Well, the shareholder letter did not come out this week. Those that scoffed at that prediction should be humbled. Now we hear from another independent IP source that, " ... the litigation over the '858 patent has been pending for several years and involves many parties. This is a very complex case from a procedural standpoint. While the Markman ruling has already been issued, the court's order pointed out that the discovery process has not been started." Those that scoffed at the information I developed from two IP attorneys that without settlement we are at least 2 and half years away from any money changing hands in this litigation should also be humbled. I will now say again, that without a reasonable settlement of this litigation a major even a minor major increase in the PPS is a long way off. So, if there is a news letter read very closely statements about the litigation; same is true for the 10K and the 10Q. The LITIGATION is the driver here, licenses, new employees, new patents, etc. are only window dressing for the moment. We need to have a positive closure of the litigation sooner than later and this outcome depends on both the plaintiffs (us) and the defendants (the bad guys) willingness to negotiate and settle. To most experienced eyes it looks as if the bad guys are in no mood to do this; the costs are too high not to battle to the end with a decent chance that the appellate court will over turn the district court based on their dislike of the claims construction. Very tenuous for us longs, and the patience of Job will be required. Those here for a quick path to riches, I am afraid are going to be disappointed.
