I vaguely remember that conversation now - I think you said that before, and someone else said there would need to be a specific distinction made that they would be issued as non-voting, and someone else said if it's equity, even non-voting equity, that it would still cause problems.

As careful as they're (the BoD) being with 4.75% instead of the SEC 5% rule, I'd have to think they'd be cautious enough to not press their luck on the preferred issue as well... but that's just my speculation. I have no absolute knowledge on that. (This is why I would expect them to float bonds before trying to issue preferreds)
