There have been plenty of newspaper articles mentioning 5% terminals and 3% infrastructure with no effect whatsoever. IDCC is not going to leak the info and only F&J knows what they will ask of the jury in the opening statement and final argument in the case. I can reasonably assume that F&J is not going to ask for an amount that they cannot back up with reasonable evidence. They will conduct the trial in an effort to maintain the utmost credibility with the jury. They will ask what they believe they can prove and no more. Many have said that they can use the Qcom rates, but I do not believe they will because it is a different technology and involves a much smaller share of the wireless market. It is their decision as to the amount they will seek and we must trust their judgment.
