an opinion on Chinese Copycats

When I Googled it, I accidentally came across another newsletter(Stock Gumshoe) that lambasted Cox's opinion that this is "the only stock you'll ever need." Which led to someone posting their opinion saying something like, "I am in pharmaceuticals and nutraceuticals. The Chinese will copy this product and sell it at a fraction of the cost..." (paraphrase). I have to say, that caught my eye because when I had been thinking about what could be a negative on this company and its product, that copycat issue was something that crossed my mind. Any opinion on that?



There is some validity to the comment. I think when the world learns how well Anatabloc really works for a variety of human conditions, we will see lots of copycats. Star has already had to shut down one company that was selling anatabine out of a PO Box (was it Texas?).

Star was recently granted a notice of allowance by the USPTO for a patented method to synthesize anatabine and the patent should be officially granted at any time. In addition, Star Scientific has filed for US patents and for patents at WIPO on the use of anatabine citrate for any human ailment known to be associated with NF-kB inflammation ..from RA to MS, from various forms of Cancers to Parkinson's, from Alzheimer's Disease to Waldenstrom Macroglobulinemia (I couldn't find anything starting with X, Y, or Z). The list in their WIPO patent application is 9 pages long.

So, when Anatabloc sales take off (as we are seeing right before our very eyes), Star will, at some point, have to defend themselves against infringers. But you know what they say about imitation (it's the sincerest form of flattery). When we start seeing other companies trying to sneak in sales of an Anatabloc look alike....we know we have made it. FWIW, I don't see a lot of Chinese copycats for Enbrel, Plavix, Singulair, Lipitor, Humira, etc.

Star will have to be ready to go after infringers and get injunctions on any sales of anatabine that violate their patents. But something tells me that by the time that comes, Star Scientific will have a war chest in the $ Billions, and any company that wants to fight them better have tons of money for lawyers and be ready to give up their profits when they lose. It is fortunate for Star investors that they had to learn the hard way (in the tobacco litigation) about protecting their intellectual property.

One more thing....in case you didn't know, the President and COO and COB of Star is Paul Perito, who is also the President of the Harvard Law School Association. Any company that has the head of the Harvard Law School Association as their President, Chairman, and COO is a force to be reckoned with in the courts (as big tobacco has recently learned).
